  1. Hi, I have just posted a similar thread after receiving the first letter from Apex after I requested CCA from them/Egg. I then found this thread, doh! Anyway - is there any developments on your battle with them?? Thanks M
  2. Following advice from here, I sent CCA request to Apex Credit Management who bought by CC debt from Egg over a year ago - up until recently I was just paying them without question. They replied to my CCa request as follows (sorry cant scan letter on): "We confirm we have referred this account to Egg for them to provide a copy of your agreemtn under CCA 1974, to enable us to deal with your queries" "We have placed your account on hold and you will not receive any further contact from us until we have the received documents from EGG" "We will continue to chase Egg, but would like to manage your expectations by explaining that we are limited on the number of requests we are able to send". My question is - what do I do next - it seems to me that they dont have copy of CCA and unlikley to get it. Are they saying I should stop paying them until they respond further or that I should continue paying them and they just wont give me updates until the CCA is received from Egg?? Should I just issue the next account in default letter advising I will not be paying, they responded to my CCA request in 3 days so they do still have time within the 12 +2 days situation. Should I wait till then and then send the 2nd letter?? Thanks for any pointers/assistance M

  7. Today I have returned home to find my CCA request returned with Postal order on basis I didnt sign the request - sounds like rubbish to me? How do I respond? Does this return buy them time or does that 12 days + 2 still apply - I am approx half way through that period now but worried IncaSSO MAY CCJ me at end of month!! PLEASE SOMEONE reply soon!

I have read your post with interest, I am a newbie to this site and your position is also very similar to mine, in 2006 I wrote to all my creditors advising I couldnt meet min payments - I had 4 cards and 2 loans. I started paying lower just about affordable amounts back and all has been fine for 4 years - I had to increase year on year and complain about a couple of them (CO Op) for one but basically all interest was frozen so debt are reducing month by month - it will take 10 years. Recently my Tesco loan has got worse - they passed to solicitors and thretening CCJ - I cant afford anymore so checking these sights I have have CCA requested them to see what they CAN actually do. Basically you are not on your own and I have felt a lot of support from these threads and replies to my own posts. Get a budget sheet down and offer pro rata amounts based on actual affordability - but certainly CCA them all first - I wish I done that first of all but maybe the money I paid might stand me in good stead when I start to push for reductions/write offs etc! Keep the faith - you are not alone!
  9. I have posted this on another thread as it relates to issues I am having with Incasso, but not sure that wil get as much of a response. Sorry I am new at all of this. I found my original (in a man draw) Customer Credit Agreement which I have asked Incasso for. Can someone have a look at it and see if its enforceable. It is not dated but I took out loan in 2003 time. How do I find out if I actually asked for PPI cover?? If any details missing that you need, please ask I can supply. Thanks M Tesco CCA.pdf
  10. Here is a copy of my CCA agreement that I found in my draw and which I have requested a copy from Tesco for. Can someone have a look at it and see what they think, is it enforceable? I have deleted all figures etc but supply those if needed. It dates from 2003 if that helps, although it has no date on the actual document. Any other info needed please ask me.   11. Thanks, is there a way of checking if they did this without my request? Or shall I just state they did (99% sure on most cases they did) as they wouldnt be able to prove it was me that requested it in the first place! Anyone have any letters on how I should set this out??
  12. I dont think I have any PPI on the credit cards, I do on my loans. I currently have agreed repayments in place and all interest has been frozen. To be fair to them they have been quite reasonable I was just wondering if I have any recourse against them for increasing my credit when I didnt ask them too. Egg has since sent my debt to Apex and I am paying them back now - once I have CCA back I will review if they can actually enforce. But from other threads I have read it seems if they have increased by credit level without asking then I can feasible ask for this to be refunded plus interest if so I could considerably reduce my overall debt which is what I am trying to do for all my Credit Card/Loan debts.   13. Newbie here again. Reading various threads, I have sooo many questions. It seems that I may have some rights against my Credit Card companies for increasing my Credit without me actually asking for it. I have Egg C/Card, Co Op and Natwest Cards from 2000 onwards, when I started heavy use in 2002 they started to increase by Credit - seems as one done it the others followed, thus contributing to my debt problems. Ok maybe I shouldnt of spent it - thats another story. Anyway - I am asking for my CCA's from them but just need to understand a bit more about the above. Sorry if this is posted on wrong Thread forum. Appreciate your help/comments
  14. Received letter from Incasso acknowled my CCA request but still not accepted my offer - I am worried they will just simply send a CCJ request which from previous letter MAY be at the end of this month - should I just sit tight?
  15. Thanks for the advise, I will deffo do that with the CCA's Any advise on which DMP companies are the best to approach, what are the benefits? I do tend to have to write to all 6 creditors every 6 months although Co Op agreed 12 months.

Here is some further info I have the following Loans/Credit card debts - I wrote to them all back in 2006 and they all agreed my Budget plan except Tesco after a while decided to pass to Triton who decided they wanted more and passed to Incasso - I have CCA them. All my interest on Credit cards frozen but with the loans I think I am paying back the whole debt including Interest (Egg Loan/Tesco Loan both include PPI) Natwest overdraft I just pay interest - I would lose my joint account and mortgage all with NW if I go down the full cant pay route - this is manageable (just) Egg Loan taken out 2005 Egg Credit card - Taken out 2002 - now with Apex Credit management Natwest Credit Card probably started 2001/02 Co Op credit Card - 1997 Tesco Loan - Now with Incasso 2003 Natwest Overdraft - not such an issue probably since 2000 I basically pay pro rata on the debt at approx 1% of the o/s balance each month. It is over £40k at present (not much more). I last night found my copy of the Tesco CCA form which details loan/ppi/interest - what should I be looking for on here?? What do I do if Incasso supply a copy from Tesco - I came home last night to a letter from them advising they still do not accept my offer but have requested this from Tesco. Help and Thanks!
  17. Hi New to the site. Have considerable debt over 6 creditors - been paying by own DMP for 4 years but finding it harder and harder to continue - what are chances of reducing/writing off debt? Been advised to CCA them all and if they dont reply etc then stop paying - worried about CCJ's - Incasso already threatening me they will do this if I dont increase payments by £70 a month - NO way can I afford that. Any links/idea/letters would be greatly received. Have PPI on one Egg Loan - I think I agreed to that at time I applied on line but surely if I am in default I should still have to pay that back. Tesco Loan wants me to pay back the loan plus interest - can I get them to consider paying back just the loan figure? If so it would drop debt by £5k Help and thanks
  18. DX - your a star! I am just very very nervous about all of this - if I CCA them and get no reply and stop paying I might end up in the S**T!! I guess from reading some of the links that wont happen - but I guess its the old story of a big company jumping all over the little man!
  19. Yeah I have been reading about that - I guess if I CCA them and prove its unenforcebale then I could negotiate a reduced amount to pay back? Does anyone know if I can agree to pay back a lower figure but do it over a period of time rather then a one off payment - I have no access to large sums of cash so even if they said pay back £10k I couldnt do it in one hit but could over 2 years. I dont know much about unlawful fees or mis sold PPI - is there any links to that? Are there any links to success stories of reduced/written off debts - just so I can get some ideas on how to go about it?

DX, Many thanks that is so reassuring, I will CCA everyone and see what happens - I have written to a couple of them just to see if they will reduce my debt/write off - do you think they will do that out of the kindest of their hearts (if they have one) or will I have to offically do this CCA thing. One of my debts with Egg was passed to Apex Credit - they have been fine but I have since read that they probably bought by circa £6k debt for a lot less - are they 1: able to enforce this debt or 2: accept lower final settlement/write off? I have been paying them £72 a month for about a year now. I wonder if I have much chance of getting my debts written off or reduced substantially - does medical grounds count for anything anymore? I also read that approx 8% of a Loan figure is the banks liability - is there any truth in this? Finally is is best that I continue to deal with all issues myself rather then get solicitors involved or those companiesadvertising help. I am pretty clued up - ironically I am an Underwriter so know a lot about good/poor risks but not so much about the legalities in paying/not paying debts. Sorry if I am rambling - its like a release of pressure, knowing there are people out there who understand!
  21. Hi I am a newbie to this site and read as much as I canover last few weeks. I am in quite a bit of debt (£40k+) spread over 6 creditors - since 2006 I have had a my own DMP in place paying pro rata to all of them approx 1% of the o/s debt - so quite reasonable. Problem I have is with a Tesco Loan that went to Triton Credit and now with Incasso - they basically want me to pay an increased figure to clear the debt in 5 years - presently it will take me about 8-9 years. If I dont agree they MAY take legal action - I have written to them advising I cant pay more - I owe more to one other creditor and they are being unreasonable - NO RESPONSE to my letters. I have sent them last week a CCA request - will this help? I am worried about being taken to court and getting a CCJ - I am trying to pay back my debts but its getting really difficult - I have read about Unenforecable Debts if CCA cant be supplied - all mine were taken out prior to 2006 so do I have a case? - sorry maybe more then one thread here. Ultimately I have been paying over £4k a year since 2006 to my creditors plus what I paid when I paid in full and would ideally like to not pay anymore as my mental health/family life is rubbish at the moment! Help and advise please - seems there is plenty of it around and its very reassuring!
