  1. Thanks for the reply Lea. Husband has booked a day off work to be there to meet the bailiffs tomorrow. House has been nothing more than a noose round out necks so will be glad to hand it over to them. Keeping fingers crossed that they do not feel the need to board up the property as it has been vacant since may with no problems. Should I mention that to them? I am so nervous and scared of what to expect.
  2. Hi, We are in the process of having our home repossessed by northern rock and I am looking for a bit of advice and hopefully reassurance. We are waiting to file for bankruptcy on the advice of our CAB advisor however we are struggling to get the fee together. We have managed to save £1000 but have the rest of the money to save for. We were going to voluntarily surrender our house to NR however they got there first and started court proceedings. Hubby & I have totally buried our heads in the sand and it is now at the point that we have been given an eviction date of Tuesday 6th December. It will not affect us because we have moved out and secured a rented accommodation so we are happy for NR to take the house. Our biggest concern is what will happen on Tuesday-should we return to the property and physically hand the keys to the bailiffs ? How do they gain entry? The village we lived in is an incredibly tiny one and everybody knows everybody else's business- there are also members of extended family there who do not know our situation and we would prefer to keep it all as low key as possible: we are both suffering from chronic depression and do not need to be the figure of gossip and ridicule. I am having nightmares wondering will it be obvious what is going on if bailiffs/police turn up and smash windows /doors to obtain entry. Does anybody have any experience of what will happen? All advice greatly appreciated
  3. The reason I went down the CCA route was they have been nothing but hassle. I am out of work so we are living on one wage and bringing up a baby. The CAB were involved and worked out our incoming/outgoings and drew up our SOA which was posted to all debtors with the amount we can afford to pay. Fashion world refused point blank to accept the payment until our situation improved. We wrote to them and explained they were one of the only debtors to refuse and would they rethink it - no. They wouldnt accept anything lower than the full payments!! They sent a letter to CAB saying it was because the last order I placed was delivered to me 1 month before I sought advice from CAB - therefore I placed an order knowing full well I was going to be in financial difficulty and wouldnt be able to pay, so apparantly they are well within their rights to demand full payments. The interest and constant charges are increasing my balance to ridiculous levels and they are constantly harrassing me - up to 10 phonecalls in a day, 7 days a week, letters every other day, despite me sending a letter asking them to stop. They claim if my account is in arrears they are within their rights to call me up to every hour should they need to. I don't dispute the debt, I just want to make the payments I can afford until things improve and not be crippled by their charges and interest.
  4. Hi all, I recently cca'ed Fashion world on 5th August 2010. I received a reply from them dated 17th August. I do not have access to a scanner right now, mine has just broken but here is what their letter says: Now, the agreements they have sent me have my details filled in, in biro and is not my handwriting, nor is my signature on them. This is what I expected as i have never received, nor signed an agreement with fashion world. What worries me is the last paragraph they wrote - are they lying or not?:? Where do i go now?-?
  5. Brilliant, thanks so much for your help. I will be sending my CCA letters tomorrow, in the meantime, what do I do about the CAB lady's advice? She wants a decision from us on monday as to whether we will be proceeding with her plan for repayments ?
  6. £10 for each subject access request - ouch may have to put this one on hold for now, or do 1 per month.
  7. Thanks for that just sorting out my CCA's as we speak. I know my husbands loan has PPI which we have only just found out about, and both of us have hundreds upon hundreds of pounds of charges. Do i wait until I have dealt with the CCA's before tackling the charges?
  8. All other debts are just with internal debt collection teams - halifax is retail collections dept. Sorry to sound ignorant, but what is a CCA and how do i go about it? tried to search forums ad it brought up so many results, cant find where to begin!
  9. Thanks for your speedy reply. I'm pretty certain almost all of the debts are recent, within the last 5 years or so. We have missed 3-4 months payments on all; do you need individual creditors and the amount missed? Sorry if my answers are a bit vague.
  10. Hi all, okay, where to begin. I am looking for advice on my current situation, which is at present being dealt with by my local CAB. They aren't really getting the ball rolling as quickly as we had hoped and we are still left with so many unanswered questions. Here is an overview of our situation at present (i'll try and keep it as brief as possible) We are a married couple with one son, who will soon be turning 1. I was diagnosed with severe PND and as such, have not returned to work after my maternity leave. I am in receipt of statutory sick pay, tax credits and child ben on top of my partners full time income. This is how we have reached the point where our debts are killing us and we can just no longer afford the repayments. The money adviser at the CAB has collated all of our debts and contacted all debtors to inform them that she is dealing with our case and that we will be sending a financial summary (once completed) Our monthly income comes to £1574.02 and expenditure is £1473.44 - leaving an amount of £100.58 available to pay our debts (all unsecured) Our outgoings actually exceed our incoming at the moment, but luckily we have fantastic parents who have taken on a few of our essentials (car insurance etc) freeing up the £100.58 for debtors. We are £26606.80 in debt in total. I am finding although the CAB are dealing with this, and the credit companies are aware - i am still receiving threatening letters and phonecalls daily. The two worst culprits are reliable collections ltd (fashion world catalogue) and halifax (BOS) I am currently in floods of tears and terrified as I have just received a payslip style docket (tear off sides to open) from BOS simply stating they are sending a representative round to my home on 12th July 2010 - and a number to call if 'not convenient' They do not state a reference number (i have 3 debts with Halifax - overdraft, one personal cc and one joint cc) and the docket is addressed in my maiden name (all debts are in married name - been married 2 years in Sept) As i am suffering with depression I am terrified to answer the door/telephone as it is - I just dont know what to do. My husband contacted the lady at CAB who just said to ignore it or tell them to leave my property when they arrive. I am scared stupid...I will be home alone with my baby and this is just adding to my depression. Anyhow, my question really is - is there anyway to deal with this in a more proactive way? Every time we have questions to ask the lady at CAB, she is never available to take calls etc. We do not know if she has requested that interest be frozen on our accounts and charges stopped (i am receiving letters stating they are still being applied) If we enter into the agreement she has set up for us, there are some debtors receiving only 54p and 99p a month - if they keep adding interest and charges, the balance is just going to increase and we're worse off, surely? We own our own home (mortgaged) but are in negative equity by about £20k. She advised us against bankruptcy as we will lose our family home and also cost us £1200 which we have no way of paying. She also informed us at our last meeting that our creditors do not have to agree to our proposed arrangement and can still pursue us with CCJ's - this is something else that terrifies me. I am in no fit state to go to court or have this over my head. What can we do...and how do we go about it? Thanking you all from the bottom of my heart in advance
