  1. Hi me again I wonder if anyone can help me with my complaint with HM Samuel. I wrote to them using the template (thank you rebel11). They replied asking for the link to the like for like ring and when I have sent it to them they have told me that my ring has been discontinued and to take my broken ring to the store and they will fix or replace it. We already did this last May and they offered us a £90 voucher to replace the ring. We didn’t accept it as the ring that to us looks the exact same as ours cost £199 to buy then and we didn’t want to hand over our wedding ring and end up with something that isn’t even visually the same. I don’t know what to do now. They seem happy to offer us a voucher for the same amount we paid 2 and a half years ago but gold has risen so much and we can’t afford to put anything towards it to get the ring that looks the same. And to be honest I’m pretty mad that we have bought a ring that was meant to last the rest of our lives but hasn’t and they haven’t even apologised that we are set to lose our wedding ring L Can we take this any further or do we need to just cut our losses and either buy ourselves a cheap wedding ring out of our pocket and keep the faulty ring or can we take this further? Ideally I’d like to keep our ring and be compensated as it wasn’t fit for purpose and then use the compensation to buy something cheap and cheerful. Is this unrealistic? Any input would be really appreciated x
  2. We got married on 5 November 2008 and my husband's gold band broke. I have attached a link to the ring so you can see what I mean. The ring has come back and it cannot be fixed and they said out of goodwill they are willing to give my husband a £90 voucher to replace the ring. The ring cost us £80 18 months ago and to replace it now it would cost £199. I'm really upset that the ring we bought and that was blessed on our day has only lasted 18 months. Surely a wedding ring should last longer than that!! Do we have any rights to ask for a like for like. Ideally I wanted the ring we got married with to be repaired but as they cannot do that I don't think it's fair that they just fob us off with a voucher that won't get us the same ring as the price of gold has risen so much. I'm also upset that we won't get to keep our ring too.

  4. I sent a SAR to Lloyds TSB on 2 November requesting a copy of all information they have about me. They sent a pile of statements for my current account (they’ve already sent me 2 batches of those earlier this year) and savings account and also a statement of one of the loans I had with them a while back but nothing about my credit card (which was the main information I wanted). This is the letter I sent – LLOYDS TSB BANK PLC 25 GRESHAM STREET LONDON EC2V 7HN DATA PROTECTION ACT 1998 SUBJECT ACCESS REQUEST Dear Sir/Madam I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts. Please supply me with a complete list of transaction and charges relating to my history with your organization, INCLUDING Loans, credit cards, payment protection insurance and other products. Alternatively a complete set of statements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization: Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same. A complete list of all transactions or statements relating to ALL of my Loan Accounts with your organization. Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information. Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me. Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data. Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations. I enclose a cheque in the sum of £10 to cover your fee. IF YOU UNABLE TO DEAL WITH THIS REQUEST, YOU SHOULD IMMEDIATELY FORWARD IT TO THE PERSON WITHIN YOUR ORGANISATION RESPONSIBLE FOR DATA PROTECTION. I look forward to hearing from you in the first instance of receipt. Yours faithfully I’m wondering if I need to send another SAR to a different address for my credit card or are they just giving me the run around? Any advise would be greatly appreciated! J
  5. I am going to make my court claim tomorrow (can't believe i haven't done it before now!!!) and I have just been trying to familiarise myself with the process again but I’m getting muddled. Can someone please tell me which POC I should be using.   6. Many thanks for that. I was going to send another LBA as my last LBA was back in January and I didn’t proceed to Moneyclaim at that time. In light of what was announced yesterday should I still send another LBA or should I just file a claim now? Again many thanks for everyones help. I’ve stalled before as I got nervous and all your advice is helping me no end

  8. I've just read the notice at the top of the thread. What will this mean for me? Do I continue as normal or sit it out. Oh I wish I'd gone to court in January! eeek.

  11. I've just double checked through my statements and have found another £80 worth of charges. Should I just add these onto the spreadsheet and send with my LBA? Or stick to the original amount I asked for in my last letter before action back in January? Sorry to sound dumb, I just want to get this right
  12. As I sent the letter before action off back in January do I need to do anything else before I fill in the form at Moneyclaim? I'm a bit worried that it's been that long since me giving them 14 days and then going to claim that they can use that against me. I have been looking around here and through my paperwork and I am confusing myself no end
  13. I was scared off by the TSB claim that went in the banks favour but have decided to go for it. I've nothing to lose! I'm getting very confused reading up again. It's been a while since I've been on here so going to read up loads this weekend and get my form sent off to court. Wish me luck!

    This spreadsheet works out the 8% interest for you (it's the one on the link on the FAQ's I sent you) - http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html I used the advanced excel sheet as this one gives you two spreadsheets - one with the 8% on and one without. You only include the 8% amount when you get to the moneyclaim bit.
