  1. Hi Elpulpo Sadly i think youre right. i am so damn angry. Ive worked for the same agency for years and they have been briliant - guess i forgot what slimey underhand b******s they can be. He did admit he thought it was lettings, but this was over the phone, and yes i doubt he will admit it over email. Im going to ring them tomorrow and see what can be done, on the plus side the new temp job (that i dont want) really liked me and as im now trained and they have no one else to do the job - i hopefully want to renegotiate some terms and get them to employ me through my old employment agency - I'm not letting the new employment agency profit from this. I work as a temp already - when the agency told me they had a job in the area i had SPECIFICALLY asked them to find for me and I would be started next Wednesday I had no choice to resign or else i wouldnt have got the new lettings job, the agency did send confirmation of who to report to, address etc as teh next day i was going for training. To start one job you have to resign from the old one - they gave me the WRONG INFO and the onus is on them not on me fortrusting their misinformation.
  3. Hi Thanks for the quick response. This debt is nearly 6 years old. I didn't keep all my mail from DCAs back then so unsure when it was defaulted. I thought the SB clock starts from the date of the last missed payment and not the default date? Cheers SY
  4. Hi Received a couple of letters from an old bank loan via DCAs, both letters had very different amounts on, I can only therefore assume the other is for an overdraft I genuinely cant remember. Can overdrafts become SB also. I'm a lttle confused! Thanks SY
  5. Thanks for you replies. Just another quick one, a few years ago the slc caught up with me via telephone and rung me at work! I did not enter in to a conversation with him - he kept asking questions and I responded that I wouldn't comment unless he told me slc had received my last deferrment. He wouldn't tell me (as I knew they hadn't) so I told him to never ring me at work again. He then said something like 'we'll get you eventually' and slammed the phone down. I was under the impression that this is NOT acknowledgment - but after reading some posts I don't know whether that was?!!? Please help Thanks SY

  8. Thanks for the responses - so to clarify if I deferred in Feb 2002 the SB clock starts ticking from from Feb 2002 in no more contact is made? It's just I'm concerned that this acknowledgment may be valid for one year as deferrment covers one year, so they could theoretically start the clock from Feb 03?? Thanks Sy
  9. Hi all Just wondering when the clock starts ticking for potentional SB re student loans. For example if you deferred Feb 2003 would the SB clock start from Feb 2003 as that's the last time you had made contact and confirmed the debt - or would the SB clock start from Feb 2004 as the deferrment lasts one year until you have to acknowledge the debt again??   10. Thanks everyone for your quick responses! The 10k has been sold on more times I'm confused with the amount of DCA I've dealt with re this particular debt...or not dealt with! I just thought as it's been sold on for less and less money that's why they've asked for lower sum I can't find the letter at the moment to let you know if the 1200 is for a limited time only. Is this a ploy for me to admit to the debt and then they'll crank it up and add on interest etc? I'm just so paranoid of making a false move right now as I'm so close to the finishing line. If for some reason they are able to CCJ me will it be for the full amount or the 1200? Can they CCJ for part of the debt? If they are able to CCJ me will I have the opportunity to CCA them so I can see if I can trip them up on anything else?? Or would it be too late in the eyes of the judge? So, just to reiterate (as i'm tired and confused) This debt couldn't get to the CCJ stage if they can't produce an original signed agreement?? But if it does I can still fight it by getting a CCA and checking the fine details of the contract? One more thing, if I check my credit file will they be able to see that on one of their searches?   11. Hi all My debts should be SB in November of this year. After reading some posts on here I fear I'm in the CCJ danger zone - I have had previous letters threatening CCJs in the past but sure non have issued any - I haven't checked my credit for file for fear of them seeing I've checked my credit file on a DCA search (can they see that?) Anyway, I'm worried that I will be issued a CCJ soon - so I want to know my options so I can gain some control. Please help as I don't know too much about all this. Firstly, the main DCA is asking for 1200 reduced from the full amount of 10,000 pounds. If they CCJ'd me are they allowed to ask for the full 10,000 pounds??? As the whole amount isn't technically their debt to claim. Secondly, can I dispute the CCJ then ask for a CCA from the DCA in question or would I have missed the boat to do this at this point? I wonder if I should time a CCA wisely with said DCA so I can buy some time and hopefully avoid a CCJ, or at the very least pay the 1000 opposed to the full 10000 via the courts.   13. Hi thanks for your response however I still require advice. I am not SB until the end of this year therefore the DCA still see me as fair game and are entitled to try and get their money. I'm not worried about the default on my file I'm worried that applying for car insurance will show on my file and the DCA will have proof of my address and track me down. I have been keeping a low profile but need a car for my career. My question is when I appy for insurance will this application for car insurance show on my credit file as they all do credit checks now??? And secondly, if it does show will the Debt Collection Agency be able to see it??? If they can see it, won't this confirm my address when they do one of their traces???? I'm unsure how Experian and the likes work, and I don't know if a DCA trace will show an car insurance check - I don't want to jeopardise my low profile as only have 9 months of hiding before my debt is untouchable by the DCAs. I don't want to give them proof of my whereabouts so they can CCJ me or send the bailiffs round or take my car. Has anyone had a similar experience or could offer advice re the system of car insurance and trace searches? How do people get to SB if they leave proof of their residency all over the place with insurance and other credit checks? Thanks for your help Sy
  14. Hi all I have quite a bit of debt which I have pretended didn't exist due to a series of unhappy events and depression. I have laid low over the past 4 years in terms of not applying for credit, insurance, not on the electoral role etc and my debt should be SB in November of this year - so I'm praying for this time so I can start my life again. I have a bit of a problem as I need a car for work (paid by cash), and I'm worried about getting insurance as they credit search?!? I understnd the DCAs search credit files on a regular basis to trace debtors?! I'm worried they will see that I'm still at the original address and know for sure I still live there. Will the insurance search show on my file for the DCAs to see? Even if they do see I still live at the the original address, unless I own up to the debt what else can they do? Would they cross check with the DVLA and see a car registered in my name and try to obtain it? My main worry is from a loan that has been sold on more times the last letter was asking 7,000 pounds less then the original debt and in their recent fishing letter they threatened to keep putting defaults on my files - so I know they're actively hunting me down. I'm so close to being SB I don't want to ruin it by putting a great big marker on my credit file for all my creditors to see and close in on me. HELP!!! As I really do need a car to get on with my career - any advise would be gratefully received! Can i get someone else to insure the car and put my name on as an extra driver? I'm so confused and unhappy as I really want to get on with my life and stop hiding SY

I'm coming up to the 6 year non-payment (non deferment of student loans) I forgot to defer initially due to seriously bad times I was going through - debt was at the bottom of a very dark pile of worries and depression - and things snowballed out of control from this point - (if I had have applied to defer I would have been elgible). The student loans were Pre 98, old mortgage style so can be statute barred. However, about 2/3 years ago they managed to track me down at work and telephoned my office. I was obviously caught off-guard and told them never to ring me at my place of work again (is this legal for them to do so?). I also panicked and fudged a diversion conversation with the student loans woman (mainly due to the fact I was so embarrassed as co-wrkers were earwigging in to conversation) by asking her whether the loans company had received my deferment to cover that year, she would not answer me (we both know she didn't). So I told her I would not answer anything she asks until she tells me if they have received my deferment. As she was unwilling to be above board with me, the conversation concluded with her threatening me by saying "we'll catch you eventually" and she slammed the phone down. Just wanted to know if this is proof I own the debt/acknowledged the debt and will this start the clock again or do they need acknowledgment of the debt in writing? Thanks in advance S
