  1. recieved a letter from Roxburghe Debt Collectors today. Pay up £141.12 (gone up £41.12 , but no explanation) in 7 days or face potential legal action. Should I contact them and state my position or just ignore?
  2. Still in a dilemma on this one, reviewing my options: A - Pay the invoice £60: Forget all about it, or will they send another speculative invoice just to spite me? B - Do nothing: probably the best route from day 1, but I’ve already engaged with them they know I’m the keeper and they have produced some kind of evidence which could be used in court? There evidence is images of my vehicle, I accept this and the times, but it doesn’t prove the driver. The other evidence is a spread sheet of times, payments and vehicle registrations. Looks convincing, but could be easily be fabricated, I always put £1 in this car park, never 50p. Personally I would like to see a duplicate ticket. C - Request further evidence: such as duplicate ticket? D - Make them a reasonable Offer: Make a without prejudice offer to save costs of say 50p+£10 admin without admitting liability on the basis: 1, unable to ID the driver 2, due to the time that has now elapsed from the date of the incident, it is unreasonable to have expected any alleged driver to have retained the ticket. Therefore I’m unable to verify or defend their allegation This letter would be the final one to close of the matter, and in the event it went to court I’ve made a reasonable offer. Where should I go?
  3. Thanks for these comments, I really should have explained my position more clearly. My P2P activity is very careful , legal & limited, and I can't understand how I recieved a 2nd invoice. ACS must have linked my IP address by error. The only safe way is not to be in the P2P environent.
  4. File sharing is not illegal, unless your're downloading copyrighted materail. Much of the P2P material is not copyrighted. My point is how do you protect yourself from accidently downloading copyrighted material? For the record I'm would never condone breaking copyright infringment, and indeed I am falsely accused of this activity, most probably because my IP address has been exposed in legal activities on P2P sites.
  5. Does anyone know how safe VPN tuneling software is for P2P file sharing, such Torrent Privacy, would is protect you from ‘digiprotect’. When you down load a file you never know what it really is, or if it’s copyrighted until it’s too late. Has anyone received an invoice from ACS-Law when using VPN software?
  6. I've just recieved me 2nd allegation of copyright infringement from ACS. The first one went to section 36 and that was 6 months ago. The 2nd case is a more recent one, even harder to believe. In the 1st case I ignored the 1st letter and only replied to the 2nd. Is this a better route as they are hardly going to take you to court after the 1st letter, and it buys more time? Have ACS actually taken anyone to court yet, after correct LOD writing? This being the 2nd allegation am I more likely to go to court even with the LOD route. Do ACS cross reference their cases, it's a different client? Advise appreciated?

Going back to the begginning of this thread, and rightly or wrongly I have engaged Excel in correspondense, they have now sent me their evidense: 2 pictures of my car , entering & leaving the car park , indicating time, looks good image, but no driver ID A spread sheet of vehicle & payments, my vehicle is indicated to have paid 50p , instaed of £1. Looks convincing to many, but could be fabricated evidense. To my knowledge I've put anything but a £1 in this car park, 50p is not long enough. They haven't upgraded the fine to £100, although I've exceeded that time limit, still asking for £60 by 2nd May. What should I do next: Assume their evidense is strong and pay. Do nothing and risk going to court. Continue challenging their evidense and claim only to be the keeper? Advise appreciated?
  9. I realise ignoring them is one approach, put I would feel more comfortable engaging them with carefully written letters. Then if they decide to take me to court then I would have acted appropriately. In any case I'm begining to collate plenty of evidense of their bogus parking fine [problem]. Why should we allow them to get away with it?
  10. I received a Parking charge of £60 from Excel for code 82- parked after expiry of time. The date of contravention was 12/03/10, and their notice was dated 26/03/10. I always use £1 for 2 hours on this car park. I know Excel have a zero tolerance policy. Their evidence is very weak, two low resolution pictures, just about make out my VRN. I’ve sent a template letter requesting proof of the driver and contravention. I received a response today, with no further evidence and the threat of £100 charge or court action. I’ve now found out that there have been many bogus charges sent out from Excel for this car park. Some people have the pay & display proof , and one paid the first £60 fine under duress, never used the car park again and still received another charge. My plan is to send another letter of rejection, but I’m quite prepared to collect all the evidence I can to put a case together for Watchdog or local press. I found an article in the Express & Star news paper back in May 2008 of similar activities by Excel. Please contact me if you have any experiences of excel on this car park? Please let me know your thoughts?
