  1. Received letter back from Barclays today thanking me for my preliminary letter and telling me they aim to have an answer within four weeks. It then goes on to say if they don't answer in the four weeks they will update me then and will definitely file a full report by eight weeks. Do I have to be fair and wait at least four weeks or I am within my rights once the 14 days has elapsed to take this to the next stage. Which is to give them a further 14 days before I file a court case online. Also can someone tell me how I find my inital thread so I don't have to keep starting a new one each time I have a question or update. Guidance required please. Thanks Badgerboy

Hi, I successfully went through the process and LloydsTSB settled just before the court date, the whole process did take about 7 months. is it any quicker with Natwest or do they dig their heels in as well. I am claiming on behalf of my wife now. Also now we have her statements can someone let me kow which is the best address to send the preliminary letter to as there are several listed in the forum.   5. A bit wierd but a win is a win I guess. I checked my online banking account with Lloydstsb today and there was a deposit titled Bank settlement Claim and the total of £788.33, which is the correct amount with interest. I haven't recieved any letter or heard a word from them. I was due in court on the 9th November. This can't be normal. I decided to ring Sechiari, Clare & Mitchell to ask them, they said they knew Lloyds were going to pay me but hadn't asked to send a letter to me yet. Seems like they are getting sloppy. Must be a breakdown in communication. I thought I was meant to receive an offer and I had to accept it, I didn't think they would automatically pay it into my account without any notification. Should I respond???????????
  6. I need to know whether I add the zip file as my case that bookworm did in the templates or do I send the audio of the Lloyds guy. Or do I send both??? I need to submit by next Thursday.
  7. You mentioned that you have to imput your own details in the case material. What do I specifically put and where in the case material do I put it. Or do I just submit what you have put in the zip file? Just getting a little flustered, do I need to mention the CD with Peter MacNamara? What else shall I submit? Badgerboy

  9. I have about two weeks now to submit my court case to both the Lloyds solicitors and the court. I haven't got a clue what I should be submitting, can someone help please. I looke din the library and saw a rough pack which was psoted by bookworm but read it and wasn't entirely sure what I should amend for my case. It that the idiot guide or is there another available.   10. Well I have followed it this far, I have my court date as the 9th November. Can anyone tell me when I should receive an offer, I need to submit my case within the next two weeks will it be after that or could court be looming. Badgerboy
  11. They handed in their allocation questionnaire 1 day late but the court have accepted this, anyway that is not my point. I am getting a little nervous now as the court said a date will be through soon. Surely they know I am not going to back down now so why have I not received any offers as yet? How long is it before the court date before people generally get an offer?? Badgerboy
  12. Well D day was yesterday for the bank to submit their questionnaire, I rang the court this morning and they said it hadn't been received. I was told they will send notice to the judge and he is likely to give them another 5 days to submit it, is it normal for the bank to submit it in this period or have I won the battle??? Any guidance would be appreciated Badgerboy
  13. Well I hope this is the last of their scare munger tactics if not I am in court. I have sent my allocation questionnaire back to the court and to Lloyds TSB, they have till the 5th July to put in their defence. I sopke to the court and they informed the the judge may well allow them a few more days after the date in which to submit their defence, is this normal? If it goes to court I will be in need of some serious help. Fingers crossed!!! Badgerboy
  14. Well, the online claim to the Court went in yesterday so I guess I will have to wait for a response now (14 days). Am I right in saying I wait 14 days and if no response (would that be an email on the online claim or a letter??) then I have won. If they respond they have a further 14 days. Am I right or not.   16. Thank you all for your advice, I feel a lot more confident now. I will complete the form with a clear head tomorrow. Let's hope the bank backs down before we have to go to court. Thanks again Badgerboy
  17. Thanks for the advice, I am still a little confused though as to what the wording should be on the form. The reason for confusion is because the advice in the library regarding the online claim is quite different to that of the hard copy. The hard copy one reads better but I obviously want to do it right. Where is the Princessaphrodite thread?? Thanks Badgerboy
  18. I received a letter from Lloyds TSB today stating that they will not refund me. So I am going to start a claim against them, I have logged onto the moneyclaim.gov website but need a little help on a few sections. I have read the library guidance notes but they don't answer my particular query. You are asked firstly to put the defendants (LloydsTSB) address down to which any correspondence should be sent. Can someone give me the piece of mind that this is the address in Birmingham still. My common sense tells me it must be but I am starting to question myself now it has got to this stage and want it to all be done correctly. Also it mentioned in the library that you need to quote the date you took out your bank account with them (firstly I don't know this and secondly I am claiming against two accounts so what do I need to do here??). I titled my claim "Money owed by Bank", is that suffice or does it need to something specific.

  20. I have already sent the first letter asking for the charges to be refunded, I am just about to send my next letter stating action will be taken if they don't pay up. Since my first and second letter I have incurred yet another £30 charge, I am alright to add this on in my second letter or do I need to stick with the original amount. I know its only £30, but as you all know, this is my £30 not ther's. Any guidance would be appreciated. Badgerboy

  22. Received letter back today from Lloyds saying that I accepted the terms & conditions and they clearly state that they can charge for going over my overdraft limit. They also said if I can't run my account within the T&C's then they may consider withdrawing certain services like DD's, Cheque book etc (then suggested I may want to make alternative bank arrangements). Anyway I guess its time to send the second letter giving them 14 more days to comply before I start court action against them. Can someone clarify if the letter entitled "letter before action - consumer version - asking for it back". Just getting a bit twitchy now and want to make sure I am following the process correctly.   23. Hi, I sent my initial letter today asking for my charges back, I also backed this up with an email to [email protected]. I went to lunch and on my return I had already received a reply. Please see below, I also had a PDF attachment which explained there complaints procedure with address's and contact numbers etc. (tried to attach to this post but it won't let me). Thank you for the e-mail. I am sorry to learn that you appear unhappy over the level of charges you have incurred on your Lloyds TSB account. Under the circumstances, your e-mail/letter has been passed on to the Manager of the Complaints Unit within Service Recovery. I have asked that he notes your comments and issues raised and arranges for a response be sent to you at the earliest opportunity. I have also noted that a copy of the letter has also been posted to us.
