Ok as promised by mbna have made a second offer, another £400 on top of the first offer of £410 which has been accepted as partial payment.
After reading some of the posts on mnba threads this is quite unusual as they normally settle at this stage. So i gave them a phone call this morning to be told they have made a mistake and should have settled rather than send me a second offer.
I have been told to send out my lba so i can claim for the rest plus contractual interest at the highest rate of the card.(which i included in the prelim stage anyway).
Should i be claiming for anything else before i send of my lba? Im sure i have missed some more interest on top this mmmm

First of all i rang this number 0161 200 7476(date protection) I did this yesterday stated that they had 3 days left of the forty before i was taking them to court plus reporting them to the information commisioner.(They pulled everything what i sent to them on pc)
I received all my statements this morning.
I would pretty much do the same but in the mean time if the forty days are up i would complain to the information commisioner and send of an LBA.
With reference to your two £10 cheques i would check your statements as they have probably credited them to your account.

As im justing about to send my lba, my statements from april 2001 have arrived. Very interesting barclaycard stated they only started charges in june 2001. On my april 2001 statement charge for £20 over limit fee. Lying twits
Right question, do i continue to claim for the charges i have got already and then pursue pre april 2001 when i get the rest of my statements.

Quick update
Mbna have responded to my prelim letter by sending me out all 6 years worth of statements again (think they have lost the plot) I phoned them up today and they have apologised for the mistake and would be sending me a second settlement figure in the next few days.

Quick update, still waiting for my statements after they had promised to send them 2 weeks ago. Phoned them up yesterday to find out where they are. During the conversation they managed to tell me their filing system does not come under the data protection act subject access request criteria. I reminded them that the abby national have the same filling system and the information commisioner had stated this being a relevent filling system. They replied well our is different to abbeys mmmmm:lol: . Well i left the conversation saying that you have 3 days to get my statements as i will report u and take u to court if i have to. Reply was eerrrrm ok we will get your statements to u within 5 days.
So complaint gone to the information commisioner
Just typed up my lba

Ok good stuff. Use one of vampiress spreadsheets to work out your interest all you need to do is find the APR of the card.

Ask yourself why they are looking to settle early. Could be possible they owe your more than what u think. eg interest. I'm making a similiar claim to u also and i have claimed interest which has doubled my claim.

As stated in my earlier post you need to send a prelim letter from the bank template library.
At the top of the prelim letter write a similar paragraph to the one i wrote in red.
You should accept their offer as a partial payment but make it clear u will continue to pursue for the rest.
Also attach a list of charges to the prelim letter.
Interest
If you are going to claim the statatory 8% then this should be added when you submit your claim to MCOL.
If you decide to add contractual interest, this can be added at the prelim stage.

Have u sent of your prelim letter? If u have not then u just need to adjust your prelim letter to something like this.
Further to your letter dated xxxxx i accept your offer of a refund of charges totalling xxxxx on the understanding as a partial settlement towards my claim. I intend to continue for the remainder of the charges added to my account between xxxxx and xxxxxx
Then use template prelim letter.
You can use the paragraph on top of your LBA if you have got that far.

Well read through FAQs and the rest of the site should take u a few days. This will give you all the tools and information u need to start a claim. Any problems their will be loads of people on this site willing to help.

Well i have used mainzai spreadsheet to calculate the monthly interest on my charges and its double the claim does this sound right?.
I phones up Mbna to find out what my APR was on my card 24.9% so used this for the spreadsheet.
Also is this ok for my calculations paragraph in my prelim? Or do i have to explain where the intrest came from like add compounded into wording.
I calculate between dates and dates you have taken xxxx plus xxxx which I have charged you in interest for the sum which u have taken. Total xxxxx

Well im sending my Lba on Monday claiming back the remaining charges still owed and the contractual interest on the whole amount.
