  2. She has had the account for over 10 years so we know there is definitely no Credit Agreement. So what does she need to do then letter wise? As there is no court address just an Insolvency Manager requesting payment within that Demand. thanks again
  3. Basically she couldnt afford to pay the debt back, and so she requested a CCA however there has only ever been supplied an application form. It is from a credit card debt. Thanks
  4. No written knowledge apart from whenever a debt was moved to another debt collection agency we would send the standard CCA request letter then hear nothing. This is the first time we've heard of Connaughts :/
  5. I would say atleast 3 years since a payment was made so not statue barred. The title says 'Statutory Demand under section 268(1)a of the Insolvency Act 1986. Debt for Liquidated Sum Payable Immediately, for just under £7000
  6. Hi Need some urgent help please, a solicitor has contacted my mum in respect of a debt that has been under dispute for a number of years. Connaught have now purchased the debt and they are acting on behalf of Connaught Collections. What does she do???
  7. Hi I have received a claim for part only of monies due for a 4 year old debt. I have requested the usual CCA's etc as per reading other threads so can anyone help me now please? I obviously need to do something on line but Im not sure if I need to extend the date or whether I do the defense? If I do the defense what should I put? Thanks
  8. Thanks for the quick response Barrowby, as it happens I am sat at my kitchen table with a huge pile of paperwork. I have found (literally 30 seconds ago!) a CCA request (and response from MBNA) from back in 2007. Looks like I already started this process and then it fell by the wayside. The CCA response from them states they have included copy of original credit card applications, T&Cs and recent statement of account. There is nothing in this response that is original paperwork nor is anything signed. I can only assume that I am being spanked on interest rates because of the couple of occasions I have strayed over my limit and the fact I only pay minimum payments each month. Now I have found a CCA response I assume I can proceed with the SAR and then decide on the course of action from there? Thanks

    MBNA Thoughts

    Hi all, After reclaiming my bank charges a couple of years back I let my credit cards drift off into minimum monthly payments, this is now something I want to rectify to get them cleared up. I took an MBNA credit card out in 2006 by transferring a balance at an introductory rate of 0%. Having recently noticed that despite no activity on the account for a couple of years and paying the minimum payment every month, it seemed no original balance had been paid off. I contacted MBNA to ask what my current interest rate is to see if this was the reason. According to them it has been increased from the original 0% to 16% then to 26% and it now stands at a frightening 34.9%! I asked them to justify this but they said they 'had a review process which they were not willing to divulge and they could increase this rate according to their terms and conditions'. It got a bit heated on the phone and they essentially said they would not explain any further and then suggested I could talk to someone if I was struggling to make payments. As they have got my back up I wanted to know what option would be best to pursue. Other then exceeding my limit by pennies on a couple of occasions (which I have been charged for) I have always made monthly payments on time and never under paid etc. So: 1. SAR request to try to reclaim any charges will probably be the first step. 2. I have been told by a financial advisor that on increase of any interest rate I should have been informed (MBNA said they had sent letters which I do not believe I had received) and given the option to close the account at the rate prior to increase, is this the case? If so Is it likely I could write a letter of complaint to get the account closed and reverted back to one of the original rates of interest? I suppose I could also ask for a refund of interest due to not being informed of the original increases. 3. The CCA route, I would quite like to say stuff them and not hand over another penny but if this is likely to affect my credit rating then it is a non starter. Any advice would be appreciated as it's a little confusing from what I've read on the other MBNA threads. Thanks in advance

  11. Hi everyone, Just a little background before i start my claim. I have been with Egg for a number of years, over which time i have picked up a few charges for various reasons. There have never been many so i have never bothered looking into claiming them back. Recently my wife and i were in the supermarket, we got to the till and she realised she didn't have her purse, i didn't have my wallet and the only card i had was in the car which was my Egg money card. I paid using this realising it would take me over my agreed credit limit. As soon as we arrived home i rang Egg to pay off the amount we had just spent to be informed that it would not be processed now until the following Monday (it was Friday evening), i paid anyway and tried to get the guy to assure me that i would not be charged for going over seeing as i had tried to pay the same day. He could not do this and told me to take it up with customer services should any charges be levied against me. It transpired that i was charged for exceeding my account limit, my payment went in but becasue of the charge i was then over my credit limit resulting in being charged again. I asked them to refund based on the what had happened but they effectively said they were within their rights to do so and refused a refund. So at last here we are! My wife has helped a number of work collegues and friends claim back bank charges (and has so far been 100% successful), gave me an SAR template to fill in and send to Egg for a list of my charges. WIth this i sent a cheque for a statutory amount of £10. I received a letter this morning from Egg saying there is three ways in which they can provide this information, they are as follows: Option 1. A complete list of transactions (including charges), £5 fee is applicable. Option 2. Copies of original statements from period....to....., £2 per statement. Option 3. A complete data subject information request, with this option i will receive an information pack (subject to Egg's terms and conditions) within 40 days, a £10 fee and ID will be required. My wife has never seen a response like this so can someone please advise which one i should go with? Thanks Dave PS. Apologies for the wall of text
