  1. Unfortunately Barclays usually enter a late defence, so unless you're very lucky I would expect it to get to the court stage. I think the average time frame for Barclays is about 5 months I'm afraid. Although if you're at the MCOL stage it shouldn't be too much longer. Hang in there and good luck!
  2. I think so, I started back in August last year with the SARS letter and Barclays have just settled mid January.
  3. You can also claim the overdraft interest but only the interest that is from a result of being overdrawn due to the bank charges. Its quite hard to work out unless you're exactly sure what is the normal overdraft interest and what is due to the charges. I think most people leave it out and then just claim the 8% interest when it reaches the court stage. Read through the FAQ, it should explain it in there.
  4. Thanks Welshman. Have just recieved the money into the bank!! Yippee!! Barclays have also just settled my other half's claim as well! Double yipee! Will complete the survey and make a donation. Thanks for everyone's help.
  5. Just a note to ask in anyone has any advice on the following situation. We purchased a home office house in 1993 which comprised of one 3-bedroom terraced house and a separate garage in a block. We also were told by the estate agent we owned the parking space directly outside our back gate. A couple of weeks ago a company called NOMS (home office people) put up a sign in the carpark stating that they were selling the remaining car park spaces they owned, one of them happening to be the one we thought we owned. On checking our deeds, we didn't actually own the space. NOMS have told us they are going to auction the spaces off on a sealed bid basis (offers in the region of £1500!!). We've maintained the spaces(weeding, filling in holes etc) for the last thirteen years, does anyone know if we have a claim to the spaces, are have a right to offer a lower bid because we have maintained the land at our cost. Any thoughts would be much appreciated!

Its just strange that considering the boyfriend and I live at the same address, we've been allocated different courts (both local, just in different directions) and my claim went straight through to a hearing and his has gone to an allocation hearing. Is it worth phoning them and asking if they want to settle before we get to court??
  8. Hello! Just a quick question, I'm doing a claim on behalf of my boyfriend as well, and have just received the general form of judgment or order in the post. Stating that the claim be listed for an allocation hearing on 2/2/07. Do I have to do anything further for this (i.e. send in the court bundle?) or is it just to allocate it to the small claims track? Thanks!
  9. I've just received my court date for February and have prepared my court bundles and am about to send them off. Just have to wait to see if I hear from Barclays..
  10. Well, Barclays acknowledged and defended my claim, and I've received my allocation questionnaire. I've just filled this in and sent a cheque to my local courts and will wait to hear for a date.....
  11. Just to update.... Barclays acknowledged my claim on the 9th and I have sent the copies of the schedule of charges to both MCOL and the bank, also starting to get my court bundle together too....
  12. Hi I'm not sure on that one. Do you get charged by the bank for using cheques or is it a penalty charge because the cheque bounced?

I realise I need to prepare my own court bundle, what I actually meant does the court contact me to acknowledge the claim and tell barclays about the claim or am I meant to keep checking the website and inform barclays, i.e. the bit about sending them another copy of the schedule of charges? Thanks
  14. Hello I've just filled in my MCOL by following the template in the library and pm a moderator (i think) with the case details and number. I've also had a look throught the court bundle Do I just sit tight now until my claim is acknowledged? Thanks

How bizarre, my boyfriend sent off his SAR to them and within two weeks or so, he had copies of his statements delivered, however, they'd managed to lose one months', so they said tell them of all the disproportionate charges and we'll reimburse you, so he did and they've just sent a letter informing him they'll refund all the charges.
