  1. Hello everyone bit of advice needed again!!!!! Sent off the schedule of charges last weekend and received the following letter today: "I would confirm that we have received your request for information in relation to transaction and charges. Under the Data Protection Act, HBOS has 40 days from receipt of your request to provide the required information. I would therefore advise that you will receive a response no later than 12th December 2006". My question is - is this the right letter they should have replied with???? Me thinks not!!!!!!! Now they are stating the 12th December as the date but I get it to the 9th December. Should I just wait and see what happens or should I contact them? Thanks everyone for the advice given me so far.   2. Statements of other account finally arranged today. Felt like having a party!!!!! Been through them and done the preliminary action letter and schedule of charges. Will post today recorded delivery. Come on Halifax I'm ready for ya!!!!!! Katie

  4. Please, please, please can someone tell me if I add the interest now when I am sending the preliminary letter with the total on or not. I need to send the letter but don't want to incase I am wrong and the whole thing goes pear-shaped. Thanks very much, sorry to keep asking silly questions. Katie
  5. Could someone please let me know if I should automatically add the interest as I am not sure. I have never had an overdraft so is the interest for overdraft charges???? I really want to send them the preliminary letter tomorrow so a reply would be much appreciated. Thanks a lot Katie
  6. I sent my SAR end of September and they cashed cheque on 4 October. Still not heard a word. Rang them up and told them basically that the service was appalling and I was reporting them to the Data Protection People. Their response - you will have your statements ASAP. Was that a pig that just flew past!!!!!!!! Katie
  7. Thanks for replying again Michael. I feel like I'm getting there now. Just worked out the charges and they come to £1601. Definitely going to chase them now. Sorry forgot to ask do I add the interest on now although I don't have any overdraft charges. Is it routinely added on to anything I claim???? Katie
  8. Right well I have one lot of statements for one account which came today. Do I just add up all the charges and put in that amount. Not really sure how to do it. Do I need to use the spreadsheet or not? Sorry to sound docile but I can't make head nor tail of it!!!!!! Do I add the interest on as well or not???? Thanks Katie
  9. Well I telephoned the Halifax today again. I got put through to a Business Centre in West Kent who said they will send an email to another department. I told them that this was not good enough and that someone was meant to ring me today which as of yet they hadn't done. I told the lady I was going to report Halifax to the Data Protection People for not complying. She then said hold the line........she spoke to her colleague in another call centre and low and behold my statements have been ordered back to October 1999. They will be here within 10 days. Well lets wait and see. Katie x
  10. I have drafted the following letter to send to the Halifax could someone let me know if it is ok or not!!!!! Thanks You have failed to comply with my Data Protection Act Subject Access Request dated 26 September 2006. I have enclosed a copy of this for your convenience together with a copy of the cheque for the sum of £10 which has been processed and debited from my Natwest bank account. After many phone calls to the Halifax they are still repeatedly saying the cheque has not been received nor has a Data Protection Act Subject Access Request. I would like to ask how the cheque has been processed and debited from my account without you receiving the letter as they were in the same envelope. If you do not comply within the next 7 days I shall seek a court order obliging you to do so together with damages at the discretion of the Court and without any further notice.

  12. I was just wondering what I do next. The Halifax actually stamped the cheque on 4th October. They are denying ever receiving it. I have obtained a copy of the cheque from my bank who say it is in Halifax's holding account. Halifax are saying they haven't got it. What do I do. I have made about 15 phone calls all with no joy. The 40 day deadline (from my working out from 4th October) ran out on 11 November and still no word but they have my money. Hope someone can help and advise me what to the next step is. Katie x
  13. Still no word from the Halifax. They cashed one cheque in September so am assuming the statements should be here soon NOT!!!!! Will tell hubby to give them a ring. Other cheque has been sent off (The one they never received!!!)

I have contacted Halifax by telephone to chase up my Data Protection Request to be told that they have received one request but not two although they were sent together with two cheques and only one has been cashed. They are adamant that they haven't received it. Do I just send another letter or what? The person I spoke to didn't have much of a clue either. Thanks Katie
  16. Thanks Ollibear I will ring them on Monday and chase it up. Cheeky aren't they.....quick to take the charges and cash the cheque but very slow at sending information to you when you ask!!!!! Thanks Katie
  17. Still no reply from the Halifax for either account. Is this normal? Do they usually wait until their time is nearly up? Thanks Katie
  18. The cheques have been banked. The money has left my account but still no statements. They have till 7 November 2006. The clock is ticking by!!!!! Katie x

  20. Thanks to this wonderful site I am going to try and get back my charges. I have read up on the FAQ's and hopefully understand it. I'm just going to go step by step and hopefully will muddle along!!!! Will keep you all posted. I'm going to send off my 1st letter tomorrow (The Data Protection One). Will keep you all posted. I have already opened another account with someone else in case it goes pearshaped!!!!! Katie x
