  1. Thanks for the reply, I apologise for the delay in response, I am out of the country at the moment and I have just picked up my e-mails. I have already replied to Harvey's store by recorded delivery outlining my complaint etc. I await there response but I fear the negative. I would appreciate any help from the Harvey rep regarding this situation. Many thanks for your help also, I suppose that I shall just have to wait and see what the response is but as I said I fear the negative so where to go from there. I feel robbed to be quite honest it just does not seem right that they can do this to people. Regards Roasted

  3. Hi Coniff I have looked at their terms and conditions via the link kindly sent by Stu. The suite was not specifically made for us as it was a manufactured product from their supplier. We have paid more than the required deposit in good faith. No the terms and conditions were not explained to us at the time, it was to be quite honest as I remember a bit of a hard sell, we had a bit of a time getting out of the shop. We only received 2 items of paper as described which was 2 pages of invoices and no terms and conditions etc. It was scanned into our computer at the time for safe keeping, we have the original in the house. In the shop on Saturday the sales assistant pulled out of their computer our purchase records and sales invoice. We were told that the deposit was 10% to order the item and as usual it would take 8 weeks. We paid £345. via the visa debit card, I thought it was more but I have checked and this is the amount, in excess of the 10%. Thus leaving a balance of 1377 to be paid prior to delivery. As stated previously I became quite unwell and I was off work from August 2010 until January 2012. I have just returned to work and can I say it was in the nick of time and we are still not out of the woods, we have a very long way to go and we take each day as it comes basically. Hi I am sorry, I have only two pages of Harvey's agreement and it has nothing out lining terms and conditions it is only the sale sheets, detailing the merchandise and the cost etc it is just an invoice. Their is no terms and conditions attached to it. As I have stated it is a bit long winded as in time gone by, but a lot of things have happened during and since this purchase, yet my wife and myself have repeatedly attempted to sort this out amicably with the store, but all times they are insistent that absolutely nothing can and will be done, the money will not be repaid, there will be no credit note to cover the deposit that they have taken and no goods will be offered in lieu of the deposit. In effect we have to clear off and stop bothering them. I appreciate any assistance that you can offer, we find it quite frustrating, especially after the circumstances. Regards Roasted

Hi Yes communications by telephone and store visits.The term of the purchase was that upon the suite being ready the store would inform us, and we would pay the balance- they would then deliver the suite. I shall have to get back to you on the terms I shall have to look at the paper work so excuse me. However the initial deposit was 10% but we paid more to lessen the blow at the end. This is some thing I will not be doing again I can say. I shall be in touch shortly. Thanks again for the interest. Roasted

  7. Hi Thanks for the reply. The reason why we have not taken delivery is that because we were not in a financial position to pay the suite off before delivery and that my wife asked repeatedly if the store would put it on hold until our situation improved. The store refused to put it on hold and cancelled the order because of our default at the time. If the suite could not be paid for and delivery taken as per agreement then they would cancel the order and keep the deposit. They did both within 4 weeks from the delivery period and within 8 weeks of the initial agreement to purchase. My wife has tried several times as have I to sort it out but they will not budge. The store in question as of yesterday had contacted their head office and the result is the same, even though the store as of now are quite sympathetic it is beyond them. They have said in the store that "should I purchase anything else from them, then they will discount the goods above what is considered normal"? I hope that this helps. Roasted
  8. Hello all. In 2010 October I signed up for a sofa suite from Harvey's store Darlington. I paid over the deposit and handed over £375. from a £1200 suite. Within 4 weeks and before the suite arrived I became very seriously ill, as a result being self employed I was without earnings. We could not get benefits for months, and we almost lost everything that we had including our home. My wife and daughter held car boot sales and virtually sold everything that could be sold to survive. My wife informed the store of our situation and this went on for months, the store in question just said basically hard luck and good bye to the deposit. My wife even asked if the order could be put on hold, and again good bye to the money was the answer. I myself was too ill (breakdown) to do anything and to be honest my wife kept it from me due to my illness, during all of this my wife's mother and later her father passed away, add to this our son was going through several periods of abdominal surgery and still is. So my wife had a lot to contend with. I am now recovered and have been on my feet in relative good health for about 6 weeks. I have contacted the store myself and explained in detail but ignorance was their answer. Now this is a significant amount of money to lose on their say so without any form of explanation except ignorance and no money will be repaid, you cannot even have the money discounted off some other goods?. So what should I do and how do I stand in all this. I appreciate that it has been a significant period but a lot has happened and in the interim my wife has on several occasions spoke to the store and was told to clear off.   9. I had a duncton experience. They took my car after falling behind 2 months? I shall not bore you with the details about it, but I offered to make up the payments. They were ok about it, it happened again and I was told only 2 defaults were allowed. Two very big and ugly blokes turned up, one could not fit into the car he was so overweight. I am glad to have got rid of them to be honest. They are a very shady bunch as is trace recovery their agents. The car was sold for its full retail value after i had it 18 months. They had twice as much as the car was worth in total if you include my deposit which was significant and the money I paid off also. I don't know how companies like these are regulated if at all.
