I initiated a PPI claim against Egg about a year ago. A cheque has now arrived through the post from Barclaycard for the outstanding plus the 8% interest.I just have to strike up a plan to clear the remainder.B

Firstly, thanks to this site I am in a much better place. The information is tremendous. I'm looking for a bit of info. I have the information provided under a SAR and CCA request. In it, there is nothing other than a list of financial statements and the latestest T&C's. I have had DCA letters with the standard threats of solictiors and court etc. My response was to politely tell them I don't believe they have the paperwork to take it to court and also, if they did as they lack anything with a signature or presicribed terms and don't believe they can legally charge me interest. I would therefore seek a refund of: 1. All the repayments that exceed the amount spent. 2. All the interest added to the account. They have completely vanished into the woodwork for 3 months, and this is MBNA, not usually known for being quiet. The information I put was a bit of leap of faith on my part, but I am wondering if this is legally correct or possible. I was hoping to use it as leverage in a settlement, though because they've been so nasty at a personally dreadful time I'm not always sure I'd like to settle and let them do without. Any advice would be most appreciated.

I have read elsewhere on this forum that it is possible to get the settlement figure lower when they know they can't produce a CCA, but I guess each case may be different. One thing I'm not too clear on with regard to offering settlements is whether you actually acknowledge the debt, or by offering a settlement even as a gesture of goodwill you are acknowledging it anyway. So I think we need to tread carefully. I, like you would also like to clear my credit file, though I don't expect it to be easy. I have read of companies agreeing to full and finals only to trash your credit report later with partial settlements listed. Gonna be a rollercoaster.

Hi guys, I hope you don't mind me popping into this thread as I'm in a similar situation, I'm happy to open another thread if you'd prefer though. I have my replies to my CCA and SAR requests. They have only been able to supply a copy of (undated) terms and conditions and the last 7 years history on the account. No application form or executed agreement and absolutely nothing with my signature on it. I would like to make an offer for full and final, I was just wondering if: I should write to them pointing out the above and make an f&f and also that: Payments to MBNA actually exceed the claimed balance, not sure if this would provide leverage. I have read from other caggers that they managed to get 10% for f&f settlement, so fingers crossed. Any help would be greatly appreciated and I'll keep you informed as how it all goes.
