  1. Well just to update everyone on my case. on the 5th of jan "oliver" promised to order me the correct corner section and that it would take no longer than 12 weeks to arrive. We accepted this but suprise suprise the 12 weeks come nd the corner section was not delivered. following advice from my credit card company we wrote a letter to the shop asking them to come and collect thier sofa and refund us as they had broken their side of the contract. "yes sofa " failed to reply to this so now my credit card company has given us a full refund!! Im over the moon , its took ages but we have stuck trhough it. Please please keep chasing this company, they are nothing but a bunch of crooks, if you do buy a sofa from this shop then make sure you pay by credit card as you will be covered then. The shop still has not collected the sofa......................
  2. Levigem, have you contacted trading standards direct? if not I have the email address of a person at worcester trading standards who is looking into this company. P.s I think I know who you are by the way. Am I right in thinking you overheard my talking to a friend about the problems im having with yes sofa at a certain school christmas play??
  3. jonno100 ...... Ive been advised by my solicitor to not say any more as i have been acused of slandering certain people and have threats of being sued!! I bet you cant guess who by???
  4. right just more of an update really and another request for advice!! i recieved a phonecall from the store manager yesterday asking me to go into the shop, i said i had no transport so couldnt so he said he would come to my house which he did he went on to explaing that the sofa manufacturer does not make a right angle corner unit and he got the catalogue out to show me all the pieces he could get. he then got out a picture of a sofa that is almost identical to mine, made by the same sofa maker but for another sofa company called csl. on this picture is a rightangle corner piece with the dimensions which match the sizes the manager wrote on my compliments slip. he then got out an email from the sofa manufacturer saying as a goodwill gestue they wil make a corner piece to match my sofa. he offered no apologies and is adamant that the sizes on my compliments slip mean nothing and i would get laughed out of court if i took it further. i asked him again why his so called manager had given me the dimension on the comp slip and he just said "i dont know" the new piece would take 12 weeks to make and he didnt give me anything in writing?? he also said that if i reject this then he is happy to go to court as he thinks he has done nothing wrong? my question is this , my wife does not want the shop to have our money any more. if we do reject it then how will this reflect on us if it went to court? also as i am pursuing this through my credit card will the affect their decision to give me a full refund?(the credit card company that is) the so called chairman of the sofa comapny who came to see me said if i keep writing posts on the ELS winding up thread then his solicictor has told him he can sue me for slander?? please advise as not sure which way to turn ?? thanks

As I type worcester trading standards have emailed me asking for more info as they seem to be under the opinion that by promising us a right angle corner unit and then not supplying one and then refusing to do anything about it , they are breaking various laws, sales of goods act and also theConsumer Protection from Unfair Trading Regulations 2008 to name just a couple. Also my credit card company have been informed and they have asked for more info which we have sent. Citizens advice have said that as we have the dimensions and sizes of each piece we ordered on the compliments slip then just because this hasnt been transferred to the order form it does not matter we still have evidence that will stand up in court which if i have no joy from the "sofa specialist" is an option i will take. why should i have to put up with being just short of £2500, have a sofa i cant use as its too big and not what we ordered and then get phone calls late at night from salesman pretending to be the chairman of the whole company trying to scare me into backing down. I dont and will persue this until i get a result. you can pass this onto the shop if you want Anthony.

I will only repeat what i put above then which is ...............Its a bit of a coincidence then isnt it !! how do you explain that "yes the sofa specialist " does not exist as a legal company and that the business registered to the same address is ELS?? you seem to know an awful lot about this anthiny. if you are the supplier then may i ask which brands you supply the shop with please.

  9. Hi Anthony, thanks for the reply. Let me put you in the picture. We bought a sofa from the sofa specialist in droitwich, the order form is headed "the sofa specialist", if they are not the same compnay as ELS then how do you explain my credit card slip from the same shop having the heading as ELS ??? if they are not the same company how come there is a PRIVATE company, same location as the sofa specialist , same telephone number as the sofa specialist, and under the name of ELS... registered to the same address as the sofa specialist on the companies house website.??? also the so called manager of the sofa specialist is a Mr Jerome Good, he is also the senior executive/proprietor of the company called ELS. He is the one who sold us our sofa at The sofa specialist in Droitwich !!! Do you care to explain that one???

Hi there thanks for the reply. so far the so called letter from thier barrister has failed to appear which im not suprised about. my credit card company have replied too asking me for more info which i have duly sent to them. trading standards seem very keen on this as they have broke laws by promisisng one thing and failing to deliver, it also appears im not the only person to be ripped off by this company. do you think it would be rude of me to start charging them storage costs as the sofa is sat in my front room , still packed up. we have had to cancle christmas lunch at our as we have no where for guests to sit !!
  11. oh and dont be fobbd off with the made to order line as most of the stuff comes from hong kong and not italy where they make out to come from.
  12. i dont suppose you know which person you spoke to in the shop ?? was it the older guy with the pony tail?? if so i dont suppose you got his name, as when i went in to complain he made out he was just a salesman, then one night he phoned us at 7 o clock at night and started to make out he was the chairman of the whole company and he had 22 other shops....... still would nt give me his name though.

Unfortunately, Exclusive Leather Sofas went into adminstration 27/07/10 and the hearing was 20/09/10. If you have paid by credit card then your best chances of recovering your money is by writing to your credit card company. You can aslo write to the Insolvency practitioner- Mr A Appleyard RSM Tenon Recovery 6th Floor Salisbury House 31 Finsbury Circus London EC2M 5SQ. Unfortunately, there is nothing Trading standards can do to help in these circumstances.   18. hi thanks for the reply, harsh but true i guess. anyway i have done as suggested on here and sent letters to both the company and also my credit card company. this was over a week ago, heard nothing from credit card company yet, but the phone call i got off the shop is there way of saying they are not willing to move on this. consumer direct have now passed this onto our local trading standards ofice who i should here off within the next 3 days. i have started to gather some info on how to use money claim online. i am not going to be pushed around by this company. thanks
  19. hi thanks for the reply. we worte to them last we and sent the letter via recorded delivery. this is the reason the so called chairman of the sofa specialiast called us last night . ive contacted consumer direct again today to expain what has happended and they are now passing it onto the local trading standards office. i should here from them in the next 3 working days. she also said that i will probably need to take them to the small claims court.
  20. thanks very much for the link. i have had a long look at that and it does seem to me that they are breaking one of the parts of it by misleading me about the goods. we paid part of the cost on our credit card and the rest by cash. i have sent a letter to my card company holding them in joint liability under the consumer credit act, so far they have not replied, however the so called chairman of ths sofa company last night told me on the phone that he had sent a copy of the invoice to the card company already???? bit strange that they havent contqced me first thoigh dont you think?
  21. thanks for the reply. we sent a letter doing that a week ago and the manger phoned last night to basically try to scare us into not pursuing this any further. he said that as the dimensions are on the compliments slip and not the order they do not have anything to do with the order??
  22. sorry about the double post im just really frustrated by the whole incident. the sofa is taking up so much room in the front room and we cant put the xmas decs up for the kids and things are geting a little bit stressful between me and the wife. i have had a reply from the so called manger, here is what i put on the other thread.............. i have just had a heated phone conversation with the sales man who was quite rude to us when we went into to complain about the sofa being wrong. he is now saying that he is in overall charge of the company and that the person we had liusted as the md is not. why couldnt he of said that at the time instead of saying he would have to get in touch with the so called md?? he is also saying that the headed compliments slip will get laughed out of court and that i have signed a legal binding contract (the order form ) which says we wanted to order 1x corner unit and that is what he has delivered. how do you think this would stand up in court?? i have a headed compliments slip with the dimensions of the sofa we were led to believe the company were going to order for us, its in the same handwriting as the actual order as it was done by the same person(the shop manger)and it was ordered from them in good faith and trust that they could supply what we wanted. they havent. they have then failed to supply us the correct sofa and are now back tracking. also he has literally got off the phone to us now at 19.30 at night?? isnt that a bit strange? he also had his phone on loudspeaker and had 3 other people in his office to listen to the conversation, trying to get me all tied up, surely this is entrapment?? i really do appreciate all the help i can get.
  23. the sofa was £2300 . i paid 900 on credit card and the rest cash. i have sent my cc company a letter holding them in joint liability.
  24. what is my next step then as in the phone conversation we just had he was adamant he is not going to refund me or replace the goods. he also said that he is getting the company barrister to write me a recorded letter and it will go out on monday?? can i take this as his acknowledgement of my letter i sent to reject the goods under the sales of gooods act? is my next step a solicitor? help!!!!!!!!
