The court will not accept a cut and pasted copy of the CCA, one of the points on which there case failed was they were unable to produce a clear and understandable copy of the Creidt card agreement. The other point you brought up about the default notice MBNA were unable to provide a copy of there default notice and the court will not allow heresay evidence ie if MBNA say they have defaulted you they have to provide a copy of the default notice in court. At this point I would not tell LINK about this fact or a default notice might mysteriously appear send a SAR to MBNA and get your personal file if there is no default notice then they have no cas e against you. Also if LINK have issued a default notice check the validity of it Hope this is of help

Well the original dispute with MBNA was over PPI and interest rate MBNA applied PPI to the account although I did not apply for it and when I got in trouble they doubled the interest rate on the card. In court MBNA breached the CCA 1974 by the following 1) Unclear credit agreement as stated earlier 2) failure to inform me of a raise in interest 3) failure to produce a default notice Link who purchased the debt were in breach because they issued a default notice 1) After the commencement of court proceedings 2) they included court costs in the figure on the default notice 3) they did not allow me the correct time to comply withe the default notice
  3. Yes the whole debt was written off the credit agreement was not the only issue but it would of been enough on its own to deem the agreement unenforceable

Hi I have just won a case against MBNA for a credit card one of the reasons the county court judge dismissed the case was that the copy of the credit agreement was not clear and legible as prescribed under the CCA 1974 and it was deemed to be unenforceable, i would write and tell them that the agreement is unenforceable on these grounds best of luck
  5. Hi Everyone I have had along standing battle with Link Financial/MBNA regarding a Credit card debt for a credit card I took out in 2005. I am happy to tell you that the case went to court last month and I won, I had the case dismissed on various grounds, via the terms of the CCA 1974. Due to the terrible way I was treated by both companies I would love to help anyone who has any problems with above 2 companies via the experiences I have had in winning this case. PS the claim was for £6536
