  1. Hi Ims21, It is my handwriting and the box it ticked but it is a very dark photocopy and I honestly can't tell if it is a preticked box. I think if I did tick the box it was because I was going for a balance transfer 10 years ago.
  2. I received a letter today from capital one refusing my ppi claim. They enclosed a copy of the short postal application form which shows a ticked ppi box which I must have done. Now here is my problem the copy of the short postal application form was for a platinum credit card and I listed another card that I wanted to do a balance transfer of £3000 Capital one sent me a basic visa credit card with a credit limit of £200, I don,t recall signing another agreement for this basic card. Can I dispute their refusal of my ppi claim on the basis when I applied I was applying for a platinum card with a balance transfer. I would not have taken ppi on a basic card with a limit of £200. Any advise would be appreciated Sand pearl

  4. It was passed to Freds for collection, but I did get my SARs and all the money that I paid to Freds was showing on HFC account
  5. I also think because the PPI was £115 over 2 years (not much, I know) and the short settled amount was £797!! (this was made up of their outrageous account fees/charges). I guess I thought the PPI is different.
  6. Hi ims, this account was settled 10 years ago. it was opened in 1999 through Curry's the balance was about £820.00 I had paid about £780 and the balance was still £800 O/S. My account was passed to Freddricksons who offered me £200 in full & final settlement which I accepted. I wasn't working when I opened this account with curry's so I didnt need PPI and I also had life/ins policy's etc, but i was told I needed their PPI as it was a condition of the account.
  7. Hi dx, I did put in a claim for all the fee's and WEBB came back & offered me £200!! in full and final settlement, which I refused and passed it to FOS last month. So I guess it will be a long wait to see the outcome...
  8. I had a letter from HFC stating that they were upholding complaint for mis sold PPI. Great I thought, but because they offered me a reduced settlement and it was more than the PPI, they will not uphold the complaint. They have also concluded that I have not suffered a financial loss by having PPI!!!!..Can anyone give me some advise, I do have a claim with them also for unfair charges/fee's on the account and I have a feeling that im going to get the same response as the PPI when that letter comes back.

Hi Bayman, I know what your going through, they are not a company to do deals with as they just want your property and to apply as many charges to the account so it looks good for them in court!!!.. .I had my property on the market and I was going through the process of mortgage shared equity with the local council (which takes time) The judge could see I was doing everything possible and he adjoured 3 hearings because he could see it was a process that could take at least 3 months. Webb are liars true & true, please get everything in writting because WEBB deny any verbal telephone conversations in court, they never cancel court cases so always turn up and never trust them. I had an offer on the table from mortgage to shared equity a week before we were due in court. (I got my council to deal direct with WEBB to keep them in the loop!) and they refused to cancel the court case and in court WEBB refused to accept the deal that we were made by the council as they said they would only accept a different deal!! I had a letter from WEBB that I put in front of the judge and he could see that WEBB were moving the goalposts with more un-neccessary added expenses to us, so he threw their case out of court and told them to go away and wait at least 3 months to give us time to sort out a new deal with the council. He also awarded us the costs for that court hearing. My council were so shocked at the actions of WEBB after dealing with WEBB by phone/letter/emails for 14 weeks. They could see we didnt stand a chance of every making any deals to keep our home. It started with £4000 arrears and 12 months later over £20,000 with legal fee's and what ever fee's they could add, I feel so gutted because there was £150K equity in the propery but they were not interested, and we couldnt get a loan because our credit rating wasnt looking rosy, but I so know what you are going through. chin up and dont let them get you down
  10. I had an interesting package delivered to me yesterday from Capital One, it was a SAR report from 2000-present. Im a little confused as I never requested a SAR as I have all statements from them and the only thing I was waiting from them was to reconsider their offered to me in which I sent LBA giving them 14 days......Do you think this is a delay tactic from them? not sure what to do....any advise please
  11. Good luck Sillygirl, I think more people really do need to stand up and fight these bullies. Scua I was in the same circumstances as you, had a mortgage for 16 years with a NICE high street lender, then went to a financial company (who have disappeared now) who got us a GMAC mortgage and we were with them for2 years and they sold our mortgage to WEBB RESOLUTIONS who totally distroyed us. My solicitor said I had a good case against both companys to get charges back but I had lost all confidence against these bullies, and just walked away. but now I am ready to try and get back all those ludacrest charges. I have came across this wonderful site and I wish I discovered it sooner.
  12. Hi Bayman, Good luck, I had the same battle with Webb after been transfered from GMAC, I had 6 court appearances and eventually the judge threw their case out as they were waisting court time. I asked the judge about the unneccessary costs as I felt they were very unfair and he awarded in my favour, it's worth asking at your next hearing
  13. Thank you, I will keep you posted, I was surprised to get a quick response from FOS regarding GMAC as ive got 2 other cases with them that I hadnt heard anything and they have responded to this one.

Hi, I had a very bad experience to do with GMAC and their never ending Arrear's Fee's that was added to my account, I tried to claim back charges and was offered £100 which I found insulting! so I spoke with FOS and they said they will take the case so Ive passed it on to them last month. Had a letter from FOS who said they will be in touch in 4 weeks. Gmac did response very quickly to all corrospondence (which surprised me!). I wish I found this wonderful site earlier, good luck and I will let you know the outcome of mine

Thank you DX & Andy for your advice, I will send them back a reply today with photocopies of their letters, Im sure they will then be able to provide me with my SAR, their 40 days to comply was up this week, so I gather it was a delaying tactic on their part, but hopefully I will get to see weather the money was been allocated to the account, I will keep you posted.
  17. On the judgement issued on April 2002 it has Page & Co Solicitors is where all payments need to be made. On 26/3/04 he received a letter from PW Kerns that they have been instructed to act on behalf of co-operative bank and all payments must be paid to them. On 12/11/07 he had Notice of change of solictor informing PW Kerns have ceased to act for them and they will be acting in person. also on 12/11/07 a letter from co-op saying account has been passed to Gothia Limited trading as Red Castle Recoveries for management & collection. on 5/12/07 a letter from Gothia informing him that they were dealing with the account. On 14/6/09 A notice of change of solicitor what has box B ticked: We Gothia Ltd have been instructed to act for the claimant in this claim, Gothia Ltd having purchased the debt on 31/12/2008. Application to amend will be made to the court in due course. On 31/3/10 Gothia send a statment from 01/10/09 - 31/03/10 and it just says Statement relating to an agreement originally made between you and the co-op. Last had letter from redcastle in Novemeber 2010. I would have thought co-op would still have information on their systems regarding this. He doesnt know what his outstanding balance is but he is still paying monthly, should he stop this until he finds out more information. Thank you

My husband had a credit card in 1998 with co-op bank that defaulted in 2001, they got a Judgment in 2002 and was passed to several debt collections where he has been on a payment arrangement with red Castle recoveries. He sent a SAR letter on 19/3/12 and today he had a reply that they can not locate anything for him. I found a statement from Red Castle Recoveries dated 31/3/10 listing agreement of payments made between you and co-op. His last letter from co-op on dec 2007 was to say his account was been passed to red castle. My question is surely co-op have records back to 2007 which is within 6 years. Can anybody advise what to do next?

Thank you, I did read a case where it was thrown out of court because Capital Once claimed the account was "Statute Barred" and I just needed to check as they have this on my account and if I did go to court the same thing would happen to me. i will get on with the final letter and spreadsheet and keep everything crossed but I am prepared to go to court, thank you
  20. I really need your advise, I sent capital one a letter to claim back charges on my account from 2000-2009. I last paid capital one in July 2009 and in december they issued a DN and passed me on to debt collector who I have been paying £10 a month. Today I have received their standard letter stating charges were fair but they would refund me £56 which is the difference between £20 & £12 charge. I was asking for £951 + interest. Now this paragraph is puzzling me that they put in their letter "We have not reviewed the default sums added prior to this date as such default sums are statute barred pursuant to the limitation act 1980. My account is not statute barred because I last paid them in July 2009 and they passed me on to Freddricksons where I pay £10 a month. I rang them today and asked could they explain "statute Barred" to me but they couldn't, but they could see I pay £10 to Freddricksons every month. Should I send another letter asking them to explain why my default charges are statute barred and also quote S32 (1)© limitations act 1980? Your advise would be greatly appreciated.
