  1. Hi guys, Received offer from Abbey yesterday for half the amount owed. The letter said 'without prejudice', I think I read somewhere that this means I can't discuss it or present this letter in court, is this right? Also do I send them the same letter as I already have done when they refunded £100, the 'thanks but no thanks' letter? I had a good laugh when I read the letter last night, kept mentioning that they weren't admitting to anything and of course I had to pay something for the service they've provided!!!

  3. Thank you, that's quite interesting I've never seen that before. Is that basically saying that I will submit my court bundle within 14 days? My local county court are currently setting small claims hearings for March, so unfortunately it's still a long way off! Hopefully this should speed things up though. I'm usually quite good with legal jargon but not sure I have the jist of this one, obviously I need to be able to understand it before I send it, sorry if I'm being a complete doughnut!
  4. Hi everyone, Just a quick update really as I haven't logged on for a while... I received the bank's defence yesterday saying that the charges are not a penalty and that the charges ARE infact proportionate to their costs and the banks losses. Just wondering does everyone receive the same defence (I don't want to be the odd one out)? Also with the defence I received an Allocations Questionnaire, so will get this filled in asap and send a copy to the bank too. Will be back when I have further updates but any advice on what their standard defence is will be greatly appreciated. Off now to read a few other threads.

  6. Hi, Just a quick update to say nothing much has happened. I sent off that letter a couple of weeks ago to say 'its been 3 weeks since I last wrote to you, when you indicated your clents wanted a one month stay to negotiate settlement' etc. Nothing heard back from the bank/solicitors at all! Still trying to sort out my court bundles though, maybe when they receive that it will start the ball rolling. It feels as though I'm being left behind a little at the moment with all the positive outcomes that have been happening over the last few weeks.

  8. Omigod! The crafty buggers, trying to short change you like that! I find the conditions very interesting, so if you refuse the conditions and go for a full unconditional settlement does that mean if you were to have a D/D returned for example you would never be charged ever again? I find that very hard to beleive! If thats right though surely we should all try to hold out for an unconditional settlement? We could change the way high street banking is conducted! Make history!! Am I right in thinking this or am I just getting carried away now? Leamarie
  9. Thanks again Gary, yes I am going to try and get the bundle sorted within the next week. Will try this letter first and if I've heard nothing after the 7 days stated in the letter, I will send off the bundle
  10. Sorry if I am being a complete doughnut but I can't find your thread! Where is it please? Re. the conditions Gary H and a couple of others held out for a full and unconditional offer and I don't think it took much longer, so it may be worth thinking about.
  11. Hi Elsinore, You have written some fab letters! Just wondering if you would mind if I pinched the one dated 8th November? I am at the stage where the bank have asked for one month to settle which will be up around the end of November. Have already sent one of Gary H's brilliant letters to say 'So you want to settle, so settle.' Have court date set for 23rd Feb but want to keep the ball rolling. Your letter sounds like it could be a perfect chase up letter. Leamarie
  12. Hi, No haven't heard a single thing from them since I sent that letter to say 'So you want to settle? So settle.' I haven't even prepared my court bundle yet and as far as I can see everyone who has received payment are ahead of me slightly. They will probably wait until the day before going to court knowing my luck!!! So you have received an offer too? Is it a full and unconditional one? Actually I will go and check out your thread...   13. Hi, My court date is for 23rd February too. I don't think there is anything we can do as the court must have set this date for a reason. My county court said its beacuse they are overwhelmed with small claims at the moment, (I have a feeling its got something to do with this fab site)! Don't despair though, the longer it takes the more interest you earn and the more time you have to prepare your court bundle. Leamarie

  15. I actually managed to log onto the website on my PC at home for the very first time tonight, YIPEE! I am now able to open the court bundle but before I get carried away and start printing 3 copies I think I had better buy another ink cartridge!!!

Does anyone know if I should write the schedule of charges including interest using the fantastic excel spreadsheet then just minus off £100 from the total and in brackets explain this is the amount already refunded. I think this may be the best way of doing it as yes they have given me £100 but what about the interest on that amount? Does anyone agree? Thank you :grin:

Hi Gary if you are there (or anyone else) This is the letter I received from the court dated 31st October, which I think maybe my directions: Notice of Allocation to the Small Claims Track (Hearing) DISTRICT JUDGE XXXXX has considered the statements of case and allocation questionnaires filed and allocated the claim to the small claims track. The hearing of the claim will take place at 14:00 on the 23rd February 2007 at XXXX County Court and should take no longer than 1 hour. The court must be informed immediately if the case is settled by agreement before the hearing date. Each party shall deliver to every other party and to the court office copies of all documents (including any experts' report) on which he intends to rely at the hearing no later than 14 days before the hearing. The original documents shall be brought to the hearing. Date: 31 October 2006 TAKE NOTICE THAT THIS SMALL CLAIM HEARING IS BLOCK LISTED AT 2.00PM WITH OTHER SMALL CLAIMS HEARINGS Cases are listed in accordance with local hearing arrangements determined by the Judiciary and implemented by court staff.
