  4. Hi everyone, I am looking for a bit advice, Last year I was late paying my tv licence and a guy from the tv licencing came out I filled in forms to pay by direct debit, i thought thats was it, until 2 month later I had a letter from the county court over it, I was fined £120 and because i didnt pay in 2 weeks the debt was handed over to the bailiffs they added £100 on so the total was £220, I sent them 4 cheques topay them £50 a month, but they sent them back saying it had to be paid immedietly, A week later a removal note has been put through the door totalling now owing is £405, which says Please not that the amount now due is £405.00 inclusive of charges of todays attendance, If this amount is not paid in full immediatly, a further call will be made, WITHOUT NOTICE to effect REMOVAL for sale at public auction Such action will render you liable to further substantial costs. any ideas of what I can do, I have never signed anything and this is the first time a note has been put through the door Im a single parent with 3 kids not got a clue where im going to get £405 from, I was thinking sbout getting a provident loan or a payday loan and worrying about paying that later any help appreciated
  5. I cancelled the contract in writing within the 7 days and they say they didnt recieve the letter, they obviously know we arent using the phone because they cancelled the sim from day 1. My second letter they say was recieved to late to late to cancel, yet I had another cw person saying that I could cancel it over the phone and to just take the phone back to the shop which we did and they wouldnt take it. It is unbelievable what has gone on but my o/h is waiting for them to take him to court now
  6. hello, can anyone give any advice, it is a long story but I will try to keep it brief. I am writing on behalf of my boyfriend I got an 18mth contract with carphone warehouse last year on 02 and I recieved a xbox 360 for free, anyway a year later my boyfriend dropped the phone on a roof and it slid down and went down a gully (hes a roofer) so he gets on the phone to cpw to claim on the insurance he had, only for them to tell him he wasnt insured, he really thought he was insured, but they was adamant he wasnt, so he went and took another contract out with them as he needs his phone for his job, when I return home he tells me about this, and I told him the phone is definatly insured so I checked the online banking and Yes the phone was insured. So he rang them back and told how he was insured, The cpw were having none of it so my o/h rings the insurance and they said the cpw arranged the insurance. So he rings cpw again and tells them this but they were still having none of it, So he tells them to cancel the new contract which he had agreed to on the phone and they said when the new phone gets deliverd to just refuse it, which we did thinking that was the end of it. The next day a parcel came which my daughter accepted as she didnt know what it was, it was the same mobile phone we refused. So cpw told us to write a letter to cancel the contract, guess what they didnt recieve it, about a month later we get a bill for this contract by this time my o/h is really frustrated so he rings again and one of the cpw team seemed to really be helpfull told us to take the phone back to a cpw shop and that will be it, so my o/h does this and the shop wouldnt take the phone it is constant probs all the time, no body can sort it out, the phone is unopened in the box. Next thing we get a bill for the whole amount 680 pounds for cancelling the contract early, that was from the second letter I sent telling them to cancel the contract, Then another xbox 360 arrives. Now we are getting debt letters and my o/h is really losing his patience with the cpw because he has to explain the situation over and over again to different people over the phone. One of the customer service team gave us his email address, (he was the one who said take it back to a shop) and he replied to it once but I have sent him numerous emails telling him to ring us but hasnt. I have been with my o/h each time he has rang the cpw and it is totally unbelievable what each person says, he has spent hours on the phone trying to sort this and now he has give up so we have a mobile phone and an xbox unopened in my wardrobe and debt letters coming, Another thing too when we got the first mobile (the one they said wasnt insured) we paid a 100 pound deposit he asked them about this and they said it had been paid back which it hasnt. Im sorry if parts of this dont make sense but im not a good letter writer. and it hard to speak about never mind write lol. So if anyone has any ideas as what we can do I would be really gratefull

  8. I received a part payment from a&l and wrote saying I accepted it only as a partial payment, yesterday i got a letter from wragge and co saying that was a full and final payment and i should cancell the court proceedings, when i looked back at the letter which I recieved with the cheque it did say it would be full and final payment if i accepted it. So I am a bit stuck on what to do now. I recieved 900 out of 2500 any advice for me or have I blown it.
  9. hi I recieved a partial payment from alliance leicester they offered me £900 from £2500 I wrote saying i accepted it but only as a partial payment and i would be continuing with the court claim that is already going through. It is showing on mcol that they have entered a defence, today i got a letter from wragge and co saying that on the letter from alliance if i accepted the cheque it was full and final payment and to cancel the court case. They have got me now, I cant continue with the claim because I have just looked and it did say if I accepted the cheque it was a full and final payment Anybody else done this

  11. he I filed a claim on mcol on the 4th May and it has been acknowledged, I recieved a letter from their solicitor a few days later saying they were going to defend, the next day I recieved a cheque for £987, saying it was the difference between the £12 which they now say is fair and the £35, and if I accept it they wont close my account. Which I dont care if they do. I am claiming for £2500 What should I do now ? I dont want to accept it, but i dont want to lose it. With everything ive been reading im really unsure, should i cash it and say i accept it as a part payment or send it back
  12. thank you so much for your quick reply, I will write the letter now
