  1. lol Glasgow, you've obviously dealt with them then! haha! Yeah i'll sort the letters out tonight and get them sent off. I have to admit, I do slightly enjoy the phone calls with these idiots though! Knowing i'm in the right!
  2. Was just reading through that actually, and thinking back now I dunno why I even accepted to send them another CCA request! I have nothing to prove to them, I have copies of the letters i've sent to Apex and Lloyds aswell as proof of delivery and proof of my account being in dispute! As far as i'm concerned my debt shouldnt of even been past onto them in the 1st place. Anyways i'll send that account in dispute letter and the cost bit I just read about, I dont think they'll be back in touch for another week anyways, by which time they'll of received my letter. As always i'll keep this updated on anything else I hear. And thanks for the help, it really is appreciated!

  4. Well i'm now being contacted by another DCA by the name of Allied International, regarding the same debt. They rang up asking about the debt and I asked him before he went any further, does he know that the account is in default because Lloyds and previous DCA's have failed to send me the credit agreement which I had requested on numerous occasions. Then he said that they had been passed on the debt back in February which I then responded with my debt shouldnt of been passed onto him in the 1st place while my account was in default. He then told me to send another request of the CCA with the £1 included to his address where he would then get in touch with Lloyds and try and sort it out. And while I was looking for a pen to write down his address he went on to ask my why I wasnt willing to pay the debt. Which I told him I wasnt willing to discuss over the phone. So now what do I do? Just send another request of CCA to these guys? Which I doubt they will be able to provide anyways!

  6. Is there a letter I can send this latest DCA to stop ringing me, or is it worth me just ringing them and telling them to stop? Everytime I get the phonecall it's just a recorded message so there's not actually anyone there I can tell to **** off! And what's more annoying I keep thinking the phonecalls are for jobs! I dont really want to change my mobile number as i've had this 1 a while and use it a lot with work (i'm self employed).

Ah well that's a pain, seeing as I hadnt made a payment for 2 years, until last April when I decided it was time to try and sort things out and so I started paying £5 a month every month right up until last October I think it was. So it's going to be 6 years from last October then? What a waste of 2 years! I never expected any of it to be quick and easy, it's not like their just going to rollover and forget about my debt is it? (Unfortunately). But I guess my only other option would be to offer them something to wipe the debt off? 50% or less of the actual debt? Which I don't have at the minute anyways! But seeing as they cant provide my CCA and legally try to enforce my debt then I would stand a good chance of them taking a lump sum to wipe the debt? Thanks for the replies!

  9. And then what? What will actually come from it? I'm starting to feel like this is going to drag on forever! I have also had 2 phone calls from this DCA. Which doesnt really bother me too much as I know they cant do anything, but it can still be quite annoying running for the phone and finding out it's a DCA. The thing is there's never anyone on the other end of the phone. Its a recorded message asking me to call the guy I named in my previous post, regarding "recent developments". So is it worth just ringing them and telling them to stop calling me as the accounts in dispute? Also, what is the best possible outcome I can achieve from all of this? Will the debt always be there until I pay it off?
  10. Well I still havn't had any response from Lloyds TSB. But I did just get a letter from Allied Internation Credit LTD. Saying: Date: 22 February 2010 Client Name: LLOYDS TSB BANK PLC. Our client has informed us that under their terms and conditions, as Formal Demand has been made, payment of the full outstanding balance must be made immediately. Should you need to discuss your account, please urgently call: Mr A Dickey (0141) 2283039 PLEASE ATTACH PAYMENT TO THIS NOTICE AND RETURN IMMEDIATELY. ----- As far as i'm aware, as my account has defaulted arent they breaking the law by passing my debt onto yet another DCA? Seeing as I havn't received a single response to any of my CCA requests? I am not scared of the letter as I know they dont really have a leg to stand on, and it makes me laugh if anything. But also p***es me off that they can try this! So once again, where do I go from here? Thanks in advance, it's much appreciated!

  13. Keep me updated if you hear anything else from them, I havn't a had a thing since those letters in my OP. How true is it about them being able to try and recover the debt once the contract has reached its end date? Without the proof of a CCA?
  14. So basically i've done all I can do? I havn't had contact from them for a while and havn't paid a penny, which all sounds good but there's a default on my account which i'd like to try and put right if possible... I also read that once my debt reaches the end of it's contract date then Lloyds could try and reclaim the debt without having to show a CCA, and as the end of my contract is this September I thought I should try and do what I could now. So is this right or wrong??
  15. Well I thought i'd update this on the latest... Havn't had a reply to that letter either so looks like i'll be making a complaint to the OFT. Any tips on how to go about that?
  16. If they aren't legally bound to keep them after 6 years then how can they be legally bound to try and reclaim the money back! No contract, no money in my eyes! The thing is, mine hasn't even been 6 years! It's only been 4, and I still cant get a CCA from them! But good luck anyways! I'll be keeping a check on how things pan out for you...

  18. Well I did state in that last letter I just sent I was going to complain to the OFT but the more help, the better. So cheers for those 2, much appreciated... Any idea how long I should be waiting for a response?

  20. Yep! That's exactly where i'm sending them to: Lloyds TSB Bank PLC. Consumer Debt Recovery Three City Park The Droveway Hove BN3 7AU All 4 of them went to that address! I take it you have had a similar experience with them?
  21. Well I sent the above letter today by special delivery and was told it should be there by 1 o clock tomorrow which I will be able to check with the 'Track & Trace'. In the letter I requested a copy of the official complaints procedure. But what happens if once again they just dont reply to my letter? Seeing as this is like the 4th or 5th letter I have sent by recorded / special delivery and have yet to have a response to any of them, i'm not holding out for a response with this letter either. But how long am I supposed to wait to get a response? A week? A month? And then if or when I dont get a response what do I do? Go ahead and make a complaint with the OFT stating that they have failed to respond to any of my letters? Also, i'm sending the letter to the address in this letter that they sent me a while back: http://www.myimgs.net/images/aryp.jpg That is the only letter I have received from them regarding my loan. Is that the right address for me to be forwarding these letters to? Apologies for all the questions, and much appreciated for the help...

  23. Well this is the letter I have come up with which I intend to send on Friday by special delivery, meaning it should arrive there exactly a week after my previous reminder. Dear Sir/Madam, I write to remind you that my letter, sent by recorded delivery on the 4th of January 2010, still remains unanswered by yourselves. I also sent a reminder by special delivery which I can confirm was delivered on the 1st of February 2010. This also contained a copy of my previous letter for your convenience. I have enclosed copies of both these letters. But please note however that as you have failed to respond within the 30 day deadline stated in both my previous letters, I will be making a formal complaint to the office of fair trading. I therefore request a copy of your official complaints procedure which you are obliged to supply. Yours faithfully, So how does that sound? Anything I should maybe change or add?

Well I sent another copy of the original letter with my reminder letter which I know was received on Monday just gone, I have a feeling I might get a response towards the end of the week, but if not then i'll write another letter as you mentioned, stating that I will be reporting them to the OFT etc. Thanks for the replies, i'll keep you updated as it go's!
