if you have a case against capital one go thru the normal methods ie, ask for your statements, wtite to them, telling them you want the charges and interest back, when they refuse write again threatening court action, when they refuse again just go thru moneyclaim online. it took 3 weeks once it got to the moneyclaim bit. incidently it was the £12 charges i got a refund on.

i decided not to take martin lewis's advice (go thru ombudsman) and i just went for the court route, and WON no problems just a case of doing everything in the correct order as advised here and on other sites, they paid out this week

i should also mention it's a rbs credit card

appologies if this question is in the wrong place or has been asked previously,but my credit card company has added around £300 in overlimit fees and i'm £100 over my limit and they are theatening action are they likely to take me to court as obviously these charges are illegal and i assume they don't want to discuss these chages in court. secondly what other actions are they likely to take? thanks

not done this for a while but is it exactly the same format as a few years ago, and i can claim straight away with credit cards and i don't have to wait for this oft jobby thing

thanks for the advice, i will contact the court and see if i have to wait 28 days,regardless i will wait 14 days from judgement then get the warrant bailiffs ect.

ok thanks,do you mean telephone them or write to them? at the moment everything has been done by post,i have had abosulutly no responce from the bank. i understood they had 28 days from the judgement to respond,the judgement was issued on 15-aug-2006. i was going to sit and wait the 28 days, untill i saw on moneyclaim there was an option for a warrant, i was under the impression i had to wait the 28 days before any further action could be taken. if anybody can clarify this situation i'd appreciate it thanks

i have put my claim in thru money claim, they haven't responded and i have claimed judgement by default. on the moneyclaim website it says i'm allowed to ask for a 'warrent' which involves bailiffs going in to get my money. judgement was entered only a few days ago, do i have to wait 28 days or can i ask the bailiffs to go in now?

i went wrong by trying to do it all on my own spread sheet, when this didn't work i copy and pasted it to the one one here,that doesn't work, you must put all the information manualy

on my online moneyclaim form do i include the interest in my claim,ie it asks amount of claim, does this include interest? just before that section it asks if if wish to claim interest and the amount i'm claiming, which i've filled in,but i'm not sure if i put this in the' total amount claimed' collum, thanks

ah i've finaly cracked it, i'd already done my own spreadsheet and copy and pasted the details onto the spreadsheet,you can't do this they must be put in manualy, however i have another problem now, on the money claim form do i put the interest in with the amount claimed or do i leave the interest to the courts discression?

can somebody help me with the excell spreadsheet,i've downloaded the template and put my details in,but i don't know what buttons to press to actualy do the interest calculation,all the information is there except the interest calculations,i've looked around the site but i'm struggling

what button do i actualy click to do the calculation? i have the spreadsheet and all my details on the spreadsheet i just don't know how to work out the days since offence and the 8% bit, i'm sure it's just a case of pressing the correct button

i have had an offer from capital one which i rejected and threatend them with court action giving them 7 days to reply,today 16 days later they have made the same offer. should i reject it again accept it as interim payment or just start my claim on moneyclaim any advice would be appreciated

ok thanks, just reading other threads and they all get a letter from cobbetts solicitors. so if i don't respond this won't effect the court case(unless it is an offer)?

case made on moneyclaim,i am now expecting the letter from cobbetts solicitors manchester,my next question is do i have to respond to their letters? can i just just ignore all their letters and just let it go thru the courts and argue it out there?assuming they want to go to court
