  2. It's the middle of Feb. I'm really nervous, will it go that far?, have they ever been to court so far? I don't know if i have the balls to go through with it! HELP! PLEASE!!! :( :(
  3. Hi everyone, I have a quick question with regards to my questionnaire. It's fairly straight forward to fill out but do I need to include a schedule of charges when i send it off?. Also when we received the questionnaire there was a defence statement from Adrian Ruffhead (what a busy man he must be!) one bit that did stand out was a part which read "The claim for overdraft interest was denied" Is this quite a standard statement that they send out?, I am worried that i screwed up the calculations when i done the Money Claim form Any help would be great, Thanks very much Jane

  5. I know it's a million dollar question but i have filled in my moneyclaim form and barclays bas***ds have 14 days to respond i believe. I presume i will then get a court date is that right?, but my question is this...how long do people usually have to wait for the court date?...is there a set time limit or am i looking at Jan/Feb?...or later?...just a rough idea would be fab as i have no idea at the moment Thanks everyone, Jane;)

  7. Hi there, i'm filling in the money claim form on line and i have come to the particulars of claim page. Its asking "does or will your claim include any issues under the human rights act 1998" I have no idea what this is or if it is relevant to my claim - im guessing the answer would be no? sorry for being completely thick if the answer is really obvious!   8. Hiya, I am just about to post my rejection letter to the toss pots at barclays and include another schedule of charges as i always do. This afternoon i will then fill out the money claim form aswell. My question is this. Do i need to include the 8% interest in my rejection letter or only when i do the money claim form? (this is my understanding) please help somebody! thanks lots Jane

Is it likely that things will change once the OFT release their findings?, as in do you think the banks will stop paying out?, sorry i know this is probably a million dollar questoin but i was curious really...i'm trying to speed things up as much as i can as i was worried that the findings might be in the banks favour! Thanks for your replies... do i need to include a new schedule of charges in with this letter (i have been charged again since i sent the LBA so i have now added this on, so the figure has gone up by £65 - every little helps!) I have just completly deleted the line: "My letter before action sent previously indicates that you have until xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale" I'm going to send this today, is it ok to do my moneyclaim form today aswell?, im concious that im not giving them enough time...actually no f**k em, they've had planty of time.

So in a nutshell should i use the template in the library which says: Thank you for your letter dated xx/xx/xx I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £1505 I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. My letter before action sent previously indicates that you have until xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale. I trust this clarifies my position. or should i reword it slightly?...it also says about the LBA but im guessing as this date has now been and gone that i should delete this part?   14. Hello fellow claimers I sent my LBA to Barclays on the 20th september and recieved an offer exactly 14 days after. The offer was for £600 when im claiming for £1750. Tossers. I havent been at work since then so havent had access to the internet but i'm just trying to figure out what to do. Obviously i'm not accepting it so shall i just go ahead and start my claim on the moneyclaim site. Or do i need to send a rejection letter aswell. (The one in the templates) I would guess that i need to send the rejection letter first but how long do i give them now? a further 14 days before i do the moneyclaim form?... I don't particularly want to extend the time they have seeing as they probably wont reply to me anyway...but i don't think i can send rejection letter then do money claim form straight after as they may argue that i havent given them enough time to change the offer or whatever, what do you think? god i hope that made sense!   15. Hi there just a quick update and also in need of some rough guidance... I have sent both the prelim letter and the LBA and today i've been offered a third of what im claiming for - are they having a f'king laugh?...i think they are, im coming to get you barclays poxy bank. One problem though since sending off my schedule of charges we have since been charged a further £65 (i know i know we tried to not go over drawn but we messed up ) is there any way i can add this on to my claim?... i know my next step is to fill out the court form on the money claim website but i have already added an extra charge when i sent my LBA. will i risk screwing things up if i add a further charge?... god i hope this makes sense... cheers everyone jane

  17. Hi there, I sent off the prelim letter to barclays on the 6th september with my schedule of charges attached. Im about to send the LBA (wednesday) but i have just discovered that since sending the prelim i have been charded a further £100. hmmm how do i do this?, do i just add this on to my schedule of charges when i resend them with the LBA?, or do i have to leave it now?...i want it back obviously but dont wanna mess up my claim thanks very much, im pretty stuck with what to do

I sent my prelim letter on 6th september giving barclays 14 days to comply so they had until 21st give or take a couple of days but i have recieved a letter from them this morning with the usual "we're sorry you're unhappy blah blah blah" nice little leaflet in there and said we will get back to you soon, but no later than 5th october.... WTF? this has really annoyed me, i have given them 14 days not 30. what do i do now?....im ready for action!!! please help me nail their butts!

  22. Hi Peeps, OK i will try and keep this short and sweet. I don;t understand the interest. When people refer to claiming back the interest is it the interest on the money that Barclays have bene holding?. Vampiress (think thats her name) mentioned something about contractual interest aswell?, what is this what is the difference?, what do most people claim for?, i really want to send my letter to claim back my cash but i can't until i understand this part Please help - PLEEEEEEEEEEEEEEEEASE Thanks so much The not so bright Sparkler

  24. Hi peeps, wonder if you can help...I have my statements and am in the process of sending of the prelim approach letter, with my schedule of charges. But i'm becoming stuck at the spreadsheet. What is the difference between the 2?, simple and advanced?... Is one for Excel whizzkids the other is for...not so smart people like myself?. Also I'm confused about the interest. I know I can't claim the interest until later so presuming im gonna use the 'simple' spreadsheet do i just hide this column? and send the list of charges?...starting with the oldest date? Is that right i dont wanna balls it up Thanks for your help everyone all the best Jayne;)

Thanks for your reply, sorry Adam for hijacking your thread here! which spreadsheet do i need to use?, the simple or advanced?...also i presume the interest we are claiming back is the interest on the charges not the overdraft interest am i right. should i just hide the interest column if im using the simple spreadsheet? this is bloody well confusing thanks again xx
