is there anyone that can help with this please?there doesn't seem to be many suggestions on here lately.please could anyone tell me whether we have a case or not?would it be worth sending a SAR to see what charges have been added etc.the card my partner had only had small limit so there must have been charges added. hope someone can help as we are expecting some more demanding letters from capquest and wouldn't know what to do if we received another court action letter. thanx dazza

no we didn't tell the court.we put in the defence.didn't know we had an option to inform the court about them not providing the papers. dazza

hi. we sent a cca and two cpr letters before xmas .it was before the court date and they sent nothing back.the court date came and went and now the claim is stayed.they replied to none of the letters up until this week when they sent the papers i posted. i don't know what to do next as they could have carried on with the court claim if they were that confident,so why are they now sending these papers if they had them all along. does anyone know what to do now? dazza

some of those letters are from 2006 supposedly but thats the first my partner has seen them.there is another 8 pages of terms and conditions so if you want me to post them i will. can an anybody advise on the next step please. as i said previously why didn't they just carry on with the court claim? thanx dazza

yes the agreement does have my partners signature on it.

hi. forgot to say that my partner phoned the court and was told that the claim was stayed.if thats the right term.the court said that after about a month it gets stayed automatically and if capquest want to do anything with it they have to pay £40 to go in front of a judge. hope someone can help with this. thanx dazza

this is the agreement they've sent .front and reverse. i'll post the terms and conditions later.have to go to work.they also said on the letter .hope this info has resolved your queries on this account and look forward to hearing from you with a proposal for payment of the outstanding balance.

hi all. received this morning from capquest what they say is the Copy of Credit Agreement,Terms and Conditions of Agreement and Notice of Assignment. theres about 8 pages of the terms and conditions but if you want me to post all the pages i will.do the terms and conditions have to have a signature because these don't .they don't look very professional .a smudged date on the front .smudged typing etc. not sure what the next step is so please could someone advise. thanx again dazza

HI i have kept all the receipts from the post office.i just went into mycol and the defence showing on there is for the 19th which is the wrong defence by the look of it. can't believe the courts are so hopeless. thanx again dazza

hi. i know x20 seems to think that we accidently posted the cpr letter to the court but i can assure x20 that we didn't .i hadn't even dealt with the court before submitting acknowledgement of service on mycol.so the only way it could have reached the court was by being sent by the claimants/claimants solicitors.(capquest/hl legal).the cpr letter was 1 million % sent to hl legal by special delivery as advised by SH. i'm a bit stumped at what to do now .should i wait or complain to the court? thanx dazza.

hi. i do think the court should have replied to my letter .i'm sure they have had enough time to do so now.we still haven't heard anything from capquest either ,after the letters we have sent. i will get that letter off in the morning.i can't believe either that this is the way the court conducts their business. maybe they will reply this time. thanx dazza

hi again. just received a letter from the court,its a bit confusing so hope someone can help. it says: "please be advised that we have received the attached correspondence from you on the 1st december 2008.we understand that you intended to only file an acknowledgment of service,with an intention to defend the case at a later date. however a defence was placed on this case on 19th november 2008. as per your request,we can delete the defence and replace it with your AOS.however ,as the date of service for this case was 3rd nov 2008.the AOS would be out of time as we allow 14 days from the date of service to file the AOS.after that date ,the AOS is out of time and the claimant may enter judgement if a defence is not received. i am willing to delete your defence and replace it with your AOS.however,as the defence has now been placed on this case,if you do wish to continue to defend this case we will leave the defence on and will forward your response to the claimants.if you wish to file more correspondence relating to this claim,it can be sent direct to the claimant for their information." we have attached to the letter our defence but also the defence that was filed on the 19th nov.it is the cpr 31.14 request that we sent to HL.Legal.they must have forwarded it to the court and put it in as our defence.is this legal?can they do something like that or not.it seems a very strange thing to do but i'm not familiar with legal stuff. there is also a photocopy of the court form "acknowledgement of service "which is filled in with typing and dated 15th nov.don't know if the court has filled it in .i know we didnt fill any form in for the court only on line. hope this makes sense . could someone please advise . thanx dazza ps.will scan and send if need be.please let me know if needed.
