  2. The documentation had already been sent to them so didn't realise I had to send it yet again. I know what I posted at #45 and didn't need it pointing out in bold this is stressful enough as it is dealing with Drydens without having extra stress piled on top. I'm assuming a DQ is a directions questionnaire?? I haven't done this sort of thing before and am getting very upset and stressed now as I realise I am now going to be held liable for costs as well as this debt which I still have no proof of. Think it might be a better idea just to give up now and pay it in full just to end it all really can't handle this. Thanks for your help
  3. Didn't realise I had to copy Drydens and give the court copies of CPR request and copies of questionnaire. I will get these to the court in the morning and hope it is in time. Do I also need to copy Drydens on all of this again even although they have it?
  4. I don't have any documentation at all the only thing we have is the defence which has already been submitted months ago.
  5. An update. I received a change of venue and hearing date back in October and the directions stated that 'all documentation which that party intends to rely at the hearing no later than fourteen days before the hearing', it also states that 'The judge may refuse to consider a document or take it it into account if a copy of it has not been sent to the other party as required by this order' and 'failure to comply with this order may result in the case having to be adjourned and the party at fault having to pay costs'. The hearing date is the 19th of December and they have informed me via telephone that they have now come into possession of the documentation requested today and that they will be sending it first class mail tonight so with current Royal Mail time scales I would assume I will receive this either Saturday the 7th or Monday the 9th of December if indeed they do have anything at all in their possession. Should I now just play the waiting game and see what materialises or should I be doing something else? Thanks in advance.

  7. Okay thanks. Received a copy of N180 from Drydens today as well stating that they wish to use mediation as well. Aren't they required to forward all documentation requested ?
  8. Thanks as far as I know they haven't got any documentation as nothing has been received from them at all.
  9. Thanks everyone have ticked yes and got it ready to send off. What's the likely outcome of this as I've never had to deal with this sort of thing before.

  12. Hi no i'm okay thanks my agreements are now closed and any old agreements will remain in place at the agreed terms. Just giving a heads up for anyone who might come across this.
  13. Just a heads up. As the title says really just been into store to pay off an agreement we have with them at long last and found out that there new scheme started today which has now pushed them from plain expensive to extortionate especially if you never used to take DLA or OSC with them The APR rate has increased a whopping 40% to 69.9% on the new agreements that now have everything included which is allegedly better for the customer we were told. Not sure how this works with regards to being sold cover and insurance which customers do not want or need in place. Glad to be rid of them at long last.
  14. Hi all time for an update received a letter from Drydens on the 2nd of August as attached and hadn't heard anything else until this morning when the second letter arrived. In between these two there has been no correspondence received at all or any other communication. I haven't a clue what there defence is as this wasn't enclosed. Any further advice would be much appreciated.

  17. Record has date of default as 27/11/2009 with no record of payments made at all. I honestly don't remember arranging this as it has contract start date in 2008. Nothing been received from Drydensfairfax at all after there last letter back in June.
  18. Getting desperate now as defence needs to be submitted by 15th and haven't a clue what to do next can anyone please advise.

  20. Hi again. Letter to Drydens was posted on the 17th June and received and signed for on the 19th June. The acknowledgment was completed on the 28th June at MCOL. Haven't heard a thing from Drydens and just wondered how long I should be leaving it before the next stage?. And what is the next stage please lol
  21. AOS now submitted at MCOL and still haven't heard anything at all.
  22. Hi just a quick update to say that Drydensfairfax have replied :- "We have requested the documents listed in your letter from our client and will forward them to you upon receipt. We confirm that the account will remain on hold until your have received the documents and had a reasonable length of time to respond to the claim. " This is the text that was received including bad spelling Do I still need to respond using MCOL and what is a reasonable length of time? Thanks
