would my circumstances allow such a request Old-Cadja from what I have revealed? i have been wondering what would have happened if I had contacted the BTP straight after the incident in that would it have gone as far as court. -
good advice as usual. I will go, be honest (which I am) and hope for the best. I know the advise here is only opinion. Discharege - 1 year spent cond discharge - 6 mnths I expect a fine to be honest but on the basis of good charcter and possibiity of effecting my working life plus my utmost sincere apologies will suggest discharge , if its not be then so be it. Yes I did read thanks you very much and all have been helpfull. What is confusing me is the fact one prson has advised to request a discharge and I know for a fact this a 'discharge' recordable, are you saying it is only recordable for recordable offences? be clear is a discharge for this unrecordable byelaw thus unrecordable? I am just getting a bit stressed now and not thinking right as it stands I have written and apologised as advised and I will repeat in court

Yes it seems I have been unlucky but I have come to terms with it and no pt in crying over spilt milk. Very annoying though when you consider some of the things you see people get away with these days in saying that it is my own fault and hopefully when I apologise to the court they will see I am genuinely apologetic and be leniant. from talking to people here they suggest 'the location may have an issue' and yes I agress someone somewhere is definitely pushing this to massage some figures , lets hope the magistrate is as annoyed with it as I am but I wont hold my breath!

I am reliably advised by more than one source that this breach of bye law is non recordable, fingers crossed whatever happens my job and future job prospects are not effected -

Can you please advise what a conditional discharge actually constitutes, what form would it take. What in effect it means -

'It is possible that they might award a discharge, conditional or absolute, but nothing is ever certain until the Bench announce verdict and sentence' Even though I plead guilty I may not be found so? Please explain how and why a conditional/absoulte discharge may be awarded and the implications of such a thing. Also am I obliged to speak before sentencing? and is there anything I can plead I may not be aware if. A part of me is relaxed but another part of me is thinking ' what a silly bu**er' to get yourself into such a situaution -

it was actually wall in ladies toilet so admittedly not nice at all see my reply to wriggler sorry for reposting.. Appreicate your advice Wriggler have not been on here as have been trying to relax about it all was getting very uptight My letter is sent in which I have advised that I have had a drink and been dieing for a wee on the tube, then in a moment of madness I have done the deed. I have apolgised to all involved and mentioned how embarassed I am and that I am of previous good character. I have asked that 'due to work commitments' could this pls be dealt with in my absence. I have spoken to the British transport Police and they advise that these issues are normally dealt with in my absence but I am not sure how much I can trust that advice , after all they are the prosecution she seemsed a genuine woman though. I ahve been generally advised that these things can depend a lot on the 'mood' of the magistrate at the time. If I go it may cause issues at work in that they may need to know why I am going and in that I am covering for others at the moment so will not go down well (what I am saying is my reasosn for not going are legitimate) I have not spoken to a local man as cant find a decent affordable one to be honest. One option iof I go is to consult the suty solicator although not sure what advice he can give me on the day ? Am I going abut this the right way guys I sure hope so also so the mag does want to see me what will happen I will be summons ata later date ? and is it likely this will end up costing me more? very confused and just want this over with -

wow I cant get my head around this. Lastly OLD_Codja as its NYE Ill leave you too it, but I am now wondering if my letter of apology and request of absteeism was such a good idea, it is def heartfelt I just hope it is viewed that way. -

More like what ? There is honestly no mention of anything more. Why would I decieve 'Soiling rail property' that is charge honestly Are you suggesting there may be a suprise for me in court ? Surely it is based on the documentation and statements you receive and in that respect I have been honest about everything -

I had been drinking yes but not particularly more than usual and yes I did pee in ladies toilet I received a caution at the time so says officers statement There is the usual questions did you do it etc I denied at time but said sorry I have now written letter apologisng to all involved and advising that I had been dieing for wee on tube and ran to toilet in station but didn't make and through impaired judgement did the deed I have asked the court to deal in my absence You are saying this will be rejected? If so I will have to get off work somehow and maybe go anyway Opinions? -

Hi Wriggler Yes I am sending the form with the apology letter and proof of earnings (pay slips) re drunk The truth is I had a drink too many but have had a drink too many on occasion and never done anything like that. I had been dieing to pee on the tube and do have bladder issues (bit embarassing but I do go a lot).My letter so far does not mention drunkeness but my concern there is that the magistrate may say 'if you were not drunk why do it'. So should I mention this or not ? catch 22 as far as I see it. and as I am asking for the case to be dealt with in my absence and I just say 'moment of madness I couldnt hold on' how likely is it the magistrate will say 'I need to clarify with this man' , adjourn and get me into the courtroom'? Hope you are still online as sending off my paperwork this morning
