  1. I think you have a good case for bullying here. Take everything to the judge and explain what you had to do to prove GMAC had received the money. However it does leave you without new mortgage. Shop around on the links shown in Dollys reply earlier and good luck
  2. have recently received all statements (if thats what you can call them) from WF. Bit of a puzzle. Each loan has been settled (3 in all) and one is still active, which we having probs with (but that is another matter) We paid insurance with each one. looking over the statements they gave a rebate for each time we settled (for fees and insurance) however there is in each case an excess which was not paid E.G fees 455.00 fee rebate 406.50 excess 48.50. Can i claim this back? Also on each account interest was added on the day of settlement in one case 22 days before it was next due. In another case it was added the day before settlement. Can this be claimed back? Would it be better to complete the spreadsheet showing all fees paid and let them tell me so much was paid back in rebate? Or should i complete the spreadsheet showing only the excess that was paid on settlement? Is it best to do each account seperately or as one? Oh and if there is something due back and we can claim it, can they take the money to use it from the account which is live at the min? Please someone help....banks were so much easier lol
  3. I know exactly what you mean about needing to go with them for reasons, it is a frequent thing for many ppl. so you paid 3 x 365.46 = 1096.38 back. You then paid 1286.33 in interest on redemption. I consider you can claim this back as it is you being penalised for closing the account early. Be wary, Swift call ERC redemption interest, but as i was advised if it walks like a duck, looks like a duck and sounds like a duck then you cant call it a chicken!! Good luck, follow the right procedure and go get it back! Re PPi thats a good case to look up, i have heard it quoted before.
  4. Hi Was there any payments made on the account during its lifetime? If so how much was paid per month? Did you miss any payments? It does seem like you paid 1286.33 on redeeming the loan. And this equates to roughly 3.5 monthly payments which is the norm for Swift to charge on redeeming early. they scales are normally on the back of your agreement. The larger figure they quote is what you would of paid back had you kept the loan for the 90 months inc interest on PPI. PPI is often added to the loan, and therfore interest is applied. You could have a case for being mis sold PPI however you would need your broker to admit they pushed it (as likely as finding rocking horse sh**) Regency have recently been fined approx 56k for mis selling PPI, maybe have a look for this case online and see if you fall into that bracket.
  5. Just quick update. Offered small amount back (approx 8% of whats owed). Accepted this as part payment and written to say i will be filing in court for the rest. They are still hiding costs, and only tell me over and over and over and over (need i go on) what fees were paid. Well i know what fees were paid cos i bl*&^% well paid them. So court here we come!!

  7. Ok here is the scenario My OD is 200.00 Im at 180.00. DD paid by bank for 50.00 taking me over my OD by 30.00 They allowed DD to be paid, charged me for going over OD then charged me 30.00 per day till i get back into my OD limit. Can i claim these charges? Hope explained ok, my brothers account so hoping i got it right lol
  8. Need a lot higher figure than 10 to find a bank that doesnt charge penalties, how else do you think they have their yearly bonuses for big cats and monthly ones for staff!!   9. Hi and welcome First of all the S.A.R - (Subject Access Request) gives them 40 days to respond before you can report them (see FAQs for advice on this). You set the time limits on all other transactions. However would it not be easier to go to local county court and show proof of the default account being paid up to date and having the defualt removed from the credit history. I know this is viable as my cousin did it when they had a period of bad luck. Good luck
  10. HI all after redeeming my mortgage with GMAC i was stunned to have over 2k charge added in. I still paid it went merrily on my deluded way to swift!!! Already claiming charges back from them and have know had the nerve to contact GMAC re charges. Got them in post with yes you guessed it....no explanation of how they arrived at the 2k figure. Plus there were over 300.00 late fees so have decided to go get them too....hopefully winning back all of the charges. By the way i apparently did not pay a redemption figure with GMAC ene tho the mortgage was redeemed early i just paid redemption interest which is the 2k figure. Well as someone once said if it walks like a horse, eats hay like a horse and looks like a horse then it is a horse no matter how you dress it that day!!

  12. Hi Charlieboy Sorry to burst your bubble but im almost 100% certain that any credit applied for online and accepted into your account (and therefore spent) cannot be left unpaid. The fact that you selected proceed, that is your agreement with most companies. I know they were expecting a written agreement back from you and therefore i may be wrong in this matter but think carefully as they can prove you applied for the money, then had it credited to your account where you spent it (i assume you have spent it). Although im sure someone more experienced may come along and put you right, i think it best you seek legal advice on this matter. Good luck
  13. Keep going cliff, they will pay you out, they offered me 76 pound as gesture (so i gestured to them what they could do with it as it was 2k+ interest. They paid when i filed at court...just in time for my holiday on the broads!!! Needless to say it was champagne and strawberries all holiday thru thanks to this site Good luck and keep us posted
  14. hi and welcome. Either you or your son for him needs to check out the FAQs before starting anything. ONce you have read them (see link at top of this page) then you should check out the Abbey forum and see what ppl have been doing there as you can imagine it can alter from bank to bank. Post any questions you may have in that forum, you will get a response, however its good to remember that it is your money (well your sons anyways) and some work is needed by yourselves to reclaim it, however we are all here to help and advise whan really stuck.   15. Keep me posted gooner i will be very intersted to see what happens in this case. We had some real awful luck during our motgage with this company so i am happy to get back what is rightfully mine however a family member was reposessed through these and if i win (or others) then i can help them reclaim their money back too...the more evidence we have of them choosing numbers out the air, doubling it then adding a couple of noughts when deciding on a settlement figure then the more chance of others winning too. LBA sent 4/9/06 Having had a nice letter apologising for my complaint, they have given me....yes they given me till 21 sept till the answer lol Took no notice (as they took none from me when i was drowning) and have continued with my process and timings as stated in letter asking for payment. They now have till 18sept to pay up or go court!

  20. hi christine\ first read the FAQs and really get to understand the process or it can be costly. You need to spend a few days learning this so you dont make a mistake. In the library is a section with all the letters you need to send and the process you need to follow. Also start a thread in the HSBC forum, and read the posts there as this will give u a real insight into what u are getting into. you will also be able to ask questions in there that can be answerted by ppl who are dealing with the same bank (great for contact details etc) Good luck

  22. Hi to all readers CAlled the Halifax today (on pretence of updating home tel numbers, but really to check any progress lol) and i have won!!! They have agreed to pay all charges plus interest. They disagreed to the compensation claim for distress but then i knew they would lol. Eagerly waiting they payment to be credited to account now....big big thanks to the site, but unfortunately this does not get rid of me lol and a massive thanks to Vamp for all the times i bugged you lol Taking swift next, and will pay donation out of that as this money is needed badly..note to all others keep in there and dont let them put you off filling the claim form out for court!!!! Note to mods can someone please update my title to show won xxx
  23. Hi Re benefits you should of been fofered the chance to pay the outstanding NI contributions in order for you to be able to claim sickness benefit. Are you still off work sick? Do you get benefits now? Re foriegner with the recent influx of polish there is only 18% claiming benefit with the rest taking up jobs that were already available to british ppl but who chose not to take the job. However in your case there is a real reason why you cannot work (if you are not working) and you are entitled to help if youhave 3 children and your wife only brings home 140.00 per week.
