  1. I have tried to upload the docs that they sent but cant, so I am going to type the letter in that i received. Card Services Pitreavie Business Park Dunferniline Fife KY99 4BS 05 July 2010 Dear Account Number: I write in response to your request for a copy of your consumer credit agreement under Section 78 of the Consumer Credit Act 1974 (CCA). I have enclosed with this letter a copy of your reconstituted version of the executed agreement comprising both the original and current terms and conditions. - I have requested a copy of the original signed application form from the relevant department to comply with your section 60/61 request. You will receive this shortly under separate cover. The copy of the agreement enclosed with this letter complies with the requirements of the Consumer Credit (Cancellation Notices and Copies of Documents) Regulations 1983 (the “Regulations”). Regulation 3(2)(b) provides that a copy can omit any signature box, signature or date of signature. In summary we are not required to produce a copy with your signature on it. By providing you with the documents attached to this letter, we have satisfied our obligation to provide a copy of the executed agreement under Section 78. As such, the agreement you have with us is fully enforceable and we shall continue to treat it as such. We will not be entering into any further correspondence with you regarding the requirements relating to the provision of copy agreement. As you have not made the required payments, you were served with a default notice, your agreement was ended on 10th June 2009 and the full balance owing became due. As such at the date of this letter, the full balance on the account of £ is in arrears and due for payment. As the agreement has ended, there is no credit limit in place and no interest is being charged on the debt owing. If you are using the services of a claims management company we would like to remind you of the warnings issued by the Ministry of Justice and Citizens Advice Bureau.   3. I am scared to sign anything, one thing that I have learnt on here is not to sign anything. Do i send the letter that WMW has posted for me - is that not delaying things? WMW - how many more days do I give them to respond to this?
  4. I have not read the letters (an probably wont understand them if I do) but it says something about digital signatures? OMG - what do I do now?
  5. Hubby just called - I have had 2 letters from Halifax asking me to sign my CCA and return without delay - they have said that they will send the original agreements by return. The paperwork that has been sent home does not have my signatures on - does this mean that they do not have signed original CCA's?

I can only presume that they are - as I not entirely sure what default notices are apart from a letter to say that you broken the terms of the agreement and have defaulted me. they insisted that I paid a sum of money into the account, which i didnt do, and they were dated 11th May 2009 and 9th May 2009.
  8. I checked at home and there were defaults notices issued on both of my credit card accounts, in May 2009. does this affect anything?

  10. just cant see the end of the tunnel at the moment. how can I expect this to end? will they ever let me just pay it off? Who do I send the SAR to? is it BOS or halifax?
  11. Blimey........ did everyone feel this worried when they first started this route? feel like its never going to end and its gonna go on and on for ever
  12. I think I opened it in approx 2006 will need to check but defo before 2007 and I applied for it over the phone, the next thing (if my memory serves me right) the card arrived in the post.
  13. Please forgive me if I am going around the houses...but to get things clear in my mind, I am waiting for the CCA to come back from BOS and if its not back by 15th July I am sending a dispute letter. In the meantime, I write to the Halifax? or BOS with the SAR request?
  14. I know that a lot has been posted on here, I think there is a SAR template on here also. When I send the PO do I fill in that it is payable to BOS? as the ones that I sent for the CCA were blank. I will sort out the PO at the weekend and send it registered delivery on Monday. I think the interest rate on the one card is at least 15% and on the other card it is 29.9%. the charges were at one point £25 for overlimit and £25 for late payment until they were legally reduced to £12 respectively. Can I claim these back?
  15. ok. Knowing my luck the CCA will come through and I will be banged to rights. Although I dont ever remember signing a CCA, it came in the post with the card but I know that I never returned it.
  16. I understand and have read your thread, I find it upsetting that creditors can do this to people. I know I incurred the debt and therefore have an obligation to pay, and have for the last 12 months paid £60 on the nail on time without fail. It just escapes me why they think that I should be paying more? Halifax added interest and charges hand over fist at one point, so much so that I lost track. I will send a Subject Access letter, will I be able to get back some of the interest and charges (both late payment charges and over limit charges - by the way Halifax they reduced the credit limit on the account and then started to hit me with charges and more charges). I cant win.
  17. ok - got my tea now, took a paracetamol as I have a raging headache. I will sit back and wait as you suggest. just feeling down and out about it all..... Is it possible that Halifax would consider my payment plan or in your experience would they insist on the same information as BOS?
  18. So I can send this to them so they receive it on 16th July by registered post in order that I am ontime and leave no gaps. The CCA should have been received by me on 15th July. Can they still take me to court on this? as they have been threatening to do this?

I would love to pay more and clear it quicker, but unfortunately I am one of those people who have been hit by the governments cuts to benefits and from April next year my income will go down by £600 a month. I have 2 children in school club / nursery club and its hard enough to get by as it is. What concerns me is that I do not know what powers they have? my understanding from these posts is that only a judge can make me fill out an I&E form, so not sure where BOS are coming from by saying that they are taking me to court for not clearing the balance as they have suggested. Can I not contact Halifax direct and set up the payment plan with them?
  20. Surely I can only get a CCJ for not paying at all? what do these people want from me?
  21. if there is no CCA after 12+2 days and I put the account into dispute can they still take me to court? or even take me to court while I am waiting for the CCA to arrive?
  22. hello WMW - long time no hear from you, I hope your monekys are well! BD - I not sure if I have seen a dispute letter? does this action stop them from taking me to court?
  23. As i said I just want to pay off what I owe, I just cant handle this at all.
