  1. recieved p45 today so i take it that suggests they have no intention of paying my 1 months notice they mentioned? can they do this?
  2. They havnt, i got that on Weds, i didnt expect to be tho as surely its all dependant on the appeal anyway, they wouldnt pay it prior to an appeal.
  3. Thanks for the help again. I was going to phone the HR rep who was in my disciplinary to mention that my letter did not state 1 months notice and ask why, surely they cant now go back on this as it was stated in the hearing but has not been put in either my letter or the typed up minutes from the meeting.....can they? i suppose they could just deny it was ever mentioned.
  4. Is there a time limit for them to get back to me, they gave me 14 days so..... Doesnt mention one in the employee handbook. There is not a cat in hells chance of getting my job back....

Dear Mr XXXXXXX On the 21st August 2009 after a Disciplinary Hearing I was informed by XXXXXXX that the company had decided to dismiss me based on an alleged act of Gross Negligence on the USPGA Championship. I would like to appeal against this decision based on the lack of consistent official procedure in place at XXXXXXXX which has made for a very uncertain workplace. Before the date of the Appeal hearing, could you please send me copies of all the Company's documentation relating to the protocols and procedures quoted in the dismissal confirmation letter as, to date, I have never seen any of these documents. I also feel my previous hard work and dedication to improving the XXXXXXX Golf product during my time with the company should have been taken into consideration. Yours S.......

I did manage to find 1 on here that i could try and alter to suit my situation, however if you have experience in doing things like this and could help it would be much appreciated, in reply to above.... I was dismissed on that date. I do now have confirmation, got it yesterday so have 14 days from the to appeal It does confirm it was gross negligence. It does NOT confirm my one months notice i was informed i would get at my hearing. I worked there for almost exactly 3 years. The ways it describes reasons are... failed to manage liabilities in the Tournament I did not communicate or escalate the liabilities position as is estableshed protocol. I also failed to factor in the large bet from the shop estate into the liabilities and then proceeded to authorise a bet from a known monitored customer. Ultimately i failed to hedge any liability thereby turning a very profitable tournament into an effective loss. My actions showed a negligent disregard of standard procedures. It says they have spoken before about similar situations and in this instance i have demonstrated i am prepared to recklessly gamble rather than manage the risk of a situation. In mitigation i stated that shops estate were never considered in the overall liability which i (my boss) would reiterate is incorrect. I also stated there was no procedure as such for escalation or reporting and that there were inconsistencies in how we deal with monitored customers. that's basically the gist of what's on it. Thanks

Thanks for the help, got a benefits meeting today so hopefully i am not on my arse when it come to paying the bills....no idea how much i will get overall but with my mortgage in (£600 pm) my bills we getting on for £1000 a month.... So i need to get myself sorted asap with a job, only had 10 or so days of no work and im ready to crack up already. Cheers again.
  9. Thanks for the replys. Can my partner and i make job seekers claim as a couple even if she IS NOT actively seeking work? I will be taking a 2 month break from my mortgage, will have 2 sort that tomorrow, will have to as i was dismissed on the 21st so will only get a proportion of my wage.....and my 1 month notice will be dalyed until my appeal has failed Can you claim JSA and Tax credits at the same time?? Its been so long since i claimed anything. I have declared an estimated income to the tax office for this year, if i phoned them and informed them i was out of work im worried this would reduce or even stop...its the only weekly income we have (it and CB are the ONLY income we have at moment) and comes in handy weekley. As i said i dont qualify for any working tax credits as my wage was too high. It really is a minefield and there are so many people mainpulating the benefit system it does tempt you to do the same to ensure we dont struggle, especially building up to xmas, but i dont want to do that.
  10. Cheers for the help scousegeezer. I have a number given to me by the job centre to call and see what i can get. May just knock the mortgage on the head for 2 months anyway as im sure there is a wait (as long as 13 weeks) to be able to claim on the mortgage, not ideal as i will be paying bits more when it restarts but i will hopefully be more sorted by then.

Cheers Scousegeezer As i am not working now am i no longer entitled to any tax credits?, if i am will it go up or down?? i declared my exepected income for this year, its very likely to be less now. My partner did not work at all last year, i submitted my earnings a few weeks ago.... Do you know if there is anything i can claim in regards to my mortgage?? I dont thnk its protected, or atleast i cant see it anywhere on the paperwork. Congrats on the new job, hope it works out.
  13. I have been sacked from my job pending an apeal (the thread is in the employment section), i have no idea what i am entitled to claim. There is myself, partner and 2 kids (4 & 1), i have a mortgage that is £592 a month plus other obvious bills (water, Electric, council tax, couch repayments, car & house insurance, cable bills etc) We now have no income apart from child benefit and tax credits and i have no savings and my partner does not work. Does anybody know what i may be entitled to claim, obviously i will be actively seeking a job once my appeal is rejected. Went the job centre (first time in about a decade) and its all changed, they basically dont want any stuff done in person, its all computers and phoning for your entitlement....cant even get in 2 speak to anybody without an appointment. Any help to what i may be able to claim wud be great, my mortgage is due to come out in just under a week, i can take a payment holiday for 2 months (i know it will cost me a few quid in the long run) that may be me only option as im not getting a full months pay this month as i was sacked 21 days into the month.....
  14. I was dismissed with a months notice. I have 14 days from when i recieve written confirmation to appeal. Any idea what happens at these appeals?? Gross negligence apparently, for not following a procedure that exists only by way of word from my boss, never been told it was actual procedure and what would happen if it was not followed.
  15. The likeliness is that even if they cant prove gross misconduct they will sack me anyway and take there day in court...big company can afford to take on 1 person.
  16. No there is not any evidence. They are stating that i did not adhere to processes..there are no processes,i have never seen or signed anything to confirm i am aware of these processes. 1 of which is make a my boss aware of large bets, again we recieved nothing to state this must be done, we just generally do it to let him know however this is not a set process that i have signed anything saying i agree to do it...
  17. Right, got my letter and reason for suspension is as mentioned, with it came a summary of various reasons though some stretching a few months ago. In these they are stating informal chats as me being told to do something, ie my boss and i had a meeting regarding certain things that are proving unprofitable, again it was informal, i didnt sign anything to state it was a formal chat to tell me to buck these up or else, however they are relying on them as evidence,, can they do this? In these meeting no solutions or training was offered to me to help me improve them,indeed my manager agreed that the processes used were corect and he could think of no reason why these markets were under performing.
  18. I am getting the info regarding the Limits sent to me I am told they i have been suspended on what i have said above. I have not been given any supporting evidence, are they legally obliged to provide me with it?

I have just phoned then to request a copy of my personal file, they informed me they can delay that by 40 days so i wont get it in time for hearing, i was told there is nothing in it relating to the incident in question...do i have he right to delay the hearing or should i just accept there is nothing in it??
  20. Hi. I have been suspended from work pending investigation, i work in the betting industry and the reason for suspension has been confirmed as 'failure to manage liabilities on an event'. Yet the liabilities on the mentioned event, never exceeded the companys structure therefore i was under no obligation to act in a certain way (im not sure if you are familiar with the betting industry). They are also trying to put together to sets of figures, 1 from the companys shops and 1 from the companys telebetting and internet business and merging them to create 1 big liability, until now these figures have always been treated seperatly and have had no bearing on each other. They are claiming with the 2 combined should have acted, yet still wih these 2 combined the bet did not exceed set limits i have been informed to trade to. Anyway,my hearing is possibly friday i am told, is there anything i should do to prepare, who should i contact if anybody and from what brief facts i have stated above do they have a case as i am struggling to see 1. Thanks for any help.
  21. Thanks HC, finally how do i get the council to accept payment from me, they have already told me (i phoned today) i have to deal with the bailiff now. Is there anything that i can say if they refuse to deal with me, do they have to accept payment from me if i offer it in full? Again, your help has been greatly appreciated.
  22. I phoned the council direct and they say i now have to deal with the bailiff. I no longer live in there borough. I just read section 36 on the council tax regulations and i cant make head or tail of how the clears my liability if i offer to pay them. If i did this wouldnt they bailiffs still pursue me for there costs?
  23. Thanks for the replies.. HC, the council did send me some letters to my current address and issued a ccj, i then phoned up the council and arranged to make payments, i manually paid the 1st £10 and there was due to be 7 or 8 more payments after i had sent them my bank details to set up a direct debit, this was never set up i found out today. I then recieved a basic letter out of the blue from rosendales a few months ago saying i still owed council tax from my previous address, which i ignored, then the bailiff turned up on my door and spoke to my fiance as i was in work, he turned up with a van, i phoned him the next day and told him i wanted to speak to my bank to check it hadnt been paid... and thats where i am currently up to. I can get the money to pay him as it would be easier, i dont want him coming around bothering my family when i am working......not sure what to do, if it was just me i wouldnt pay, i would fight it as a lot of people seems to have done on here but anything could happen whilst i am working and that concerns me, even more than paying the excessive fine. If i did pay him is there a guarentee that all the debt (council tax and bailiff fees) will be cleared..? Feel like a bit of a cop out wanting to pay it but dont want my family feeling scared to leave the house.
  24. To add i spoke to the council involved and they have said i have to deal directly with the bailiff now. There part of the debt is £102, so Rosendales part is £180...how? I would like to fight this but have a fiance and 2 young children who are left at home when i go to work who i dont want to be left to deal with them. I was advised its best to start a new thread. thanks
