  1. Interesting read about Minster Law. They have been fobbing with off with rubbish for 9 months over my case. Also clear cut, guy drives into the back of me. Minster Law clearly have no interest in my car or the case, Only injury claims. I accidently told them the other day my elbow still twinges when i called them to find out what was happening and they told me they will have to persure the injury claim despite me telling them after i dont care about my elbow which is fine! I just want my car sorted! Anyway, they said because i said it twinges they have to carry on with injury even though i said i don`t want to. How can i get them to chase the 3rd party to admit liability so i can go ahead and get my car repaired? I was only TPF&F. So fed up with it. Minster Law are rubbish and after reading this, makes me realise i`m not alone. Will I ever get anything out of this case which was not my fault, yet having to hang on meaninglessly with a knackered car! A
  2. Hi I`m only TPF&T so have to sort repairs out myself unfortunately if i want my car fixed. I did havea courtesy car until the TP inspection declared my car fit to drive after 3 weeks of accident. Exhaust blows and Mot now out and to fix damage to go through MoT will cost ME £800 which i may be able to claim back when or if it all goes through. My insurance company have told me not to call them within the 4 month period the other company have to respond to my claim. They said they will call me when they have news. Although mild, there is also personal injury in addition to damage to my car which is also being sorted. When my policy is up for renewal, i shall be going fully comp!
  3. The solicitor dealing with my claim just phoned to say that the TPs insurance company can blow the claim out if liability is not admitted through failing to contact the person that was at fault. Seems like a bit of a loophole to me!! either that or my solicitor acting on behalf of my insurance co and the TPs insurance are working together on this! I did ask that the client has a legal right to notify his insurers if he changes address and that could invalidate his policy in the event of an accidient but she said that is one of those things and is the fault of the client and not the responsibility of the Insurance Company. The Police can try and find the person at fault if they can prove he was driving without due care and attention, which needs to be proven through my witness. I did notify the police at the time so they have all details of incident on record. forgot how much fun car insurance can be!
  4. Hmmm well from his point of view that would seem like an easy escape clause for anybody responsible for a minor collision. i.e. Just ignore it and it`ll go away unless the victim takes it upon himself to pursue things? Or am I misunderstanding that one?
  5. Hi I have a company called Minster Law acting on behalf of me who work with my insurance company Smart People Budget. The person dealing with my claim has basically told me not to contact her or the 3rd party insurance company, Fortis, as Fortis have up to 4 (four) months in order for them to contact their client/customer. Therefore I stil have another 4 weeks or so to wait. To date they haven`t managed to contact him and as mentioned before it has become apparant the guy doesn`t even live at the address he has insured his car at. Cheers

  7. Hi I was driven into the back of in May 2009, totally the other guys fault (I have a witness to the accident). Attempts by his insurance company and the Police to contact the guy has failed ever since this point. An enquiry agency has recently sent someone around to his registered address and it has come to light that the address he has registered with his Insurance company he doesn`t live at. The woman that lives there has never heard of this person. Of course she could be lying or he could have recently moved out and not changed his details. Does anyone know where I stand with my claim if they cannot trace him, or at least if they can trace him and he denies all knowledge of the accident after 3 months. He also might have changed his car since. Thanks
  8. Hi Does anyone know the legal obligation of reporting Road traffic Collisions to the Police? I was involved in a very minor bump which did result in minor damage to both cars involved. I was driven into the back of compeltely at the fault of the driver behind me. I reported this to my insurance company as although not visible at the time has incurred £1k damage to the rear cross member, spare wheel well, and rear bumper of my car. His car suffered broken numebr plate, damaged bumper and possibly damage to chassis. Since the accident, his insurance company have failed to make contact with him and he is also ignoring the polices attempts to make contact. The police are sending someone around next week to his house but what legal implications are there for him by ignoring the Police? Should he have reported this to them? Also, should he have reported this to his own insurance company and the police at the time? Cheers
  9. Me again, you mentioned about taking County Court preceedings against the 3rd party if he still fails to get in contact. Could i do this through his insurance company as I don`t have his address details as I guess data protection will prevent them from giving it to me otehrwise. Alan

  11. See this is what I thought! The solicitor was allocated to me as my insurance company works in partnership with Minster Law Solicitors. Therefore, is not one i appointed myself. I agree they should be chasing and taking my intersts as their priority regarding my claim. However...........She said she won`t do this as they have a policy that states the third party insurers have a 4 month period in which to respond to my claim. Then, and only then, will this solicitor chase the 3rd party insurance. in the meantime I have to sit and wait! I appreciate the advice you have supplied and shall ponder on which why to appraoch this based on what you have said. One thing for sure is that I won`t be insuring my car with Smart People Budget next year!
  12. Thanks very much for the reply. Useful info. Just one thing. The solicitor activing on behalf of my claim/insurance company told me categorically not to contact the third party insurer as it might compromise my claim. I personally find this unsupportive and unhelpful advice but as a result, so far, have not contacted them as the solicitor as mentioned above is already getting annoyed with me for chasing her up! even told me she was fed up with hearing my voice! charming!   13. Hi Not sure if you can help or not but I have a query regarding a car insurance claim I am currently putting in for. On 18th May 2009 I was approaching a roundabout on a main road where I was driven into the back of by the car behind me. The insurance repair estimates have been between £1k and £1.5k. I have 2 witnesses to the incident and reported the accident to the Police plus my insurance company within 1 hour (earliest opportunity). The other driver did stop and we had a brief chat. After reporting the accident, my insurance company have managed to contact the 3rd party insurance company successfully who identified it as one of their customers who to this day have not acknowledged any communication by his insurance company. As a result the claim is still up in the air although I do appreciate these things aren’t sorted over night. My concern is that I have since been told by the solicitor acting on behalf of my insurance company that the 3rd party insurance company have a 4month window in which they have to get in contact with their customer and report back to my insurance company. Because I am only 3rd PF&T cover I can’t claim on my insurance in the interim to get my car fixed. My MoT runs out on 25th June 2009 and I am not in a financial position to pay for the repairs myself, therefore leaving me without a car from 25th June. I find this frustrating as the accident was not my fault, yet I am the one being inconvenienced and potentially without transport for anything up to 4 months. Where do I stand with this and is there anything I can do to speed things up? I have been told NOT to contact the 3rd Party insurers OR my own insurance company during this period and that my insurers will contact me when they hear something. The solicitor also told me there is nothing I can do and if I want to get my car on the road I have to pay for it myself and try and claim it back when things get moving. Any advice appreciated.
