After a stressful 10 months of not really knowing just what the outcome would be a cheque arrived on Saturday for the FULL AMOUNT!!!! £3558.38p I am still in a state of shock as I really thought it would end up be sorted out at the Court. A huge thanks to everyone on this forum for their advice and encouragement I couldn't have done it without you all!;-)
  3. Well, well, well, would you believe it? Received a cheque on Saturday [the day before my 40th birthday] for the full amount!!!!! A big thanks to everyone on this site for all their help and encouragement! Glad it is all over, the past 10 months have been a worry! to put it mildy..
  4. Hi I am due in court this Thursday but have been told by various helpers on this site that it is doubtful that it will actually get to us having to attend due to hopefully settlement beforehand. I am preparing my court bundle just in case, but need to know if I get an offer prior to Thursday should I still attend? [dodgy.. as money won't be in my account] If they make me an offer on the steps of the court buildings 10 minutes before hearing do I accept or continue with going before the Judge? HELP!
  5. If they make an offer on the 11th hour and we accept then obviously we must make the court aware [therefore not attending hearing] but we may not have the money in our account at this time!!!... :confused:
  6. Hi everyone, Just been reading various posts etc. I am hoping that RBS will settle before the actual court date arrives with either a phone call or a cheque in the post. If this is the case do I still have to attend court to get everything sorted legally or just accept their offer and keep everything crossed? My only concern is that I have read that despite 'offering settlements' money hasn't appeared in accounts and then what happens? Any advice would be much appreciated.
  7. Hi George SO you think accepting part payment under the clear understanding is ONLY part payment is the right way to go, not to refuse and sit tight?
  8. Hi again Stansfield We did not mention interest when we filed although it was mentioned in the prelim letter so does that make any difference? Cobbetts have told me I have until Thursay 11th Jan [two days away] to accept their offer with conditions or not. I really need urgent and clear advice as I am getting into a flap!!!! Let the court date of 8th Feb go ahead anyway but in the meantime accept part payment and go for the rest on the 8th OR refuse and hope they increase offer before court date? :-? I feel intimidate alright:-|
  9. Thanks! Prelim letter was 10th June 2006 so effectively I am alright from that date then? I had gone back to beginning of Feb 2006 - so I take it that I cannot do this? Should I add the interest? not sure how that works seems confusing...
  10. Thanks to everyone for their advise on this site it is encouraging:) I need some advice on how brief should my refusal letter be? Court date 8th Feb so not much time left to get it all sorted. Have had goodwill gesture offer of £2000 but actual claim is nearer £4000. Have had the usual if you dont accept this pressure and that my claim will not stand up in court... they have tried to request THEIR costs and cried the Limitation Act 1980.. I am going to send a copy of my letter to the court, do I need to point out that my costs and interest will be added OR should I make a goodwill gesture [so that it proves to the Judge I have tried to reach a settlement] and waiver the interest? I don't want to appear uncooperative or greedy, just want my money back! HELP :-?

I have received a letter from Cobbetts prior to my hearing on 8th Feb :o explaining that Under the Limitation Act 1980 I am unable to bring a claim more than 6 years after the date on which the cause of action accrued. My claim is from Aug 01 2006 and therefore apparently on entitled to claim from Aug 2000 to Aug 2006 so that is incorrect then? :-?

  13. How did you guess I am a veggie? Anywho thanks very much for your swift and helpful reply. I realise the bank are trying to get us quivering in our shoes with all of this and at times it feels as though they have succeeded! Hearing other peoples advise and guidance has really helped and I suppose I should hang in there and stick it out for the whole amount. Cobbetts will be getting a reply this week and I will update the forum.

Hi to everyone dealing with claims against RBS Have received an offer from bank via Cobbetts for £2000.00 full amount requested is actually £3724.38 (excluding interest or any costs) thinking of sending refusal letter to Cobbetts but unsure as to whether perhaps accept part of the claim or just flatly refuse the offer and wait until the hearing date looms. I NEED ADVICE! Also Cobbetts have requested THEIR costs for £775.00!!! Will I have to pay this no matter what the outcome?
  15. Hi to everyone currently dealing with claims against RBS. Claiming for £3724.38 and have been offered £2000.00 from bank via letter from Cobbetts. Can anyone advise me on whether accepting part of payment with LBA letter would swing more in my favour rather than total refusal? Would the court see this as not trying to resolve the case before it gets to the hearing date? Also I notice on LBA template the address is to the Bank rather than Solicitors, should copies be sent to both and to the court also?

  18. Do you think seeing as though I am at the point of attending court it is too late to finally correspond with Cobbetts and acknowledge their defence and supply more detailed info or just await a court date? Don't want to give them the impression that I a bricking it....

I recieved a defence from Cobbetts requesting further details of the Claim, but was advised not to approach them directly and wait for the Court to send out the Allocation Questionnaire which I did and subsequently returned. I have not included the interest incurred in reclaiming any charges as I have found it impossible to work out - any ideas?????
  20. Hi I am currently awaiting a court date after receiving a defence from Cobbetts representing the RBS..... In their defence they are stating that the particulars of Claim was lacking information and that therefore the claim be struck out. They couldn't even be bothered to file the Allocation Questionnaire on the due date (two days late) which would indicate how arrogant these guys can be. My claim is for 4k+....over a six year period. I have followed the procedure of reclaiming the charges step by step and am amazed that is has got this far and as the court date looms nearer I must confess to feeling apprehensive. Has anyone else actually gone to court and had a settlement?
