  1. thank you sorry to mither, just checking i've got it right, is it the full SAR? This one:- DATA PROTECTION ACT 1998 - SUBJECT ACCESS REQUEST ACCOUNT /REF NUMBER XXXXXXXX Please supply me with copies of all the data which you hold on me in relation to any matter and in any form and for any period of time. Please note that this Subject Access Request is not limited to the account/reference number mentioned above but that number has been provided purely as a starting reference for you. For the avoidance of doubt, and as stated above, this Subject Access Request requires disclosure of ALL personal data which you hold on me for the entire period of my dealings with you I enclose the statutory maximum fee of £10. You have 40 days in which to comply. If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. If I do not hear from you then I will assume that this Statutory Request is satisfactory and that the 40 day timescale has started.
  2. I've done the CCA, but need to know if I send one SAR for each account to HBOS or should I group them as one, because BW legal have now sent a DN where the two accounts are combined?
  3. I'm onto it, can you please give me a link to a template? ps. do I send two postal orders and separate letters, or can I group them together now that lowells have?
  4. Sent off the CCA on Thursday. Had SD delivered today, they didn't knock on, they just posted it through letterbox and they have combined my two cards. Should I send SAR to HBOS?
  5. Shall I use the same CCA letter, or has it changed? Also, should I send a SAR to hbos? another thing, I am going to put both accounts on the CCA, so should I send £2, so that's £1 for each account, or will the £1 be suffficent? Plus, they have also got two different account numbers, so four in total rather than the correct 2, but they are very similar, so prob just a typo. should I include these account numbers too? These are different from lowells own account numbers, they are the original acc no.
  6. Really glad that you've replied citizenB, you helped me to help my partner get his stat demand set aside, a few years ago, so I do have experience as I went to court on the day with my partner and it was successfully set aside. Let me answer your questions - post #11 on this thread has one of the DN's, the other DN is the same. They both only give 14 days from date of letter, so both deficient because of this! http://www.consumeractiongroup.co.uk/forum/showthread.php?252083-HBOS-credit-card-can-they-do-this I have sent a CCA to the original creditor in the past (2009) which was never complied with. I will send another today, shall I send it to lowells, or BW legal? Has the letter changed, or shall I send the same one I sent in 2009? I sent a hardship letter to the original creditor back in 2008, but I have not replied to any correspondence from lowells so far. ps I'm not sure if they are grouping the two accounts together or it's just one, there is no identifiable ref number on the recent letter, however lowells have been sending me separate letters for both accounts.
  7. Hi all, I have two threads open regarding two HBOS credit cards that I have not paid since Aug 2008 due to hardship. I was sent dodgy DN's for both and have been passed around practically every DCA going. I have not had much dealings for a year or so, but since August this year, I have received a few letters from Lowell and a notice of assignment from BOS. I have ignored all of them. Last week I had two separate home visits from BW Legal (I wasn't home for either, but had a card posted through letterbox) I have today received a letter through the post stating that they will attend again next week and if I am not at home, they will post the Stat Demand through the door and this will be the day of service. These two threads are regarding my HBOS cards:- http://www.consumeractiongroup.co.uk/forum/showthread.php?187638-HBOS-defalt-notice/page2 http://www.consumeractiongroup.co.uk/forum/showthread.php?252083-HBOS-credit-card-can-they-do-this This thread is regarding my HBOS card, plus my AMEX and Barclaycard http://www.consumeractiongroup.co.uk/forum/showthread.php?160532-can-anybody-advise-me/page3 HELP!
  8. Does anybody know if liverpool airport is a private parking company? We decided to stay on hols for another week but forgot all about the car only being booked in for one week. When we realised we thought we could just pay the extra week, but they wanted £80. We didn't have it so they have isued a ticket and have recorded my husbands passport number. Iniatially it was only £22 for the first week so £80 seems very exessive
  9. Thanks for that Uncle B. It all actually makes sense with hindsight, but unfortunately no less annoying for me! That's the trouble these days, us ''little people'' are expected to be experts in every field and none of these big companies have any compassion for genuine mistakes. I will check with the bank re. the cheque tomorrow, but to be honest, I'm not expecting them to re-instate the policy because their tone and manner was really bad. They actually said that they are unable to re-instate a policy by law !! Thanks!!
  10. Hiya, I'm hoping that someone can help me with this insurance matter Briefly, I had a car insurance policy which I was paying by direct debit and had also paid an upfront fee. I owed around £250 on it and decided to send them a cheque to pay in full and cancel the direct debit. I received a letter a day or two later saying that my bank had informed them that the direct debit had been cancelled and to re-instate it so that the policy isn't cancelled, but I thought that the cheque had crossed in the post. I have today received another letter saying that the policy had been cancelled and they had added a cancellation fee and took some off my debit card too!!!! I got straight in touch and they said that they had never received my letter and cheque and that there is no way the policy can be re-instated. Is this true ?? I am furious, I have paid almost £500 for 4.5 months of insurance.
  11. Hiya! Not been on this thread for ages, as nothing much has changed really. I'm still being passed around all the different dca's and the threatening letters are still coming, but to date nothing more substantial than threats. However, as I've been reading through other threads and dealing with other issues which I've had, I have noticed that the dodgy default argument is now ''no good''!!!!! This is worrying as it's what I was relying on in relation to my credit cards, so I was wondering what the best step would be for me now??? Any advice please!!!!
  12. Do I have to put everything down in a letter to complain to the OFT, or is there a set form or procedure?
  13. Thanks Guys What happens now, can they send out another stat demand and put the correct details on it?
  14. Went to court today. We manged to get it set aside in the end, but it wasn't easy, we were in for 15mins and didn't get costs! My partner went to jelly a bit and lost his voice, but I quite surprised myself and managed to get quite a lot out in a confident manner, it was clear that I was fighting to change his mind and it was the 1st credit printout that seemed to work wonders with him. Basically the judge said that by them not putting a court name on or by not serving it properly didn't actually prejudice us in any way we managed to get everything we needed to court within the time limit, so although they made a mistake, it didn't stop us from finding everything out and doing the necessar steps!!!!! He did a lot of ''headmaster'' style moaning to my partner for not paying this debt and warned him to pay it asap. He didn't agree with our arguement that the penalty charges were excessive, he said that under their (hbos) terms and conditions, they are within their rights to add on whatever they feel and not try to help us to get the debt under control, in other words, that was our problem!!! Glad it's over!!!!
  15. Thanks, it's all coming together now. My partner has had the day off work today and he is going through everything! I didn't sleep at all last night and I just can't wait to get it all done now!
  16. 42 man, I've printed out the 1st credit document that you've said to show to the judge. In your opinion, is there anything on it that I should hilight more than others? I think it's a bit long for him to read there and then, or am I wrong?
  17. thanks again I'm onto it now! - is the rate of £9.50 an hour standard, or is it because capquest have requested that this be the amount?
  18. sorry to be a pain, I'm looking to submit the costs today, but I've been searching round for hours, I can't seem to find how to do it? I followed your link above, then on to other threads from that, it's taken up the last 2 hours and I still haven't found it can you send me a direct link to it ?????
  19. thank you 42 man! I'm feeling a bit more confident now. I think I'll prob be doing most of the talking in court, will that be a problem?
