Hi , well after winning my set aside in August 2010, Capquest are now bombarding me with phone calls which I am ignoring! What do they want? Can they restart the progress? At my set aside they had faxed a letter through saying it couldnt be staute barred as i had paid 800 pounds a few years back, I am positive i didnt as dont have that kind of money lying around!! Advise needed please, thanks

Lets see what Monday brings - I now have direct line to their legal team saved on my phone so I can ring them if now news!!!

ok heres the tale from them as they have rung me back!! the woman who deals with this is on hols and they canr find the director to sign the cheque but as soon as it is signed they will post and are ringing as soon as its posted!!! were extremely apologetic and nice on the phone!!!

As soom as I have received my costs that is on the very top of my list as with out the help of this site I would have got no where!!! just waiting to see what their excuse is for for not paying on time!!

well - just got through to their legal team who are going to ring me back as have it raised on their sytem but dont know what is happenning!!!! fingers crossed!

it states on the letter that they have until 4 pm today the 6th Auguste to pay so unless it is being couriered I will not get it today - how often do they not pay and have to have the costs collected through enforcement? Really thought by today it would be an end to it! x

hi yes I received my letter from the court last week so assume Capquest would have received theirs on the same day?

does any one have an alternative number for capquest accounts/legal? any advice? thank you x

have just rung the court for advise and they didnt check if it was there just said they would send me a pack with info on enforcement. Have tried ringing the number for the legal department but just get voicemail?

Hi well I went to court 2 weeks ago - had missed a recorded delivery letter that morning and got to court to find it was from capquest stating they would set aside if no costs were awarded and that I had made a payment 5 years ago of which i have no knowledge and waiting fro proof of! they didnt show at court and the judge was lovely and awarded costs which are supposed to arrive by 4 today! what do I do if they dont send the costs? Do Iring them or go back to the court.Also what should i do if they do not send proof of payment from 5 years ago? Now it is set aside does that mean they will leave me alone? Many thanks and as soon as I get costs I will be making a donation to this site as you have all been amazing with your help x

Hi I attended court today - missed the post and a recorded delivery letter which I later found out at court was from Capquest!! They stated in letter - sent via fax as they didnt show up that,they had not had sufficient time to obtain information from the originator to prepare in order to serve evidence in opposition to the set aside. they claim they can confirm however that the originator claims to have confirmed that I paid a sum of 899 oin august 2005 which means that the debt is not statute barred. They do not accept that the the debt is not due however in view of the time consideration and use of the courts time they ask that the application be granted but with no order as to costs. If as they anticipate they subsequently obtain information which enables them to prove the debt is due we will proceed by issuing a county court claim which will allow the applicant the opportunity to defend the claim.' I was awarded costs and have no recollection of paying such a vast amnount and as the debrt was originaly only 1500 that i remember then surely that would have almost paid it off ??? The case was set aside I just wondered where I go now? Should I write to Capquest and ask for proof of payment? Also as I married in 2003 and they are still iusing my maiden name surely any payment I made would have been in my married name so they would have been aware of name change? Please can some one advise if they are using scare tactics or will they just drop it now? As soon as I have my costs I will be donating money to this site as without it I would have got no where and really appreciate every ones help x

well I am back , got the case saet aside but they - Capquest- faxed the court that I had made a payment in 2008 for 900 which I am pretty sure I didnt!! the judge awarded me some costs even though they requested not too, now to write to them recorded delivery to get proof of siad payment. Thanks for all the advice
