    It is much appreciated.

    Unfortunately, My mum has next to nothing and she helps me out with, or rather my deceased dads pension.

    I live in London and to rent would leave little difference between that option and paying the mortgage now.

    I was going to write them a letter saying, quite rightly, that this increase will break me completely and that I just cannot possibly afford another penny.

    I often wondered about these equity-- plans. I know that they can be a problem but it is good to hear it has worked.

    I wonder if I clear the relatively small arrears, - mum again - they may reconsider.

    They actually told me at one point it was because I had cancelled more than one direct debit. - i cancelled 2 but informed them I was doing so.

    That was when I was on my payment plan and it was coming to an end and my payments were due to jump to the present amount and I wasn't yet in my part time job.

    However, I still paid the amount for my payment plan and never missed a payment.

    I then went on to full amount.

    I can only try.

  2. Thanks Maxx. I would think that I would need to be told to cancel the service with Sky.

     

    That is the whole point.

     

    The lady NEVER told me to phone.

    Sky have obviously listened to my call.

    Would it matter if I was a first timer.????

     

    You know that you have to be told or given written t and c s......I was not.

    I was not told it was my old contract being resurrected either.

     

    It was not a missed payment as I had no second month broadcast,

     

    What about the Debt issue?

     

    One debt company say they are satisfied and there is no further action.

    Sky ask me to go back.

    I refuse and another company come after me saying Sky wants their "debt"

     

    Get chased up and threatened.. For what?

     

    As I said...dog with a bone...you can't threaten somebody when you have told them no further action.

     

    Dirty tricks by Sky in my opinion!

  3. Interesting. Had another threatening letter from Past Due Credit, re the above saying the usual blurb about impending action.

    Under no circumstances am I going to phone them on their pricey phone however many pence per minute number to inform them again what I informed them earlier.

     

    Personally, I think of all the companies I have ever had to deal with, Sky pull the dirtiest tricks ever and seem to be forever trying it on.

  4. Many Thanks....Yorkshire said that it was their policy but the way it was said, gave me the impression it was set in stone everywhere. There is no problem proving my income for the future. I have a feeling they won't budge so I have no idea what my option will be . I owe £520 arrears so no other company will want to take me on.

    If you receive any letter regarding overdue of payment from the debt collection agency, inform them that the outstanding balance is been cleared and for more details they can contact Sky.

    Just a warning to anybody else who may have had the No Further Action message from a DCA and a subsequent letter from another trying to resurrect a non existant debt.

    Hi..I am wondering if anybody has any advice.

    I was in arrears to my mortgage company because I was unable to find work at 55 years old.

    They agreed mortgage re payments of the basic which was £400 per month plus some off the arrears which I paid another £150 on top.

    In fairness, they extended this agreement for several months . 

    Eventually, they demanded I pay the full agreed amount per month. £1,320.

    I managed to get a part time job and this along with my private pension enabled me to pay that amount, I say allowed, but I have absolutely no quality of life whatsoever and my 86 yr old mum pays my council tax with her disability money.

    I had been on a fixed rate mortgage with the company which comes to an end in May.

    They now cannot offer any other offer and I must go back to the ordinary rate.

    This will push my repayments up by another £70 per month

    There is absolutely no way on earth I can afford another penny over the £1320 I am struggling horrendously to pay.

    My mortgage still has £119,000 on it.

    I am able to pay a considerable amount each month because that is all of a private pension I got after paying in for over 35 years.

    I have asked the Bank if I can extend the years I pay my mortgage for.

    They said that they do not do this because the mortgage must be paid in full by my 65th birthday, which is 9 and a half yrs away.

    Whilst I understand that 65 is a recognised age for pensions etc, it does not apply to me as I will always have my private pension which is indexed linked but will never drop each month unlike some.

    Also, if I die, I have full mortgage protection policies and life policies.

    I just cannot see why they cannot extend the term which would help me enormously.

    They insist there is nothing that they can do and I don't qualify for any fixed rate because of the recent problems

    They may just as well have the keys back now because paying another £70 a month will topple me so we are in a stagnant situation.

    Can anybody please give me a hope.

  7. Hi Thanks for your posts.

     

    I am not quite sure about the legality in "assuming". Time and time again in these posts we are told never to assume, yet you say it would be reasonable to assume this was a resurrection of old Terms and Conditions.

     

    My contract ended with Sky ended a year or two before that no problem, hence the Terms and Conditions did too.

     

    All I know is that the agent said this was on a month to month basis. I am absolutely confident NOTHING was said about phoning them to cancel. My Sky TV was switched off by them shortly after the start of the 2nd month anyway.

     

    My concern is this.

    How, can a Debt Company, allocated by Sky, investigate and be satisfied that no breach had been made.- I told them to listen to the conversation whereby they would find no mention of Terms and Conditions or phoning to cancel - come back with a No Further Action result, only for Sky send it out to another Debt Company to see if they can have a go with their threats?

     

    Where does it end?

    Past Due Credit listen to the conversation, find no breach, send it back to Sky , who then send it to another Debt Company etc etc etc???

     

    Where is the right to reply with Sky without them feeling they have a right to spoil your credit?

     

    What about the fact that Sky tried to get me to sign up, (wiping out the "debt" as they told me.}and when they hear nothing from me, scrape this up again 18 months later after I was told there was no futher action?

    A form of blackmail and certainly seems like a breach of something or another!

     

    Even if they demanded a penny I would not send it. You surely cannot NFA something then try it on again

  8. Thanks MaxxPower but there are a couple of points here.

    Firstly, the buyer should be told the terms and conditions and not assume them.- This never happened,

     

    Confident the conversation was being recorded I asked the agent, after paying for one month by card whether there was a contract and she said no. At no point was I told to phone to cancel. She never said so I didn't ask.She spent 15 mins talking about her Christmas plans.

     

    Secondly. Don't you think there are a few dirty tricks here? The Debt team allocated by Sky at the time - 16 months ago did their investigation and told me there would be no further action.

    Out of the blue, I get an "offer" from Sky promising to wipe my " debt" - what "debt? -" if I return to them.

     

    When it is obvious that I am not interested, they get another Debt Company to start threatening me and stating "It was the other company that decided no further action and now Sky have sent all their 2010 stuff back to us to collect"

     

    I don't want any goodwill gesture or anything from Sky.

    I am big enough and ugly enough to tell Past Due Credit Solutions where to go, but my concern is, they will start contacting other "debtors" whose matters have been resolved, trying to extort money.

    Hi Can anybody help please.

    Many years ago, I had Sky tv but after many years subscribing,I cancelled it.

     

    Just before Christmas 2010, I was called by an agent from Sky, who offered me the service for half price. The woman catagorically stated that there was no contract and that if I was not happy continuing the service, I didn't have to, as there was no bind. After a month, I was unhappy with the usual constant repeats and cancelled my payment. No problem I thought. I had paid my money up front and had had my months viewing .Sky cut me off as expected. End of. Or so I thought.

     

    Several months later, I got a final demand letter for £30. I sent them numerous letters saying that I had not had a second month of viewing and I was not paying. There was no contract written or verbal. They replied stating that I should have told them I was not continuing. I replied saying that absolutely nowhere in the conversation from their agent who called me, was there any mention of being told that I had to contact them if I did not want to continue. They immediately got huffy and sent their "debt" on to a collection company they used at the time...the name escapes me.

     

    I wrote to the debt company and told them this could be solved by listening to the phone conversation I had with the sky agent'

    Several weeks later, they wrote back to me and said that they had investigated the matter and as a result, were happy that nothing had been breached and there was l no further action.

     

    A couple of months ago, I had a letter from Sky... "Come back to us" they said "we will wipe off your debt"....Strange, I thought, I have no debt with them. I had no intentions of phoning them on their premium number to remind them of this fact.

     

    Like a dog with a bone, a few days ago, a letter dropped on my mat from a company called Past Due Credit Collections, acting as agents for Sky,demanding payment of £37.49P. However,the letter said, if I wished to reconnect to sky, I could call Skys operator.

     

    I phoned today and told the guy at Past Due Credit Solutions that the matter had been resolved by a previous company acting for Sky.

     

    His reply was "well it may have been resolved by another company but the papers from 2010 were all sent back to Sky and now sky have given it to us to collect the debt."

    I told him that he had no chance of getting a penny from me as I owe nothing, the matter was investigated and it was proved that I had broken no contract.

    I then got the "your credit will be affected" threat

     

    Who are these people?

    More to the point, what the hell are Sky playing at?

    If this was not an underhand dirty trick to either try to get me back to subscribe to some stupid overpriced sky package or try to scare the hell out of me, I don't know what is.

     

    How many other vulnerable people are Sky trying this on with.?

    It seemed to me that the person who I spoke with at this debt company knew full well this matter had been put to bed by the other company but he was trying it on.

    I sincerely hope that any vulnerable person, doesn't have to deal with this.

     

    Anybody have any thoughts or ideas on this ? x

  11. Hi Everybody.Just my absolute luck my PC crashed last week until now and this is my first chance to get access and to reply to you all. I thank you all so much for your hel. The case is due later on this week. I will do as suggested and concentrate on the hard facts. I have spoken to Restons and the person said the usual "i dont knoiw why you are contesting because i guarantee we will not be asking for more than £30 per month" He then went on to say "however we do reviews every so often" That to me, spoke volumes. They said they had no record of my previous payments, they could not tell me how long I had been a customer, and had only corres from MBNA since Dec 2010 stating how much I owed. I have been with MBNA for at least 15 years in my reckoning. As I said, I will take on board everything you said. I sincerely hope that the judge doesnt treat me like a number, but sees that I intend to pay every month and have not given Restons any reason to believe I wont.

    Any relevany Acts and Sections of Consumer Laws that anyone can provide so I can look up, would be greatly appreciated .

    I am certain, tho not 100 per cent, that the Court Papers said to return them to Restons. I may be wrong here, but I seem to remember them saying that unless I wanted to contest the CCJ. I spoke with Restons to confirm that I was to send them there and Restons said yes. I posted them that very day, but the alleged they received them after a 14 day cut off period hence the CCJ went ahead as a "no response".

    I have been with MBNA for about 15 years, maybe longer. I am ashamed to say, I am one of these people who just paid up without checking anything. I had never any reason to request any charges because I was ignorant. I never had reason to think of any discrepancy there might be. Like other folks, MBNA were just chucking credit at me, up to £13,500. I am not blaming them. I agreed, spent the money but always paid on time until my job situation changed.

    The CCJ was granted a few months back and as soon as the relevant amount of time passed, they then went in for an Interim Charging Order.

    I complained to the Court at Norwich regarding the papers being returned and they agreed that the Judge at my local court will hear my story regading this at the same time as the full Charging Order is heard which is next week.

    Restons wanted £130 per month to halt proceedings but I was not going to agree with something that was not sustainable whilst I did not have a job. I explained fully to them the problem that having a CCJ would mean to my employment, but they said they had to act in the best interest of MBNA etc.

    I guess it is too late to ask for a break down of charges etc over the years. I accept that the CCJ will remain when I go to court, but I am desperately unhappy about the Charging Order.

    How can these companies/ solicitors demand a unrealistic amount each month just to keep things out of Court?

    They can quote any outrageous amount, knowing full well the person cannot afford it and so they have the green light to go to Court for whatever order they want.

    Isn't there a law which says that the amount required as a repayment, should be reasonable, taking into consideration, the persons present circumstances??

     

    Thank you especially to Denzil69. I will take your advice re fighting the CO. I have paid so far although not what Restons want, so there is no reason I wont pay in the future.

    I dont believe Restons promise to me that they "are not after the house just a security you will pay"

  13. I really do appreciate your help in this. I was just ready to say, "yes I owe you money and there is nothing I can do to deny this". Since being passed over to Restons from MBNA, they, Restons have acted rather quick. One month I payed £50, the next when I phoned up, the girl said that I didn't have to stretch that far and they would - and have - accepted the payments, albeit only £30 per month, which they take out by card direct debit. I will definitely go oto Court on the emphasis that I have not defaulted on the payments made so far so why should I now. As far as costs etc are concerned, I am lost in a maze of figures. I also wanted to argue that if a CCJ had not been taken out against me in the first place, I would be paying the FULL amount every month. I know 100 per cent I would be in a job in the legal sector if the CCJ was not in existance and that would be the end of the matter. Restons have cut off my nose and spited my face so we both lose out. Me no job, them no money because of that.

    When I first started speaking with ERestons, I informed them that I was paying the same amount for similar debts and others like Lombard Direct, were very happy with the payment and sent me a letter confirming that all payments must be fair etc, it is Restons that have bulldozed through. As I said, part of me realises it is my mess, but at the same time, I feel there really was no need to charge ahead.

    I don't have anyone else living with me. The case is up at Court in a couple of weeks. My statement of means will show that my outgoings are more than my income and the mortgage company have in fact given me a break for a year and I only pay the interest plus a sum towards the arrears unntil I get on my feet and get a job. That of course takes me back to the legal problem. I cannot claim a penny of goverment support because I have a private pension

  14. Hi Everybody. I would really appreciate some help as I am worn to the ground with all this. I presently owe £13,000 to MBNA. I have only a pension, have no wife or dependants, and can pay them £40 per month. Restons say they have no problem with this payment but want a Charging Order on my house, which has equity enough to pay the outstanding amount should I default. When I initially returned the Court papers for a CCJ( before the Charging Order), I sent them to Restons, as requested by them, within 14 days as requested. Next thing I know, I have a CCJ recorded against me in default, as the Court said I had not replied. I contacted Restons, who said my papers reached them outside the 14 day period. I know I sent it back in time, but being stupid in retrospect, I didn't queue at thePost Office to get it sent recorded delivery.

    So, having obtained the CCJ, Restons have gone on to an Interim Charging Order and a full hearing at my local court in a few weeks time. I wrote to the Court and told them I was not happy to be treated as if I had ignored them as I had not and they agreed they would hear my story about the "late arrival" of my response to the original CCJ .

    One of my main questions is, Is there any point in arguing any further??. Restons will go ahead with their application in a few weeks time. Is it inevitable I will lose ?and they will get their Order, because the fact is, I owe them money?.

    My main problem was that because I worked in an area whereby to have any CCJ was a no no, I have been unable to apply for any jobs where my expertise lays. That means no job, no money to pay in full. I almosted pleaded with Restons not to go ahead because it would destroy my job hopes but they ignored it. I dont get the job, they dont get their money. This could have been avoided. But back to the question of the Charging Order. What defence do I have, if any? Am I wasting my time opposing it. Sorry to go on, but I would so appreciate some help I am in pieces.
