  1. I posted the letter yesterday requesting my CCA again. However today I recieved this response from a previous request that did not fully outline why their previous CCA documentation was unaceptable, unlike the latest letter I sent. Looks promising to me....any thoughts?

I had come to the conclusion that the debt was valid...I have previously looked for advise on this matter but it seems that there's not many people around with experience of this type of credit facility. As a complete novice I was granted access to thousands of pounds by barclays to trade with as I pleased. I was supposed to be able to pay any money back within a few days. I tried to take advantage of this, but things backfired. The markets crashed and soon after Barclays sold all my holdings (without warning) at a loss to cover my debt. Due to a shortfall I ended up owing them over a Grand and losing all my holdings that I had previously built up. If there is scope to refute this debt I would certainly be interested. I know it was my own fault for taking a risk when borrowing this money, but I was not happy when they sold everything without warning. I rang them when this happened and they told me they had sent me a letter, but I did not recieve any such correspondance.

I note that you confirm that the documents enclosed in your letter dated 23 March are a true copy of an original credit card agreement executed by you on unknown date. I note that your have enclosed the following documents:-: A three fold general leaflet entitled “Important Information about your capital one credit card” and further endorsed:- This is a copy of your agreement for you to keep. A separate letter referring to my recent request and which purports to contain current terms of an agreement with you on the reverse As you must realise these documents which together you allege are a true copy of an original credit card agreement do not conform to sections 60(1) and 61(1) of the Consumer Credit Act 1974 and would therefore only be enforceable by a court under s65. The absence of a properly executed agreement containing my signature and the prescribed terms within the same document means that a court would be prevented from enforcing it under s127(3). I notice that you have stated that your letter is your final response in relation to this matter therefore I assume that Unless you can produce a copy of an executable agreement within 21 days I will consider that the above account is now closed and that you will not pursue the alleged debt further.   7. Looks like they are struggling to find an enforceable CCA to me. Fingers crossed!
  8. Looks like my lastest letter finally hit home, just recieved this below. I think I'll agree and start paying the £10 a month, then offer then offer a reduced full and final settlement when I can afford to.
  9. Now recieved this from Cap 1 Perhaps I should send them a letter stating they have not provided me with a true copy of my CCA and therefore the account remains in dispute. Any thoughts?

  11. Just recieved this letter, I presume it is an update for the Account Dispute letter I sent them.
  12. ha...and that won't be happening! Do you I should respond in writing or just wait and see what there next move is....I don't want to write letter just for the sake of it though!
  13. Just had a response back from power2contact thanking me for my correspondance and confirming that my letter will be forwarded on to capital one.
  14. Just recieved the following letter, I have no intention of taking them up on their offer whilst I am without enforceable CCA and account is in dispute. Any opinion on this latest correspondance? Thanks
  15. After viewing this CCA with Windows Photo Viewer with the zoom tool I think this is a fraud. It has several parts that have been copied and pasted to produce a CCA that looks authentic. I have compared it to another Caggers CCA (see link below) that is very similar to mine and the paragraph's and signatures boxes are not in line with each other.   16. They have not terminated the account yet, I'll keep quiet until they do. The letter itself is also dated the 29th April, so they have shot themselves in the foot, without me keeping the envelope, as they have only allowed 10 days if I recieved it the same day! thanks.
  17. So far I have requested my CCA from HSBC for my Flexi Loan, this has not been recieved so I have sent them an Account Dispute letter. HSBC have acknowledged my initial request and informed me that they are looking into my request. However, I have recently recieved a Default Notice which served me less than 10 day to comply. Please see below. Can any advise me on how to play this, I have been told that they must give a minimum of 14 days!

The covering letter states; In accordance with section 78 of the Consumer Credit Act 1974, we enclose a copy of the credit card agreement (original and current) including applicable terms and conditions, and your most recent statement of account. We appreciate the copy of the original agreement is not very clear but it is the best copy we can provide. For the avoidance of any doubt, all of the necessary and prescribed are included in the credit agreement and in addition we have also provided you with. If anything needs clarifying please call.... blah...blah...blah This looks very strange to me! This is the bottom third of a form and the second side looks like copy and paste job! If you look carefully in the botton left hand corner you can see the top edge of some text that they have chopped. Also non of the codes match each other. Another thing is that there is not any mention of is the PPI they miss-sold to me! Any opinions welcome! thanks in advance! I've blew it up a bit but its still really unclear.
