  1. I will be honest, they are very bad for this. My advice is this: 1. Write to 3 giving your 30 days notice and requesting the disconnection of your account and your PAC code. 2. Make up a story that they cant come back at you with. For example I want an iPhone, as they cant offer it, only o2 and orange and later vodafone, this way they cannot come back at you with new offers. 3. Be tough, but not rude. If you are soft they will muck you about till you give up and take a deal. If you are rude or aggressive they can hang up or pass you on. 4. If you dont get straight through to disconnections, ask to be passed through to them. 5. Also dont mention you are leaving because of poor service as they will probably try and tell you it was your old phone or something ridiculous. 6. If they start going on and on then just repeat your intentions to them, ie "no, thank you for the offer but I would rather just take my PAC code and move over to o2 to get the iphone" 7. If they ask why the iPhone, just say "I JUST LIKE IT , YOU CANT CHANGE MY MIND". Hope it all goes well! Gordon Carphonewarehouse

  3. you could argue that it is a marketing ploy, but the point is that such a thing does exist and the returns policy is different than buying a new pay as you go sim with a phone. you see mobile phones have a handset only value which is more expensive than the value most people pay for phones, since the networks discount the phones as they presume people will top up in the future on the sim card they need to take with the phone. some networks allow people who already have sim cards with their network to buy the phone at the discounted price without needing any top up, this is what a pay as you go upgrade is. the reason for difference in returns policy is that the handset loses 30% of its value when returned, meaning potentially more money is lost. As for this persons case with their 3 phone, the previous post from the carphonewarehouse employee is 100% correct, and from here 3 have no legal obligation to allow you to exit your contract, HOWEVER they MUST either exchange of repair the handset, in this case they have offered a repair so they have kept to the legal requirements. If you are unhappy with the alternative handsets on offer then unfortunately there is now law to use against 3, as they have provided a service agreement which ie being fulfilled. Any further action would have to be taken from out-with the store, and by head office or upper management. I would advise you to contact 3 head office and express your displeasure, however the odds of you getting out your contract are unlikely. As was also mentioned in the previous post by the CPW employee, the new software version for the N97 is much improved, and I would give it a try while you are waiting on a response. Regards Gordon
