  1. Hi CAG Forum I have just noticed this post whilst looking up information to challenge Barclays. I have received a letter stating that they cannot locate a policy in my name. At the same time I am also looking to challenge their previous letters (from some years ago) that my data is held on a microfiche and cannot be easily acceptable. Any help with either of these problems would be a real bonus. Successfully claimed from Santander and MBNA. Thanks Homerisright
  2. Thanks for your feedback. I did not send the notice by registered post, nor did I call to check on receipt. Hindsight is a great tool isn't it. I was hoping that someone could point out that if they have a clause in the contract which says that any notice they send is deemed received on the day after posting that the same clause would apply to my rights? A bit of a long shot, I know. Also, as I signed as a fully involved Director, the fact that I resigned some twelve months before the company went into receivership then I could not be liable for the actions of the Directors of the Company since resignation. I had seen some information on IBAS and so I will go back there and read more, thanks for the link.
  3. Hi All Some years ago I was a company director and signed up for a joint personal guarantee with the other directors. I then resigned my position, withdrew my support of the agreement by letter to the bank and the managing director and left the company. The withdrawal of the support was given under section 3.1 and 3.2 of the attached document, which, if I am reading it correctly, says that I can release myself by giving them one months notice. I would welcome any insight into this clause. Some twelve months later the company went into administration (or liquidation?). The bank advised me then that I was liable but after sending them copy documents in 2008 I thought the matter finished. I have (stupidly?) written all my letters and responses and not bothered to ring anyone and so have no proof of receipt. Natwest Bank has now approached me to say that following the liquidation of the company I am liable for £ 47,000.00. They would like my proposal to repay the debt within 14 days. As you can imagine I have had a couple of sleepless nights already - I am not able to claim legal aid and I cannot afford the £ 180.00 per hour that local solicitors are charging.
