Could you ask ingrid if this ruling would be applicable to those who took out a loan on behalf of someone doing the course. FoS ruled me out purely because my name is on the training contract but my fiancé is on the loan agrement. This is despite the fact the the loan states quite clearly that it was for training. And another round of thanks for fuzzys hard work in all this i think is in order well done we all appreciate what you've done -
FOS was late getting back to us (me and my fiancee) so we chased them up about it. Apparently we would have had a strong case against barclays (we were going with misselling as our strongest argument) but because the loan is in someones name other than the person who is training we have no chance. I want to know why S75 doesnt cover us. The loan is clearly for training it says so on the loan contract we signed. Also from the info FOS gave us it says Barclays found us the replacement provider in march. If the FOS thinks that it makes me wonder what Barclays have been telling them.

I'm getting seriously worried over this guarantor issue I signed up for the course but it was my fiance who signed for the loan. Im sure the contract she signed specifically states advent on it doesnt the prove it was a loan for training? As for the miss-selling point we cannot prove it but the guy who sold us the course kept saying it was study at your own pace and take as long as you want but I dont have anything written down. As for the end date on the contract he said that was left blank because there wasnt one. We are curruntly paying £200 a month that we just cannot afford. If it the loan was just cancelled we would be happy. but a part of me says the way barclays has treated us that we should be entitled to a full refund.

My dad gets free legal advice for family from his union and I've just had a conversation with them. She said that barclays are contracted to provide training and are allowed to find a new provider and thrust them upon us regardless of what we think as long as the trainer is equal or better then we dont have grounds to cancel. If its not equal or better then they are considered breaching the contract She also said as its now 2 months later we should send a letter saying that they have 14 days to find a suitable trainer or offer a refund or we will consider it a breach of contract over the length of time without paid for services.

Hi all I've been following this thread for weeks now and I'm in the same boat as most of you Im with bpf and have been paying for nearly a year now. early on I phoned barclays to freeze my account and they said they would but it would take a few days to action. my payment for feb was due out 3 days after and they said it would probably still go out but the march payment deffinately shouldn't. I phoned again a week later and they said that my account was frozen and they said this without any prompting from me. I've just checked my bank statement online and the march payment has come out. Other than phoning just to complain does anyone have any ideas on how I should handle this? My view is that it shouldnt have taken 3 or 4 days to freeze an account but Im willing to give them the benefit of the doubt on that but I'm absolutely outraged that they are still taking payments on an account thats supposedly froze!
