  1. As at 4pm today (24 Jan 2010): http://www.xltrading.com/ says "Forbidden. You don't have permission to access / on this server." http://www.xltrading.co.uk redirects to an "Account suspended" page at http://xxlteam.com/ xxlteam.com was registered on 15 Nov 2009 (after this thread started) to someone called Jack Daniels in Sheffield, with an XL Trading gmail address. Maybe Jack Daniels is what he was drinking at the time?
  2. Because court action costs them money. So they'll look at cheaper ways of solving the problem first. Such as approaching ISPs to have the site shut down. Or having their solicitors make threatening telephone calls (it appears Tom-Tom did this and were successful). In fact, the High Court nowadays has what are called "pre-action protocols", which say that claimants are supposed to try to settle the matter in other ways before they take court action. Litigation should always be the last resort.
  3. I've just put Tom-Tom (and other variant spellings) into XL Trading's search box. The result: I can hear that conversation now: Tom-Tom's solicitor: You're selling illegal copies of Tom-Tom software. XL Trading: We just provide a backup service for existing Tom-Tom users. That's legal. Solicitor: Rubbish. But I'll do you a deal. Take all our products off your site immediately and we won't sue you. XL Trading: Oh, all right then. Yes, I'd say that was a very positive conversation... for Tom-Tom.
