  1. Hello, Just wondering if anyone has any advice about claiming again? I received £700 in charges (from over 6 years) in August 2006 However have somehow racked up £900 in the last 6 months due to not being paid properly etc. Sent prelimerary letter and received reply saying they wouldn't pay again due to having paid once - however this is not what the letter stated - rather will close account. Guess this is inevitable - does any one have any experience? Am thinking will just carry on as before as am actually far more angry about these charges than before as have been based on very minor amounts and wages gone in following day etc Would love to hear any advice if people have done repeat claims before Thank you in advance soph
  2. Thanks for advice! Still not a hundred percent sure what to do though... aargh...
  3. Hello, wstill wondering if anyone has any advice on the above query? Has this happened to anybody where they offer part of what you are claiming after the court stage?? Sorry to harass but am a little confused/concerned! Thanks Soph
  4. Hey all, seems like i have been away a long time. Have been following other stories with interest but has all been quite straightforward with my accounts til now... Was initially offered poxy payment of about £100 which accepted as part payment. Filed against them with Moneyclaim claiming: £604 charges (both accounts together) £222.66 interest £75.51 in 8% interest Have now been sent a letter from Halifax without admission of liability offering £494 in charges and £222.64 in interest, with a paragraph stating "The Halifax does not consider that you are entitled to the further £195.51" that you are claiming. Unless you can provide evidence of this further loss the Halifax will file a defence in respect to this part of the claim" Is this normal?? Have only used the spreadsheets from here and am fairly (very!) sure my figures are correct. Am wondering whether I should accept this but am inclined to think that should continue???? ANY ADVICE PLEASE!! Has this happened to anybody else? Thanks all for reading - any opinions gratefully received
  5. Righty ho, am sending a letter looking like this: Thank you for your letters dated 9th and 10th August 2006 offering goodwill gesture payments of £60 and £50. I will accept this offer only as part payment and not as full and final settlement. I am very disappointed that you have failed to respond positively to my letter before action on the 1st August 2006. As this deadline as now passed you have left me with no alternative but to begin a claim against you for the full amount of £604 plus interest plus my costs and without further notice. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £429 plus £47.65 that you have charged me in overdraft interest for the sum from my current account. I further calculate that you have taken £175 plus £174.99, which you have charged me in overdraft interest for the sum from my credit card account. Therefore, the total you have taken from me is £826.64. I am enclosing a copy of the schedule of the charges which I am claiming. I will also be adding the 8% APR to my claim. I require repayment in full of this money. Yours faithfully, If anyone has any comments please feel free to pass them on - Thanks all!
  6. Hi dollies, all seems to be going well for you. I didn't get anything apart from a "this is our complaints procedure" after my Prelim letter, then right at the end of the 2 weeks after sending my LBA I got a piddly goodwill gesture letter.... which i am obviously not taking and filed Moneyclaim today WOO HOO v exciting! Anyway my point was I wouldn't worry about waht you do and don't get and when - just carry on with your plan exactly and they won't have a leg to stand on. Good Luck !!!!!!!!!!!!!!
  7. Hi, me again! Have worked out my above question I think and filed my moneyclaim.. interesting that all else has been ok but am now geting nervous!! However, have been looking for a standard "thanks but no thanks letter" for their tiny little offer they gave me but can't locate it anywhere in the templates library... any clues? links etc would be much appreciated or else shall get composing! Thanks again in advance, Soph
  8. Hi , I am by no means an expert on this but my case sounds pretty similar to yours. I only sent 1 letter and 1 cheque for my credit card and bank account combined and have treated them together claiming for one total amount. Have however sent separate schedules of charges but in the same letter. So far so good, just filled out Moneyclaim... arrgh!! Have had standard (separate) offers for piddly amounts for each account so they seem to be able to cope with it all in one... shall see... Good luck with everything!
  9. Well thought I would start a thread as i have a couple of questions... have looked through but can't find my precise answers i think... well maybe I need a little reassurance too!! Anyway, have sent the Data Protection Act, Prelim and LBA - had standard letters blah blah initially but received a offer for £50 on bank account and £60 for credit card last week (which i am obviously not accepting) Am filing Moneyclaim today for almost £1000 (so exciting!!!) shall I still a thanks but no thanks letter for the charges? Now I have written it I guess I might as well!!! However my second qu is the Moneyclaim interest thingy, are you supposed to put the total amount of your claim? Also what is the daily rate of interest? Thanks so much for any help in advance - am so so impressed with this site and shall be adding my donation WHEN i win!!
  10. Snap to above!! Well done thats excellent news - is all so very exciting!!
  11. Thank you very much for that, have my letter printed and cheque ready to send recorded delivery tomorrow - am actually quite excited! This site is fab!!! Shall keep updated...
  12. Hi could anyone give me some advice. Have been reading all the threads and FAQs and really can't find an answer to this!! I want to claim for my bank charges and CC charges simultaniously and was wondering whether I could send one letter with bank and CC numbers on (and one cheque for £10) or if i should send 2 separate letters (with two cheques)... Seems I will be sending them both to Trinty Road (Sarah Briggs...) so feels abit crazy to send 2 but if that ness then so be it! Thanks lots - this site is fantastic and think I might have about a grand to claim so shall def donate
