  1. Hi all

     

    I am looking for the latest information on the unfair bank charges , i wrote to 2 of my banks i had a debt with and they declined so then i decided to go to court where they were out on hold until the courts made a decision, then when it was ruled in the banks favour the banks sent a letter saying this was the ruling and nothings happened since that i am basically wanting to know can i reclaim ?

    what do i do next ?

     

    any advice much appreciated.

  2. ok thanks for yr help, i rang the court yesterday in panic and spoke to a very young girl who advised that they will send a letter out advising me that they are doing this before they turn up!

    if i need to get a solicitor i will i am so annoyed by this man its unreal i too am going to fight him every step of the way the more of us do then he may think twice but maybe not but atleast satisfaction for me

     

    why leave it this long though the courts said he can do an enforcement within 6 years after that he cant do anything!

     

    oh and just to let you know at the bottom of his new designed letters new director is A humphries she was the secretary (anne)

    much needed help please ,

     

    as you are all aware this named company/garage whatever they are are not the best to deal with to say the least,

    i am wondering what i do next

     

    i had a car from them back in 2000 and i part ex a car in poss 2001/2002

    a year after that i had money troubles new born baby and couldnt afford it

     

    they kindly reposessed it

    send abusive letters/calls/texts etc all the normal delightful stuff

     

    in 2005 he put a ccj on me for an amount just short of £13k with a repayment plan

    i was not able to pay this

    i may have paid one or 2 payments but that was it

     

    i havent heard a single thing for 5 years and 2 months exactly

    yesterday had a lovely letter from their new legal and recovery department saying that i have to pay full amount in 7 days or they will instruct baliffs from cardiff county court to remove my goods to the value of the outstanding debt!!!!

     

    what i am wanting to know is can they do this after so long?

    what do i do next ?

     

    unfortunatly i had a house fire in 2007 and lost all my documents

    i dont have a single piece of paperwork,

     

    how desperate to chase after purchasing a car 10 years ago.

    i too tried calling several times but they are horrible not interested in any circumstances or reasoning its one way or no way!

     

    any help on where i start and what i do would be great

     

    am just so pleased i found the thread on here about them

    otherwise i dont know what i would do apart from panic and wait for his thugs to turn up!

  4. thanks for yr help., yes i agree they are a nasty piece of work i have been reading some other threads on them and oh my days nothing suprises me now!!! this letter states they are coming to remove my stuff to the' value i owe!! unbelieveable..

     

    need to work out what my next step is anyone offering any advice can pm much appreciated i not rolling over just like that i owed about £8000 and he is saying i owe just short of £13,000 !!!!

    i had a nasty letter from finance u today aswell chasing me for same amount from 5 years ago!!!! i got into a mess 6 yrs ago and they took my car off me and they put a ccj on me and heard nothing until today which is 5 yrs and 2 months ago and now they are threatening me that i have to pay full amount in 7 days or they will send court baliffs in ..so i need advice too pls anyone thanks :)

     

    also does anyone have the links on this garage/company

    i am in need of some desperate help!!

     

    i started a claim against lloyds at the beginning of the year and been so busy with new baby and job and house etc ( i know i dont do things by halves) lol

    i done all the letters and then threatened them with court got the forms for court then left it so i am wanting to pursue again now and just wondering wether i need to start off again with the 1st reclaiming letter or do i continue wat i started i am just worried if i continue where i left off b4 they will throw that bk at me so if i got to do it all again thats fine i would rather and be correct so please any help greatly appreciated

  7. ahh thats great thanks steve yeah i did hear that too, just a bit worried as i rang cust serv in the beg of the week and some snotty littly boy gave me a right attitude saying i had to be careful as nationwide wouldnt want to keep a customer like me!!! like me , i was fuming at him, i was going to appologise but then i realised why should i it wasnt my fault i had a baby and my emplyers messed up my pay...i was so annoyed i hung up on him!!!

     

    so good glad about the now going to send off my 1st letter asking for my money here we go !!

    Red - if you have a default notice issue as well - which has been caused by the charges. Otherwise to not include this part.

     

    Blue - only include this if you intend to do it. Don't make empty threats

    also dont forget to add in the list of yr charges!!

    I am in the process of court dates with barclays and lloyds, now its nationwides turn, i have only been with them since last october and from then til may this year they have charged me in total £700 charges this was due to be going on maternity leave my emplyer messed up my wages and then nationwide hit me so with a newborn baby , no money i was struggling then,

     

    the best bit about this is one of my good friends is a manger of my local nationwide and when i spoke to her about this she said still to claim, wirte a letter hand it in to her and then she will send it off, the only thing i am concerned about is that i did hear that once you got yr money back of nationwide they close yr account?? is this true?

    i cant afford to do this as i am straight now and dont want to go through the hassle of changing dds etc as knowing my luck i will get charged again

     

    can someone please advise?

    Am looking for some help. on the middle of all this test case buisness i have recieved letters from barclays and lloyds saying that everything is on hold etc( they are standard letters)

    i submitted my court forms a while before this happened i today recieved from the courts a defence letter saying they have put up a defence and i have to complete the aq questionaire, can anyone advise me how to do this??

     

    also what is the situation with the charges now i am still reading through forums but a summary would be helpful..

     

    arre they still paying out????

    i would send it to the address on the latest correspondence you had....

     

    i have read yr thread and i know how you felt, i felt exactly the same i got 3 court dates approaching and i am struggling but i aint giving up at the end of the day its my money....

     

    the banks never gave up when they were charging it and taking our money from us did they..

     

    so stick with it it will be worth it good luck !!!

    i think i have done too much reading on here and confused myself,

     

    i have filled out the n1 form to give to my local court, i am going to do the schedules with it aswell but its asking for case number will the courts give this to me when i hand my form in...

     

    i just dont want to get thrown out i want to be prepared as much as i can , once i do this how long does it take? and whats the next steps i do

     

    sorry to sound so thick but i have read links after links and threads after threads and just confused but want to be 100%

     

    so please please can someone help me :-)

    i am just filling out my n1 claim form for lloyds as they have had an extra 2 weeks as i was away on hol and stil nothing

     

    so i just need some advise

     

    after the n1 form and i take it to my local court do i need to do anything else???

     

    i have read on here and it says about a poc form and to send that sepratly am confised about that bit so i just need some advce on what i do when i take the n1 to my local court

    I need so me help i have just been given bank statements off my dad as i am trying to help him, my dad has in the last 2 years got on his feet and set up his own buisness and doing really well, proir to this though he was in quite bad financially difficulty and went to lloyds for help, basically they just shut the door on him refused to anything and charged him left right and centre , his charges go from 5th jan 99 is it too late to claimm these back now the 5/1/99 is the earliest and they end in 04????

     

    i really want to help my dad as he has no help off anyone in the past and its the least i can do please advise

     

    oh and the funny thing is about lloyds since my dad has been doing well in the last 2 years lloyds write to him atleast 3 times a month offering loans, cards, everything but my dad has told them to get lost as he said to them they wouldnt help him when he needed it and had nothing and now he has got something they want to help..he is very stubborn anyway so lloyds will never get any buisness out of him now, so he now wants to change bank account and claim his charges back!!! good on my dad i say..

  15. ok nicsussex, thanks for yr help yeah i feel a bit nervous and thats prob why i keep asking the same q's but i would rather get it right and make sure i know what i am doing so any further advice would be great
