  2. Hello Can anyone tell me where are the template letters to see if the Debt is enforcable. I have a credit card agreement taken out in 2004, seems quite shoddy I know from this Forum I should write to them and ask for a copy of my Agreement what do I do next and where are the template letters ? Is there a thread on here about Debt Enforcability
  3. Hello What do you mean by 'CCAed the debts to check they are all enforceable?' I have credit card agreement taken out in 2004 and it has nothing about amount, repayment, interest at all, it all speakes about doing credit checks, sharing information blah blah. Any suggestions ?
  4. Hello its the City of London Court But the court refered me to Mediation - Which is also in London, City Disputed Service. I had to go through this other wise I would be seen as un-co-operative to resolve the problem Becuase I lost my job in 2008 I can't afford legal servive, One solicitor took on the case on legal aid and dropped it again with explanation - only 50/50 chance of winning not worth spending legal aid with such a chance lack of evidence I found plenty of evidence - but the solicitor over looked it Human Rights Commission say I have a case I been preparing the case myself as I know quite a bit about diversity and discrimination, I had a PA who cannot make it on that day to Mediation so I am stuck with noone to speak for me

Hello I am taking HSBC to court over disability discrimination I have a severe speech problem, HSBC were charging me 23.9% during 2009 I tried to sort it out but they kept on discriminating by asking me to explain on phone, even though I sent Written explanation of my hardship, Even when I tried to pay by phone they kept on asking for a lenghty explaination even though they have it on file I explained my disability - they did not make any adjustments or ask 'how can we help to make it easy' I am going to Mediation set up by court NEXT week Wednesday 6th October, London - only I don't have any legal representation.... and I can't speak. My PA who was supposed to help me speak (read out what I write) can't make it so I am stuck and panicking. Can someone help or know anyone who can ? they don't necessarily have to be legally knowledged as long as they can speak clearly on my behalf ? I am willing to pay up to £70 or a little more for 3 hours.
  6. Hello Not sure what you mean, the bank sent me a copy of the original signed agreement becuase I asked to see it under the credit agreement act, I used a letter template from this forum. The original signed copy says nothing about interest rates, how it works or that its variable. After I signed the agreement - They gave me a separate leaflet to read and take-away with me, which says 'terms and conditions' which has all the info on how the interest rate works, e.g that it is variable etc. but agreement I signed does not have that info, can I challenge it ? and if so how can I ? is there a law I can use ? p.s currently I am taking them to court regarding disability discrimination, should I mention the above at court ? Thank you
  7. Hello I signed for an ordinary HSBC credit card in 2004. interest rate was less than 12% APR at the time. now its 23.9%. I asked to see my terms and condition which I signed - it talks about 'background checks, sharing info with fraud prevention agencies, credit ref agencies, keeping up repayments, recording personal information etc' which I signed but it does not mention 'variable interest' rates. I think what happened at the time is this; they asked me to sign the above agreement, then handed me a separate leaflet of 'credit agreement terms' which talks about 'Variable interests'. However, my point is the variable interest rate terms and condition is only a leaflet, I did not sign anything that mentions variable rates in the agreement. Can I challenge this - and does anyone have any experience in challenging terms and conditions signed or rather not signed. Any advice ? I can't afford legal help at the moment. Thank you p.s: I used templates and info in this forum to get a refund on bank charges ! thank you so much ! you guys are greate. Full refund is approx £180.
  8. Thanks for the encouragement Well I have a sever speech problem. When I lost my job I found it hard to keep up credit card payment I have to contact them to ask for lower repayment under the financial hardship policy. HSBC say they have alternative methods of payment but thats not helpful when I want to make an enquiry they didn't give me any address or email for the dept I wanted when I asked for reasonable adjustment to access their service - they said 'NO because we need to provide the same level of service to everyone' Then they said I never told them about my disability - but they hear me struggle on the phone. I also wrote to them about it. They did not ask me how they can assist in providing access to system When I wrote to them - they did not respond Instead they said I have to call to sort it out or I will be passed to the baliffs. Then they said I have to 'prove' that I have a disability They failed me on so many occassions.
  9. Hello it says nothing about interest rates varying or changing, its not even in the terms and condition. I will take a closer look and get back - but I remember I looked for it and their was nothing about variouse interest rate.

Hello I am taking HSBC to court for Disability Discrimination The Human Rights Commission say I have a good case My solicitor said I have 50-50chance of winning, So my solicitor Dropped my case Becuause:- 1. 50-50 chance 2. I need legal aid - so risk is too big for 50-50 3. They seriously overlooked evidence I provided 4. HSBC Solicitors omitted and fiddled evidence (They really are playing dirty - I can't believe that they could be so dishonest !) - so my solicitor took their 'professional' word over mine without listening to the evidence. I was cross but I decided to represent myself at court Problem When my solicitor handed over information to me so that I can represent myself They did not mention that I had to sign the Particulars of Claim, I did not sign it as I signed the claim N1 form and thought that was enough. If I had dealt with this myself from begining I would have know whats what - but because solicitor was dealing with it, they did not give me all the information during hand-over *Now HSBC are saying they may seek the have to claim struck out of court as I did not follow procedure with a signature on Particulars of Claim, although Claim form was signed. So now - Under the The Civil Procedure Rules which require parties to litigation to act reasonably and to co-operate where possible at every stage of the litigation process. I asked the courts to tell HSBC that they need to Co-operate as I have co-operated with them by giving HSBC 'extension of time to respond to letter before action' also HSBC asked me to 'give them time before serving the claim form' When I had my solicitor, they advised me to allow time or the court will say I have not co-operated, I would have been able to correct this mistake within deadline if I had not given them flexibility and extension. Can anyone advise me what to do, I haven't heard from the courts yet. Can HSBC suceed in getting the Claim struck out ? if the Claim for is signed but not the Particulars of Claim ??
