  1. Hi Donkey B, I've had some more read on other thread and note the defence done by CAPCOM, do you think I can use the same arguments in mine? Also, as mentioned, I still have not received any response back from TR/HFO to date.... The 7 days is up for the CPR letter, should I apply to the courts now? Or should I just concentrate on my defence which is due in a few days? I would really appreciate your help with this please. Thank you.

  4. HI DB, I've managed to look at several thread and my goodness there is a lot to take in, however, as promised here are some bullet points as promised: 1. No acknowledge to any of my letters 2. No reponse to my CCA request (and this is stated in the CC form) 3. Possibly no response to my CPR31 request letter I can't think of anything else. Please let me know your experience thoughts. Thank you so much for all your help in dealing with these horrible people.

  6. Ok DB. I've sent off the CPR letter recorded still no response yet as per all my correspondence to them. Just for some clarification, am I correct is thinking I have 28 days to complete my defence? The claim form was dated 10 May which gives an additional 5 days to act as the official date of is being served, is this correct? So, am I correct in thinking the defense have to be completed no later than 10 June? I have acknowledged the claim form last week. Thanks for all your help!

  9. Thanks Donkeyb, No, I wasn't implying I wasn't going to defend, maybe I worded the details incorrectly. Apologies for the misunderstanding and I agree it's a no-brainer. Does the same apply to HFO Cayman to HFO Capital Ltd as well?
  10. DonkeyB, Why did you say I puzzle you? I am sorry, I have alot going on at the moment with my dad's death and trying to sort out funeral not being able to grief, taking care of my mum and 2 young children, I may be abit space out and I can only apologize. I promise I am normal and just want to get these horrible people off my back... I have a few more questions if I may, you mentioned in post 40, the POC's are conflicting as it was not possibly for Barclaycard to be assigned to the claimant plus the other one states HFO Cayman. I've read some articles with this company dealing in illegal transfers of accounts. I just wonder how can I prove this? Also, should I ask them to send me details of the alledged transferred to the Claimant pursuant to an intra-group agreement? Thank you. Should I also asked where do they based their contractual interest to or this should be included in the credit agreement?

Also, from your experience on this forum have there been any successful cases with HFO? I have to make a decision soon and would really appreicate your expertise and advice. Thank you
  12. I am sorry for any confusion caused,please know this is not intentional, it has been a long time and to be honest I didn't understand it then hence I loss that case hence I am trying to learn better so I am prepare if and when any questions are asked I am able to defend myself properly.

Hi coledog, Just to give you an update, I send off CCA request along with a (copy of my letter to HFO which stated I didnot acknowledge the debt and for them to send evidence which to date no response) to Turnbull and cc HFO and haven't heard back from them, however, I received a letter this morning from Turnbull saying the following: "We write further to the above. Please find enclosed the Particulars of Claim relating to the cleim issued by Northampton (C.C.B.C) on the 10 May 2011. Please acknowledge receipt. The attachment says IN THE NORTHAMPTON (CCBC) County Court... Claim Number: xxccccc Between HFO Capital Limited and me... which goes on to outline 9 points which includes they are entitled to claim contractual interest pursuant in the terms of the Credit Agreement at a rate of 17% per annumn from the date of assignment to the date of judgement or sooner payment being at a daily rate of £2.31. The claimant is entitled to claim post judgement contractual interest pursuant to the terms of the Credit Agreement a a rate of 17% per annumn Alternatively, pursuant to Section 69 of the County Act 1984 at a rate of 8* per annum from the date of assignment to the date of judgement or sooner payments Then it list what the claim and dated 12 May with a Statement of Truth. What should i do not? Please note still no response of my CCA request....which was received and signed for on 21st April.
