  1. Hi Sparkler.

     

    Is it likely that things will change once the OFT release their findings?,

     

    It could have some bearing on future claims against the banks if the findings of the OFT rule that bank charges are excessive.

    i.e Read a thread on Barclaycard someone trying to claim their charges and Barclays reply was they would only accept a claim of the difference between their charges and the OFT's charge of £12.

     

    If the same ruling applied to Bank charges then i think it could get quite difficult to claim those £30 charges if the OFT said bank charges should be set at no more than £12.

    However what is also interesting if the OFT said charges as they are now are fair where would that leave consumers?:confused:

    Personally then i would think you will find that claims against banks would stop.

    It has been reported that Barclays have terminated accounts with some members(or threatened to close accounts), however i have also read on other threads members have received letters after claims from Barclays,saying that Barclays will terminate accounts if account holders will not conform to Barclays terms and conditions,implying that further breaches of their terms i.e claiming back charges will ammount to the closure of the account.

    It's true the OFT are looking into bank charges however with regards to the banks waiting on the contents of the report, i think they will have quite a wait.

    As the OFT indicated that they expect their findings to be released in about 6 months.

    Barclays have 14 days to acknowledge your claim from the date they are served.

    If on your claim it does not say acknowledged then you have to give a maximum of 5 days from the date of issue + 14 days to start judgement.

    If Barclays acknowledge the claim they have 28 days from the date they acknowledged the claim to submit a defence.

    So in your case you should be if they have not acknowledged your claim starting judgement on the 9th October.

  5. Hi Tadmeister.

    You will find some members like myself found it easier to leave the interest out on the overdraft.

    My reasons for leaving the interest out were because i felt the interest they charged me was a true reflection of the costs the bank incurred and secondly it was just to complicated, i found it easier to claim the charges then at the moneyclaim stage i just added 8% interest.

    Far easier in my opinion.

    Hey but it's your choice if you feel confident go get every penny.

    Welcome to the forum.

    This whole proceedure will feel daunting.

    However there are many people here to help you, don't be afraid to ask questions,read the FAQ's and get your money back.

    Do note the site does ask for a contribution of 5% but this is down to you personally, i think you will find a donation after you win will be greatly appreciated, the money received is used to help others like you and I.

     

    Finally your question about was i tempted to accept their offer?

    Hmmm(let me think):? ( right thats it after 2 secs of thought) Yes but thought the other 50% of the claim would buy me another holiday so i decided to go get Barclays in the court:p

  7. Hi Parsnipsmum.

    I take it Barclays have not acknowledged your claim yet from your post.

    The 14 days for acknowledgement begins from the day that Barclays are served with the claim.

    The court normally say the claim is deemed served within 5 days of being issued.

    Making the date the 10th October the latest.

    However Barclays could have already been served the claim and missed you in all the confusion in that case you maybe able to file for judgement by default.

    However don't quote me on the last paragragh.

    Hopefully a mod can answer this 1.

    Basically sit and wait until Barclays make the next move.

    They have 28 days to file a defence which they will do more than likely on the last day, then your next stage will be the allocation questionaire.

     

    Adrian Ruffhead is defending my claim, seems KJ maybe snowed under with claims LOL :) .

    I would have serious misgivings over trying to force the courts hand of ruling the charges to be unenforceable.

    My real concerns are like Bookworm has stated the possible costs that could be awarded against you should the court rule in Barclay's favour.

    After all we are talking untested ground here as the bank's always settle prior to a court visit.

    My other concern is should the judge decide to look into your argument and rule that the charges are enforceable, where would like leave other claimants currently in dispute.

    After all to my understanding once a case has been tested surely other following cases of similarity can be judged in accordance with the tested case.

    For instance if Barclays win against you then they have basically won a ruling in principle over all others who have claims against them, therefore all other claims would find it very hard to stand up against the banks.

    Personally if i was you i would tell KJ to stick the confidentiality clause where the sun don't shine and accept his offer.

    I would leave the other issue you have down to people who should be doing this and are currently investigating if bank charges are unlawful and that is the OFT.

    Save yourself some heartache and possible punitive costs against you and accept the offer.

    After all i for one am glad that the banks don't go into court, the chances of retrieving my money is greater,after all i started my claim out to get money returned not to wage "war" on a large financial institution.

    If Barclays decided not to settle prior to court then i would goto court and defend my rights.

    I would certainly consider your position and seek legal advice if you are going to fight this battle.

    My final thought is if the banks persist in charging us these charges, then all we need do as consumers is reclaim the money back the tried and tested way.

    Now you have your case number HB can you email a mod with the details and ask for it to be entered into the ligitigation in process part of the forum.

    You need to get onto the beaten and proven track for your claim to be successful.

     

    You will need an exact figure of your charges so first step would be to get your statements and highlight those charges.

    Step 2 (after you highlight charges) i would send the LBA with a schedule of your charges giving Barclays 14 days to comply to your request for a refund.

    Would hold on the issue about accepting their initial offer (if memory serves me i think it will say on Barclays offer you have 8 weeks to reply.)

    After these 2 steps are completed post a reply here to bring us up to date and we can guide you further.

    Answer is Yes.

    When you get your statements just highlight the charges, after you notice the charges just look for the word refund on the statements just after your charges if you see it and it is the same ammount as they have debited just don't add that charge to your claim.

    You will then have a true figure of what they have taken and given you back.

    Standard reply from Barclays.

    Next step is to wait for the statements and highlight the charges on the statements.

    Then edit the preliminary letter and send it to Barclays with a schedule of the charges you are claiming( use the template in the bank templates folder) but do not include in the 8% interest at this stage.

    Daily interest is charged at the ammount your charges are X 0.00022 secondly from what i have seen it appears that you can claim as many years you want if you can prove the charges i dont think your claim will have much of a bearing on your day in court if it got that far( very unlikely knowing Barclays).

     

    Take them for all you are prepared to do.

    Just makesure you stay below £5000 so you can keep your case on the small claims track.
