  2. Hi all, thanks for all the help. Am after a little bit more...... I handed in my Allocation Questionaire to the court office on 22nd December. Today I received the following from my local court:- "TAKE NOTICE that the Case Management Conference will take place on 21 March 2007 at Consett County Court When you should attend 15 MINUTES has been allowed for the Case Management Conference. Please Note: This case may be released to another Judge, possibly at a different court." Now I've done a bit of digging on the forums and this seems quite new. I have found a thread where a number of people have received one of these for another court. Has anyone else had one of these hearings (not necessarily this court) and on the off chance does anyone else have the same date for this court? As always any information much appreciated. Emble x
  3. Hi all, I'm after some advice. Received my AQ and a copy of Barclays defence. Usual sort of stuff but I did notice the following :- "In the alternative, which is denied, if the said charges amount to sums payable on breach of contract, it is averred that the charges asserted by the Claimant to have been applied to the account prior to 6th November 2000 would not be recoverable for reason of exhaustion of time in bringing contractual claims from the date of accrual, pursuant to the Limitation Act 1980." Now as I see it they are trying to say I didn't start legal proceedings until the 6th November therefore I can't claim back any earlier than 6 years before this date. HOWEVER, I made it perfectly clear in all my previous letters (including my Data Protection Act letter) that my intention was to claim these charges back and was making an effort to settle out of court (as MCOL etc advise). I seem to remember reading another thread where the same thing had happened, but for the life of me I can't find it. Any help much appreciated Emble x

  6. Received a copy of Barclays Acknowledgement of Service today. It's signed by Adrian Ruffhead and they intend to defend all of the claim. Not unexpected but quite scary when it actually happens to you. Onwards and upwards as they say
  7. Barclays have acknowledged my claim on 24/11/06. Was kind of hoping they'd forget and I could have gone for judgement today Only another 14 days to go.......

  9. Another update - received a 'gesture of goodwill' on 25th October for £100. Needless to say there haven't been any other offers so I'm going to start my claim tonight. I'm very nervous but I know its the right thing to do and it's good to know I've got so many people who've been there, supporting me. Emble
  10. Hi all Surprisingly no satisfactory response from Barclays before my deadline :rolleyes: Have posted my LBA today. I'll give them the 14 days + 2 days to allow for delivery (i'm nice like that) and if not resolved will start my claim. Oooooooh, exciting !! As a small aside I've just had a very nice chap from Barclays on the phone asking if he could go through my accounts with me. I feared the worst and braced myself for a grilling about my action but none was forthcoming. Poor chap went through my balances ('looking okay there') and then stopped when he realised all my direct debits had been stopped. When I informed him I'd switched accounts to another bank he enquired why. When I told him my new current account gave me 5% interest his words were, 'well I can't argue with that, thanks for your time goodnight' :lol: Will keep you posted, Emble x

  12. Hi Steve Having not known what sort of correspondence you've sent or received previously I'd suggest starting again using the templates from the library. Send the Data Protection Letter off and start the clock. From my experience they take the full 40 days to reply but I did receive a full breakdown of all account details for the last 6 years. Sometimes not in a very readable format but I got there !! Please don't be downheartened by having to start again, it will be worth it in the end. I thought they only owed me about £50 but turned out to be £200. Good Luck Emble x
  13. Hi all Haven't been on a while so need to bring you all up to date. Having received my statements from the last 6 years I calculated £200 in charges. I sent off my Prelim letter on 27th of September. Had a response from Martin Bennett, Customer Relations Advisor saying 'we are sorry you have had to contact us about the level of service you have received from Barclays. Thank you for taking the time and trouble to do so. We are looking into your concerns and will let you have an answer or update as quickly as possible, but no later than 25 October 2006' From looking at the other threads this seems to be the usual ploy of giving a date after the 14 day expiry. I will be sticking to MY timetable with my LBA however I just wanted a bit of reassurance that others have had the same letter and if anyone had a letter from Martin Bennett as I've searched the forums for him and found nothing Thanks in advance, Emble x

  15. Hi all, just a quick question to all you helpful dudes out there. I'm typing up my schedule of charges and from the statements Barclays have sent me I've added up £200 But, by the time Barclays actually got round to sending the statements, 2 of the charges are now out of 6 years i.e July 2000. So my question is am I allowed to claim these charges as my original request for statements was June and these charges would have been within the timescale or do I now have to accept that I've missed the boat so to speak and can only claim charges from the date of my Preliminary letter ? Any help much appreciated Emble x
  16. Hello All ! Wedding went well and I'm now a MRS More importantly, I received my statements on Monday, Day 40, and they were posted on Friday (my wedding day!) Things must be bad at Barclays as the covering letter wasn't even signed. Have worked out my charges and what I thought would be about £75.00 is actually £200.00 Am typing my letter now ......
  17. Hi, just a quickie. My Amex Card sent a letter today saying they've reduced the fee from £25.00 to £8.00 !!! Realising they CANNOT JUSTIFY THE CHARGES !!!!!

  19. Hi all, still waiting for my statements. By my reckoning they have until Saturday to reply. I've been reading through the forums about different experiences with Barclays delaying tactics and I'm wondering what the best thing to do is. Should I ring them and remind them they only have until Saturday to comply, or, just wait until the 40 days are up and send the template letter about none compliance that Bankfodder posted? Been a bit busy the past few weeks as I'm getting married on FRIDAY !!!

Letter this morning from Hannah Salmon - Senior Concerns Officer Your comments have been noted and on this occasion, I have arranged for the two late payment fees of £20.00 to be refunded to your account as a gesture of goodwill' Usual blah,blah regarding the fees being fair resonable and transparent but they caved after a preliminary letter !!! I know this was only £40 but I was quite ready to take them to court and its better off in my pocket than theirs. I'm still waiting for my Barclays Data protection response but this has given me the confidence to push through. Good Luck to everyone still fighting against NatWest WOOO HOOOOO !!!!!!!   21. Hi Hannah and WELCOME to the site !! Firstly its better to start off your own thread, makes it easier for people to follow your case and help you. Next it doesn't matter if the accounts are closed or not (probably better because they can't threaten to close your accounts and stuff). Just follow the procedures as written in the FAQ's. It's best to spend a few days reading all the FAQ's and other peoples cases. There is quite a bit to get your head round but it is definately worth the effort. Data protection, preliminary letter, letter before action etc. Regardless of the account being current or closed the process is the same. Hope this helps Emble x:)
  22. OOOhhhh, hi all, delaying tactics abound. Having sent off my preliminary letter on the 10th and received the response from Noreen above, I've got another letter. This time it's from Eileen Mihill who is a Senior Customer Advisor Basically they are sorry we are less than satisfied with the level of service and thank me for letting them know so they can address my problems. But..... they need more time to look into matters further and answer my concerns fully. They will contact me in 10 business days to either propose a resolution or just let me know how things are going Unfortunately, MY DEADLINE is 24th of July so if they don't cough up before Monday its LBA Time !!!! :lol: Will keep you posted Emble x

Hi Dottie Hang in there, I'm almost 100% sure you won't get to court (though you have to be prepared to) however I think, and this is just my humble opinion, that if the banks thought they could win they would have gone straight away and made an example for people not to mess with them. But if you read the many hundreds of stories around the forums, they are continually paying up. It is intimidatory tactics and they are trying to use thier big corporation power to get to you but you're not on your own. We are ALL behind you to give any support we can. Stick with it and keep us posted
  24. Hi matd - Welcome !! I myself was fooled into upgrading to an Additions account (what was all that about??!! ) Unfortunately I don't think you can claim for this as it was an account fee and not a penalty charge. However I am still a newbie at all this so anyone feel free to butt in an correct me. If its any consolation I fell for it and can't believe it took me 2 and a half years to realise I was paying them for......????? Emble x
