    Abbey T & Cs

    I have made successful claims with the help of the HSBC forum but I'm now helping my sister with her claim against Abbey. Can anyone point me in the direction/link for any Abbey T&C's that have been collected? I'm ideally looking for T&C's from November 1996 when the account was opened or January 2001 when the first charge was incurred. Many thanks in advance for your help. Thanks Mandy

  3. I have successully claimed charges back from my bank HSBC. My sister has claims with both Natwest and Abbey National and she has asked me to help her with the N1 form. I claimed mine back via MCOL so the N1 is new to me. She has forwarded me copies of the most up to date POC's (templates on CAG) to include on the N1 for both Abbey and NatWest. I have read through the POC's and in relation to Schedule 1 a precis of the banks T&C's can anyone confirm if it is ok to use them as they are (i.e. T&C's on NatWest POC dated September 2006) or should the precis be of the T&C's which were in place at the time the account was opened? When I sent my court bundle off I sent T&C's from 2004 which is when I opened my account. Any help appreciated. Many thanks Mandy
  4. Probably should post this in the Abbey forum but you guys have been brilliant getting me through my claim with HSBC. I'm actually asking on behalf of my sister. She is coming round to mine this pm to go through her claim. She has over £5,000 of charges to claim back from Abbey. She's done the prelim and LBA and is now stuck, she says she's not getting much help from the Abbey forum so I thought I'd see if you guys can help. Basically, she doesn't understand the claim process now for over £5,000 and I have to say nor do I. Does she need to file a claim on MCOL or direct through the courts. I think I'm right in assuming this isn't a small claim because its more than £5,000. Can someone just confirm the process so I can talk her through it when she comes round?   5. Same as Freaky, the charges I got back yesterday were for a joint account and the settlement letter they sent me required both signatures. I wasn't happy with the terms they were proposing though so sent my own acceptance letter signed only by me and I still got my money. Send your own acceptance letter and then give him half the money if he is that fussed, sounds like he's being a complete arse!
  6. Hello peeps! Well got my money today so have contacted the court. Looks like I got in there just in time after having just seen the news headlines about the FSA case against the banks. Thanks everyone for your help, it was hard work getting the court bundle together etc but worth it in the end. I'll be sending a donation. How do I get someone to put *******WON******* againsts this thread?
  7. Thanks Lateralus I'm going to send my response by email and by post so fingers crossed they'll get a cheque out to me asap as the account is now closed. I've left the bit about future charges in but amended it slightly to reflect the fact that the account is closed (its a joint account with my partner)but reserving the right to make future claims in respect of any another account still held in either mine or my partners name.
  8. Well - no phone call but I have received a response by email as follows: Dear Miss Kenny, We refer to your earlier email in relation to the above claim. Please find attached a copy of our letter to you dated 24th July 2007, the contents of which we trust are self-explanatory. (See attached file: Kenny-24Jul07.pdf) We look forward to hearing from you in due course. Regards, DG Solicitors The letter has made me an offer only a couple of pounds under what I was asking for £318.16 rather than £325, they've taken off the debit interest and there's a load of speil about how they don't understand why I've claimed it etc etc. They have asked me to sign the letter as acceptance and that this would be on the basis that I make no further claims and that it remains confidential. I'm want to accept but not on those terms, how do I do this? I would copy and paste the text but its in adobe and for some reason won't let me. If anyone can explain how I can attach it to a post I will do but thats the gist of it. Also, once we've settled do I just phone the court and let them know?
  9. Copy of my email sent to Kate Eaves this morning, will let you know what if anything is the response. Dear Ms Eaves I am extremely disappointed not to have received a single response to any of my letters regarding the above claim. Not wholly conducive to good customer service in my personal opinion. Additionally, I have sent you a copy of my court bundle and have not received one from you, I understand from the court office that they have also not received your bundle. I can only assume therefore that you have nothing to submit in terms of evidence for your defence of this case. I look forward to meeting you or another HSBC representative in court on Monday 30th July at 2pm. For your information, I will be the lady who is 8 months pregnant and currently on crutches.   10. Hello chaps - quick update. Phoned the court on weds 18th (court bundles due on 16th) to see if HSBC had submitted a bundle, nope nothing. I asked what that meant for my case and was told by the court office that it may just mean they had no supporting documentation for their defence so would have to wait and see what happens at court date on 30th. Still no offer from D&G so I'm getting a little nervous now. Well, if I end up in court on Monday and HSBC/D&G don't turn up, being nearly 8 months pregnant and on crutches maybe the judge will take pitty on me and throw the book at the bastards!
  11. Might be a little premature but just want to know what happens next. I hand delivered my court bundle to the court on Weds and posted a copy to D&G recorded next day delivery. Bundle due date is tomorrow and court date is 30th. I haven't yet received anything from D&G in the form of their court bundle or an offer. If I don't receive anything tomorrow (the deadline) what happens next? Have HSBC defaulted by not submitting the court bundle in time to the court/me, is that it over? Any help/advice appreciated.   12. Oki doke peeps! Everything is pretty much ready to go, court bundle all bundled together, all pages numbered, contents page etc etc. Covering letters prepared and ready to send. Do I need to sign the Statement of Evidence at the bottom? Bit of a duh question, I expect the answer will be yes but just want to check, don't want to get anything wrong. Also will it be ok to hand my bundle into the court, it is literally 2 mins from my office so was planning on popping in with it on my lunch break. Will let you know how I get on, its due in on 16th so presumably so is HSBC's, doubt I'll get anything, then I guess I'll be back on here saying what happens next? Thanks Mandy

  14. Thanks, will leave it out for now but would be great to be able to get hold of a copy as I have referred to it in my court bundle. If I can't get a copy do I have to take the reference to it out? Also, how do I calculate the daily rate of interest until the claim is settled? I remember seeing a link to this somewhere but can't for the life of me find it now. This is for the section in my statement of claim which says: 29. Accordingly the Claimant claims: a) the return of the amounts debited in respect of charges and debit interest in the sum of £xxxxxxx; b) Court costs in the sum of £xxxx; c) The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year, from xxxxxxx to xxxxxxx of £xxxx and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £xxx. Its the daily rate in red I want to get right. Thanks Mandy

  16. Hey guys! Well my court bundle is getting there, I managed to find a very helpful friend with great printing/photocopying resources to help me, so no exorbitant copyshop charges and the prospect of a wasted costs claim! Yay! I have a question about the standard letters banks send out informing you of a charge. I never received any. I was informed of the charges I am claiming for simply by my charges summary at the front of my monthly statements. I am claiming for 3 lots of £100 which were taken from my account over 3 months. As I say, I never received a letter from the bank. Has anyone else come across this? Obviously I have explained this in my Statement of Evidence and I have provided copies of the charges summaries. Also, can anyone provide me with the link to the Austrailian Default Charges report by Nicole Rich, the links I've found so far take me somewhere completely different. This is the last thing I need for my bundle. Thanks Mandy
  17. Thanks again Pete, will give it a go and let you know what kind of response I get back, if any, so far I've had nothing to all my chaser letters. Thanks Freaky, we've currently got a Cannon which appears to drink ink cartridges at a rate of knots (not cheap to replace either), will get a quote first and then perhaps buy a new printer instead!

Thanks Pete Do you think it would be worth writing to DG again as I am doing so anyway and suggesting that I will be reserving my right to claim wasted costs in relation to preparation of the court bundle should they then settle to see if I could get them to budge? I work for a local authority and would risk losing my job if I used work resources even out of office hours. I don't know anyone with home printing/photocopying resources that I could use so it looks like a copy shop is my only option. I guess DIY in the copy shop would keep the cost down but I don't relish that thought being the size of a house and with swollen ankles. Might just have to swallow this one in order to see the rest of my money. Thanks for the advice though.

  20. My court bundle is due 16th July, court date 31st. Can I claim costs such as printing/photocopying if my claim is successful? My printer at home is crap, I don't have a photocopier. I have printing and photocopying facilities at work but they are strict on personal use. I think printing/photocopying 200 pages 3 times is pushing the boundaries a little. Plus I'm 7 months pregnant and just the thought of standing over a photocopier for 2 days gives me back ache. I'm thinking about taking everything to a copy shop but I guess the cost is going to be between £60 - £100. Can I claim this as reasonable costs if I win or will the judge think I'm being cheaky? I haven't been on here for a while, how are claims going generally at the moment. I'm getting really nervous and have thought about just jacking it in but the £300 will come in really handy for the baby which is pushing me on. How much will it cost me if I loose, we've got so much to buy for bubs I can't really afford to loose. Thanks Mandy xx

  22. Thanks Pete. I received Notice of Transfer of Proceedings (N271) on 8th May with the order that an AQ be dispensed with in this case unless the district judge at the court of transfer orders otherwise. I then received Notice of Allocation to the Small Claims Track (Hearing) N157 form with a hearing date of 30th July and the standard directions to present docs 14 days prior to the hearing. I've sent a chaser letter to D&G and will continue to do so every 10 days, I'll also send the letter and draft directions as suggested and see what happens. Thanks again Mandy
  23. Just been reading all the threads re the AQ having been dispensed with and potentially sending a polite letter to the court suggesting draft directions as well as chaser letters to D&G. I note they started in early April and was just wondering whether or not draft directions is the way to go and has anyone had an order granted as a result? Was about to send the draft directions but wanted to check if its worth doing or if I should just stick to the chaser letters to D&G? Thanks Mandy
  24. Thank you Zootscoot, I'll make sure I use the correct statement in my court bundle. Quick update, I've just telephoned and spoken with the Court Manager at the Court Office and he confirmed that they were not expecting to receive a statement of evidence from me within 2 weeks of the N157 notice and that I have until 16th July before I have to provide any paperwork. He apologised for the fact that N157 notice seemed unclear. Phew! I'll be sending the draft directions (after dispensation of the AQ) and a chase letter to D&G today though. Thanks for all your help, here's hoping I don't find myself actually having to go to court on 30th July, having said that though, the fact that I'll waddle in 8 months pregnant may work in my favour with the judge!!!
