  5. That has gone straight over my head, I dont understand it all to be fair, this is my aunts debt which i have been trying to help her with she has less clue than me,i just thought(well was told) that doing a defence would not go any further with the court ..
  6. yes that's correct and no no new agreement was ever signed when i requested a CCA they sent back a store card application

Hi thank you Andy post #158 i have copied it here also In the Northampton (CCBC) county court issue date 08 Dec 2013 Particulars of claim 1 The claimant's claim is for the sum of £11122.74 being monies due from the defendant to the claimant under a regulated agreement between the defendant and Marks and Spencer Financial Services PLC and assigned to the claiment on 20/2/13,notice of which has been provided to the defendant. 2 The defendant has failed to make payment in accordance with the terms of the agreement and a default notice has been served pursuant to the consumer credit act 1974. 3 The claimant claims the sum of £11122.74 4 C has complied,as far as is necessary,with the pre-action conduct practice direction.   8. Here is what ive written out im not very good with things like this but is this ok to use thank you This is my defence against arrow global limited over M&S store card. In October 2001 i was in my local Marks and Spencer's store when i picked up an application form offering a Marks and Spencer Chargecard or Budgetcard,i filled it out at home and posted it to Mark and Spenser's financial services.My application was successful and i received the store card.Sometime after this my store card was upgraded to a credit card (which i did not sign an agreement for ) - i continued paying the amount owned on this until i ran into financial difficulties.On 25-04-2011 i was issued a default notice from M&S however this is defective as they have failed to specify an actual date DD/MM/YY. The CCA request i sent to M&S came back to me primarily as an application form for Marks and Spencer Chargecard or budgetcard and further fails in it's compliance to s60(1) of the CCA act 1974. It contains no prescribed terms to represent the credit card also the terms and conditions are not part of the signed document,they don't fit onto it because what i signed had to be posted back-if you look along the bottom it says "moisten and seal" then the two edges folded over.
