  1. I have had a couple of responses from credit card companies who are only willing to refund partial amounts of the charges. They are saying they only have to pay the difference, and 12 pounds of the charges is still applicable. Reading around the forum I can see I am not the only one to get this response. Can anyone please give me some advice on how to respond to these muppets? Any decent response letters out there? Many thanks in advance kx

  3. Thanks Slick. A few years ago I became disabled and both my partner and I have had to stop work as we also have 2 small children. We have been making token payments for some time now but they just keep adding a huge amount of interest and charges and the outstanding balance just keeps going up and up. Was originally 3,500 and now nearly 7,000. I think I will stop payments and send them a letter advising they haven't issued a valid CCA agreement, it can not be enforced in a court of law, and until they produce a valid CCA agreement we will be making no further payments. Do you think that will be ok? I haven't gone this far with any of the other creditors. Those that can not produce a CCA have just said they will put our accounts on hold and stop further payment collections. kx

  5. Thanks for the advice - been looking around the forum but still not sure what to respond with to HFO? If a DCA haven't sent a valid CCA is their a procedure out there to stop them from pursuing the debt? Just a bit lost.
  6. My partner and I are claiming back PPI on credit cards and charges, the only problem is that a couple of the accounts we are claiming back from have been sold to DCAs. I know from previous advice that I am still able to claim but my questions are? 1) Some of the accounts were are trying to claim back from we in the process of proving them unenforceable - 2 have even stopped collections of the debt - is this still an issue when trying to claim? or will it cause problems with our claims. The issue of enforceability is with the DCA and we are claiming back from the original creditors? 2) Can the original creditor pass the money we have claimed back and give it to the DCA to clear part of the outstanding balance? I have read somewhere on the forum that they can't. For example Barclaycard have offered to pay back the charges but are advising HFO to take it off the outstanding balance. All help appreciated as always kx
  7. Got CCA response today from HFO (DCA)........... The muppets have only been able to provide us with a copy of an application form and a photocopy of their terms and conditions. No valid CCA. Can anyone advise us where we go next???? Many thanks kx
  8. I have 3 different DCA who have not responded to my CCA request. I have then followed the timescales and sent account in dispute letters. They are now over the 14 days to respond to my request - Any ideas as to where I go from here? Many thanks kx

  12. Ha - dx my hero - I was doing it right then. Not so dizzy after all! Does it make a difference if the credit card was never paid off and is with a DCA?   13. DJ I am obviously doing something wrong! I am using the compound calculator Compound interest calculator I have put 14.99 in the amount 16.9% in the interest rate 15/3/01 as the start date and todays date as the end I was doing it monthly as advised by middenmess in previous post but have tired it as annually but still coming up with 14.99 @ 16.9% as £49.589 interest accrued totaling £64.58. I am really loosing my tether - can I ask how you are working the calculations?
  14. Thank you to anyone who has the patience to help me with this..... I have numerous credit card companies that I am claiming back PPI insurance for both my partner and I. I am worried I have got the calculations wrong. On the notes for the compound interest calculator it advises you to add interest at their interest rate say 16.9%, from the date you were charged up to todays date. Then add 8% statutory interest. If the credit card account has ended then can you only add their interest rate for the time of the agreement? I have been adding their interest rate and the 8% from the time of the charge up to todays date - for example 15/03/2001 - £14.99 + 16.9% + 8% = £76.20 I selected the compounded monthly on the drop down box. Is this right? Thank you for your patience! kx:-?
  15. Sorry middenmess - bit of a novice still AFAIK? and 12 rests - the compound calculator above gives you 4 options 1 - compounded annually 2 - compounded bi-annually 4 - compounded quarterly 12 - compounded monthly I am assuming I use 1 - compounded annually Thanks for your help kx

Could someone also just confirm this for me please - Compound interest calculator When using the above calculator to calculate interest on a monthly PPI fee (for credit cards), it asks you to enter the interest rate. Do you enter the monthly interest rate or the annual interest rate? Sorry if this seems a really basic question but I am having a mental block. Thanks kx
  18. Hi guys, I was miss-sold PPI on a loan with the Halifax. I took the loan out on the 20/7/99 for £3000. The total amount I paid on the insurance was £294.94 - the loan was to be paid back over 1 year. I was charged at 17.9% APR. Before I send my demand for PPI reclaim could someone please please please check my figures. I have done numerous reclaims for month;y paid premiums but this is my first for single. My calculations are as follow - £294.94 + 17.9% + 8% (statutory) = £3484.72 Is this right? It seems an awful lot? Many thanks in advance kx
  19. Hi Slick - I had a credit limit of £300 - I didn''t go over this but when pased over to DCA they had added charges of nearly £450 before it went over to them. I just don't have the exact figures and dates. Is there a example letter about I can use on the forum? Thanks for your help as always

  22. Ok - will do - but what happens if they don't have any of the transaction details as their letter stated? I may just get the same response and I will be no further. They have already said they don't have details of the default charges. What can I threaten them with? Thanks as always! I sent a CCA request on a old Barclaycard, the request was sent to HFO as they are the debt collections agengy who now own the debt. I received some great advice about where I stand on a previous thread (Barclaycard forum) - as HFO did not send a CCA only a completed application form and a copy of their terms and conditions. I am now posting on the Debt Collection Advice forum as I really need some input into how to compose my response to HFO. To be honest I am a little nervous, even frightened about fighting the big boys - I suppose I am after a little reassurance. I know that HFO have complied with the CCA request but they do not have the correct documentation to pursue this in a court of law. Can anyone please please please give me some examples of correct response letters that may be on the forum - I have seen a few out there but not sure which to use. If I am going to fight this I am going to have to fight with confidence - just petrified I am going to look like a twit! Thank you to everyone that has offered help and advice to me (and your patience), Your help is genuinely appreciated. CAG is a godsend and another donation will be on the way soon. kx
