  1. my mom has been off sick for a year but was still employed by the company whilst recieving ESA. The company have gone into administration and have sent her a form to claim redundancy but the accompanying letter told her not to apply for holiday pay on the form that holiday pay would be still paid by the company and would be paid in march's payroll. She received a blank payslip followed by her p45 at the end of march. Is she entitled to any holiday pay??
  2. my sister has worked for a legal firm for 4 years, has trained through the firm to get to executive conveyancer. Throughout this time she has suffered with ulcerative colitis a dehabilitating illness which has progressively got worse over the years (she has had the condition for 8 years and the firm were well aware of the illness when she was hired). As such she has had to have large quantities of time off sick (most of which has been covered by the firm using her holiday to cover it) The firm decided that because of her time off work that they would need to hire a locum to cover her when she was off sick. This was the case until she got back from a two week period of sickness in july and was told that the locum would do her job full time and my sister would work alongside her, that no client files would be opened in her name but as soon as they could see that she would be back to work with no absences then they would reinstate her back to her position and that the locum was only temporary anyway. Occupational health were instructed to contact her doctors so that they could obtain their position as to whether she would be able to return to work full time soon. Occupational health received information saying that the only way that my sister would be able to return to a normal life would be by way of an operation. The firm looked into private care for my sister but before they could do anything about it my sister was rushed into hospital where she had her colon removed and now has an illeostomy bag as well as some effects from the ulcertative colitis.She was away from work for a month and has at the moment been on a fazed return to work where she is working 4 days a week 9 til 3.30and has been told that she will be doing office admin for the time being with no role in her orginal job at all. The operation that she has had means that she doesnt have any time off sick at the moment but work say they think she looks ill and tired all the time. They keep mentioning that they think the commute to work is not helping her as she lives 40 miles away. To get completely better my sister will need another two operations but her surgeons have told her that most people decide to get on with their careers and have children after the first op and she has anything up to 10 years before she will need to have the 2nd operation. Alternatively she can have the 2nd operation as soon as she is medically fit, which at this time would mean she needs to lose a lot of weight which takes time in itself. Work have had reports from the surgeons stating this but work are saying that the report emphasises that she will never lead a normal life until she has had all three ops (which is true because of the ileostomy bag but poeple live with ileostomy bags everyday) My sister was called into a meeting yesterday saying that the locum would take over her job full time and will be contracted into my sisters position after a year if my sister has not recovered from all three ops (she will not be able to have all three ops within the year anyway) that she would be demoted to basic admin elsewhere in the firm and that if and when she recovers she will then have to reapply for the same position within the firm when a job becomes available and undergo the normal interviewing process. All her training has been stopped and she has been asked whether she wants to go full or part time but that they are not really bothered either way. My sister is devastated she has worked hard to get where she is, feels like she is being forced out and that that they are using any excuses to achieve this. Work say that her job involves providing a one to one client service and that if they never know when she will go off sick or have the time off for other operations then it is affecting their business. Are they discriminating her because of her illness, can they demote her on these grounds?

Dell have called me back this morning and told us that they are initiating a tracer on the package that will take 8 days, but on the 25th UPS told us that they had already started the tracer and it would take eight days from then (and this shows on UPS tracking system on the internet) When I tried to argue this with Dell they were having none of it and say that they are doing it from today. I asked to spk with a supervisor and tried to explain the problems i have experienced and also told them about the amount of time and money i have spent on phone calls. They say they do not have to reimburse anything and it is the customers responsibility to make sure that things get done. Do companies reimburse such expenses because they are required to or is it out of courtesy when they do?
  4. this is a complete joke just had a call from UPS to say they think that the phone has gone to o2 and by the way are we sure that we dont have it!!!!!

Dell computers were sending us a new Dell Streak mobile phone as we had had endless problems with o2 repairing the phone and had gone directly to Dell who assured us that if we sent the phone to them then they would get a new one sent to us. UPS collected the phone and it got there fine. The new one was sent out and they had tried to deliver it to us twice but we were out and the card put through the door said they would deliver the day after. I waited in all that day and and in the evening I contacted them asking where it was. I was told they would contact the driver but it would probably be enroute tomorrow. After waiting in another day, still no phone, i contacted them and they told me that they didnt know where it was and they would 'look for it'. I contacted Dell immediately and informed them of the situation. The tracking information that can be viewed on the internet showed the phone as being at their tamworth service centre and i was given a contact number for tamworth. They said they thought that the package and been sent back after failure of delivery twice but customer services still said that the phone was at tamworth. For three days and endless phone calls noone seem to know where the package was and worse really didnt care that it was missing. In the end they have agreed that the phone is 'lost' and that a tracer was needed to be placed upon it to see all the indvidual scans that the packages go through that are not shown on the internet tracking system. In order for this tracer to be initiated Dell would have to authorise it. I spent three days, 50 quid, trying to get through to any department that knew anything about it of Dell who eventually told me that they would sort it but they didnt see why they had to as UPS have an agreement to chase any of their packages. Only to have an answer machine message from dell america to say that they had looked it up and that it was in tamworth!!!!! i spent another 7 hours on the phone and eventually phoned back UPS who said it was tuff Dell needed to authorise it and their hands were tired (although they tried to tell me at first tamworth had got it). I had had enough I contacted Trading Standards who told me that as Dell sent the package it was their responsibility to find or replace it and to send an written letter to their complaints address which should be on their website. Let me tell you trying to complain to Dell is just about impossible and after searching forums of other complainants of dell on the net I found an email and head office address. The email gave an automated response but within 4hrs the website had changed to tell us that a tracer has been put on the parcel. Apparently the tracer takes up to 8 days for some reason and we are now waiting Again!! Trust me - you will regret dealings with these companies.
