Hi all its been a while since I have been on this forum due to health reasons...anyway I am looking for some help please. it this thread I was a t the stage where barclaycard had offered me half of what was owed to me..... because I have not been well for last few months I know that the offer will now be fully withdrawn. What I would like to find out is am I able to start again with the claim to get my money back even though I have been through the process of sending them a letter before action and them making me an offer Cheers Debs
  2. HI there Away back in March I parked my car at the shopping centre free car park at woolworths. When I came back 2 and half hours later I had a ticket from a company called BPM Group Services it said on ticket I was to pay £85. I was told ignore it by a memeber of my family that was with me so i did. A few months later I had forgotten about it and received a letter from a credit agency in Londonsaying that BPM had asked to get in contact with me and they now want £95.00. I am raging so sent a letter stating what I had read on here about Under the 1991 Act, they must also clearly identified as a Parking Attendant. ie. If they are not wearing a hat, or epaulettes then they cannot issue a ticket. I said that in the car park its just young boys hanging around on corner wearing bright yellow jackets giving out tickets where they liked also aske if they could prove I was in the car park. They have asked me to send away a copy of my tax disc which I refused to do. My question is can they legally persue me for the £95.00 Cheers Debs
  3. I live in Scotland.....can you still claim your money online with sheriffs court like you can with the money claim, or do I have to go into the court and hand in the paper????...do you have a link to where it is I should be looking Cheers Debs
  4. hi guys trying to find out about money claim i live in scotland and was on money claim website last night the details below said on the site you need England or Wales addy I stay in Scotland. Can someone please tell me how I go about making my claim now ?? Money Claim Online is suitable if: Your claim is for a fixed amount of money (no more than £99,999.99) Your claim is against no more than 2 defendants You have an address in England or Wales where documents can be delivered All defendants have an address in England or Wales where documents can be delivered You have an e-mail address Cheers Debs

  6. Hi NIk i seen that on bbc news yesterday, I was thinking of maybe phoning up Currys and stating this fact to them, that is does actual occur. They will probably just say that its a differnet company but ike you say they are all supplied from the far east countries. What you think a wee call to them to let them know I am still on there tail ??? Debs

I have sent them two letters first stating my complaint and asking for them for a refund or replacement gave them 14 days they waited till last day to contact me then is was by telephone call a quick 2 mins to say that all the could do was take the laptop back to work shop and get engineer to reasses it. I never sent it back because they have already examined it and did not think it would make any difference. Second letter was Letter before Action think this is where I might have went a bit wrong I gave them only 7 days to reply to Letter before Action because a was so peved with them from last letter waiting till 14 working days for them to contact me. They have not bothered to reply to the letter before Action. So do I sent them a letter stating all the times I have tried to contact them give them another chance to respond or start small claim ?????? also sent letter recorded delivery and they did receive the letter Cheers Debs
  8. hi blacksheep1979 i did sent them a letter before action on the 24th july they never bothered to even respond to the letter. Do you think I should just start small claims or send another letter to them. I have read on here sending a few letters looks better for me in the long run if it comes to taking them to a small claims court ?? Debs

  10. alritey to answer cindyLS question we originaly bought the laptop on HP at Christmas but on may of this year we sent cheque away for the outstanding balance on the laptop and typical the problem happened in june . I am hoping to send a letter tonight when I get home from work any help would be great. I dont know if another letter will help because they didnt bother responding to my last letter. or do u think small claims court is now the way to go Cheers Debs
  11. hi guys update on laptop the final day for them getting in contact with me was y.day (wed) and you guessed it heard nothing no mail no phone calls. Thanks StoneLaughter for all the help with the letter before action thats the one I sent to them with my details inserted. So now I guess its the big move I have to make and take them to court :o bit nervous but determined to see this through.   13. update with barclaycard.....barclaycard offed me half of what i asked for they offeded me £156 back in 25 july a sent a letter away saying that I would accept the £156 in PARTIAL PAYMENT ..... got a letter back from them today saying that they ...note I am dissatisfied with the offer of the refund £156.00. However out position remains thats we believe it is fair when customers' break the terms of their agreement with us, we recover the costs. Therefore , I am not prepared to consider your request for any further refund. goes on to say about terms and conditions. then ....they appreciate that this may not be the outcome you expected, however I trust that the information I have provided has clarified Barclaycards position. What should I do now I dont even now if the offer of £156 is still there for me to take .......whats my next step guys Cheers Debs
  14. Thanks StoneLaughter for the draft of letter, its great and its giving me hope again. I am going to post it rec'd first thing tommorow. I am raring to go and kick some ass again blacksheep1979 "Where in the UK are you debs? - I could asses the laptop for free and if find no accidental damage will happily bill currys for my time. I work as an IT contractor and they will be billed from a registered company, just depends wether they take my word for it - they'd probably say they prefer their own techies word" thanks for the offer but I am going to go with stonelaughter and send the letter cheers much mate. I do have a wee question for you thought that I had wrote in my letter to Currys I asked them to tell me how a engineer can define accidental damage to any other sort of damage ?????
  15. thanks StoneLaughter for advice they said that if i took it to an independant engineer i would have to pay for it they are only willing to pay for it if the indp engineer says different from what there report says ...so if it came back the same then i would be left with the bill for engineer also
  16. Hi guys Update on Laptop received a call from currys today unfortunalty I was not in and my mum took the call. The women from currys said that all they can do is for us to send the laptop back to them and appeal the decison of accidential damage I am raging that they called I would rather they dealt with it thought mail, also mum doesnt know much about what questions to ask on a phone so she got no name of who called a telephone number to call back on basical she got no details at all So they said sent the laptop back to appeal the decision there engineers will take a look at it again, or we ourselfs could go to an independant engineer and get it tested and if the independant engineer says its not accidental damage they will pay for the indep engineer. I am so NOT amused. They still have not answered the question that I put in my letter asking them to tell me how they can come to a conclusion of accidental damage. Just feel that its been a waste of nearly 3 weeks to get a reply to the letter a sent them and not get feed back on the questions I have asked. Debs (depressed and down now)
  17. hi thank for info, yes I have sent LBA it was this letter that got yhe response of them willing to give me £225 back and not £450 orignal asked for. So your saying what I do now is send them a letter back saying yes I will take the £225 partial settlement and dont sign the full and final statement. What happens after the 7 days if they dont offer me the full money is that when i fill out the moneything(cant remember the right name) on line ??? cheers Debs

  19. up date on laptop progress, i sent a nice letter on 6 july stating facts of what happened with the laptop and my sisters hand gave them 14 days to reply so fingers crossed should hear from them at start of next week. I sent it to there Hempsted office. I did not think about getting pictures of my sisters hand at the time, which I had know and I am taking pictures of the laptop because on the outside casing there are no damage marks i.e scratches or bumps dents. One of the questions I have asked in my letter is for them to tell me how there workshop come to the conclusion of accidental damage !!!!   20. Hi there Just giving an update of how far i have gotten with my case. Sainsburys sent me a letter saying that as a valued cardholder they are prepared to offer me refund of charges to the value of £225.00 representing half the amount applied for. I know this is good and a step in the right direction. Now a just want to double check I have read all inforamtion on here, they have sent me a Full and Final setlement they want me to fill in agreeing to accept the above amount. So what do I do because I know you take the money but how do I do that without filling out the full and final settlement cheers all help welcome Debs
  21. Hi all, I sent my Data Protection Act letter to Barclaycard on 16 june they received it recorded delivery 19 june. Today I received a letter from Customer relationship Manager. The letter says 'Thank your for taking the time to contact us regarding the level of service received from Barclaycard. I am very sorry to learn of your dissatisfaction blal blal. Your correspondence is being dealt with by this office and we aim to resolve the matter by the 18th July 2006. I sent it to 1234 Pavilion Drive. Letter goes on to say they are dealing with my complaint as quickly as possible, and will investigate all aspects fully. I dont understand why I have received this letter I have not put in a complaint I asked for my credit card statements Is this a normal letter to receive from Barclaycard ??? Please help cheers Debs

    I have been reading this forum for the last few days and really enjoy the information available. Today I sent my 1st ever DPA away to three places Sainsburys bank, Capital one and Barclaycard. I sent the DPA that is provided on here along with three seperate cheques each for sum of £10 pounds. Also in recorded mail. I know that they have 40 days to reply to these letters please can someone confirm that i have done this right today bit worried :-| I might have done something wrong cheers in advance Debs
