  2. Oh Dear..after all of the trouble I have gone through over the last 8 months with this matter. I sent a copy of the revoking order to Liverpool Council I have today received a letter from them with a cheque for £110 plus a notice to owner for £70. After all the messing I am £40 better off. After some rambling the letter states: This order does not cancel the original penalty charge notice. As the order for recovery (for£110) was revoked and you have paid the Marston group this amount we are refunding it back to you. Please find cheque for £110 attached. The court order dated 21st December 2009 does NOT order Liverpool city council to pay back to you any court fee,legal fees, Civil enforcement officer costs or any other costs. What should I do now, I am tired of it all but I will be dammed if Marstons get to keep the fees after all of this.
  3. Hi, I leased a property, a small shop for just over 1 year Nov 2006 to Feb 2008. I paid what I presumed were my full water rates by direct debit for this period. I have just received this letter from UU I am writing to tell you about the adjustments we made to your account. When you moved into the property on 1st Niov 2006 a water meter had not been fitted. It is UU policy to back charge customers for water and sewerage service they have used based on current water usage. (This property has been empty since I left) As your account has been closed on 5th Feb 2008 and there were no water meters fitted at your property. We used the national daily average of 2M3 of water for non household customers. This means that based on the nastionasl average water consumption you would have used 924M3 during this period. An amended bill was sent on 27th May 2009. As this is a tiny shop I had a toilet and a small sink in the toilet for hand washing. Apparently this usage 924M3 is around £2084.!!! Please help me, I received the above letter to my home address and prior to that had not had any notification from them. During the year I had ther property I had made payments of £60 per month.
  4. If a limited company goes under would the directors be liable for the business rates of the empty property from where the business was once conducted ???
  5. I took the lease on a shop premises in October 2005, due to circumstances in my life I did not trade from the premises and tried to sublet without success. In August 2009 I have a rates bill from the council for 3 years rates, i immediately telephoned and they asked me to prove the premises was unoccupied, as because the RV is below the threshold I would not be liable to pay rates for an unoccupied premises. I have sent them a letter from my accountant and landlord stating the premises was unoccupied. They are refusing to accept this and say they want utility bills which I cannot furnish. When I telephoned last week they told me an amount was with the baliff and after me phoning the bailiffs I found out that sum related to the year 2009/10 ( my lease was up Oct 2009 ) I obviously refused to pay the bailiff from Equita and said I would keep him informed of my situation after the council had clarified figures. He said he had been to my house last week, it is a lie nothing through the door and I have phone records to say I had rand him several times the day before. What has really worried me is that the council have told me that they can make me bankrupt. I have told them that in over 3 years I have had no bills/summons or anything, they said they sent them to the premises, there is no letter box!! They admit that they only found out my home address in August 2009. 5 now dont know the next step as they are refusing to accept the proof I have submitted, I today asked whether they would accept witness statement from the surrounding business's and they have refused. Can anyone please help with some advice about what to do next as I dont want to be made bankrupt. I have only ever received the bill sent in August 2009.
  6. Hi, Thanks for your replies, I have the revoking order from TEC. I have telephoned Liverpool parking services who actually cannot tell me a. they have received nothing from TEC b, that they donot know who refunds me c. to send a copy of revoking order to them with details of claim and to cc it to Marstons.

Hi, I have finally after 6 long months of letters and court appearances just received a notification from northampton that a statutory/witness statement has been filed, this started with `Marstons bullying me to pay 501.70 on the 19th June for anm unpaid parking tickedt. I have had the patience to wait and pay for subject access report, go to liverpool county court , send numerous letters, pay £75 to get it lodged in court etc etc etc. So finally I have the piece of paper. WHAT NOW I ask, how do I actually get my money back, can anyone help please
  8. Hi There, Thank you for your kind reply Gustavious Rex. Not quite ofay with the site yet so dont know how to PM you. It happened on Merseyside, Liverpool City Council. The Bailifs name is Shuttler. I have sent forms TE7 and TE9 to Northampton also Subject Access Request to Marstons ( this info I gleaned from the internet). I am so angry, distressed and more importantly ill after this experience I would even say I feel violated and abused. I want to go all the way on this one , the money is not my only motivation. I called the police in this instance and it worked against me, the bailiff was allowed to walk into my house due to the police, in my shock I listened to the advice of an officer of the law. The police at no time asked anything of the bailiff re charges etc. I never saw any identification from either bailiff, I never saw the warrant as they wouldn't give it to me. I couldn't remember the ticket and I definately didn;t recieve any letter from Marstons. I am desperate to move things forward whilst the full impact is still with me but feel frustrated that I have to wait for info before I can do that. I would nlikem to put in a complaint re the police too.
  9. I have just experienced this very same situation from Marstons. Whilst having tea last night at 8pm there was an extremely loud knock on my door, when I opened up I was confronted with two scary SAS style men complete with bullet proof vests, My car had been clampted in the street and their large white van was parked in the middle of the street. I was asked for £501 for a parking ticket that had been £30. I was refused when I asked to read the warrant. One of the men rang a tow truck on his mobile. They had previously knocked on a neighbours door, my neighbours are now out in the street. I rang the police. On the telephone the policeweoman told me not to let them into my house. 4 policemen and one policewoman arrive in the street. I bring 2 officers in the house and the other officers are talking to the bailiffs. Within 2 seconds the bailiffs are in my house demanding I call someone to lend me the money if I didn't have it. I asked the bailiffs to leave and the policewoman tells me to calm down, one of the policemen actually told me I had only 2 choices, pay them or let them take my car. He wasnt sure what was on the warrant cos of biro all over it but said it was a real warrant. I now have 7 people in my house, I was shaking and crying, I paid cash in front of them all and was given a receipt. Bailiffs and police leave, the parting shot of the bailiff was " they dont call them distress warrants for nothing" I signed nothing only the receipt. I had a massive panic attack when they left, have been to Drs today blood pressure is sky high.
