Liverpool Victoria Flexi Loan CCA Enforceable?

If this is a valid CCA does anyone have any ideas on how I could get this debt reduced? Should I start paying them reduced repayments, that I have already proposed to them? -

Davey, thanks for your very informative thread. I too have just recieved an identical CCA to yours and will follow in your footsteps with a view to make a reduced F+F settlement sometime in the future. I will start my own tread soon. -
I have again written to CD(UK) asking them to accept my repayment proposal based on my affordable funds after all essentials. Today they repliead with a letter stating; Dear sir, when you purchased the shares you were not given an instalment facility, you supposed to have the funds available. You will not get a facility to repay this debt at £**'s per month, even through the court. We suggest you now contact a solicitor to act on your behalf as will be taking further action for the recovery of this debt. You now have until the 30th March 2009 to find the £****'s (full ballance) if you with (assumed typo, should be 'wish') to prevent further action. TREAT THIS MATTER AS VERY URGENT. Does any one have any advise? I cannot pay in full or offer them an increased offer as this would affect my repayments to my other creditors. Should I stick to my guns? are they likely to take me to court? would a judge make me pay in full although I can't afford it? Thanks

Thanks to you both. Can I send the letter recorded to Mercers at PO Box 55, Liverpool, L32 8XX. Or do I need to delete the PO Box 55 part from the address?

Yesterday I recieved a letter from Mercers informing me that they are now acting as agents for barclaycard and that I must pay £**'s. Today they called me at home and asked me to answer some security questions, I refused as I could not be certain who was calling me and I'm not in the habit of giving strangers my personal details. I also informed them that I will only correspond with them and barclaycard in writing, and not to bother calling me again. The lad on the end other end of the phone seemed stuck for words and said, OK! before hanging up! As Barclaycard's CCA is unenforeable should I send Mercers the letter of Account Dispute that starts off "I must admit that I rather bemused as to why this account has been passed to yourselves"? or is there another more appropriate response? Thanks

I thought that would be the case, I just needed clarification. I have CCA'd twelve creditors and so far it looks like half of the debts I hold will be unenforceable. I will begin to take a different stance with mint and look to make reduced payments with a view to make a reduced final settlement sometime in the future. Thanks for the advice. -

I origionally posted this tread in the General Debt Issues section, however I have not had any response so far. I thought I might do a liitle better in this section. If anyone could give me any advise on enforcability of the CCA it would be greatly appreciated. I have accumulated about 12 creditcards over the last 8 years, mainly due to taking advantage of balance transfer offers. Over last 2 years I have managed to get myself into a bad position and ended up maxing most of them. Now I need to do something about, hopefully without having to make myself bankrupt.

Can anyone advise if this CCA is enforceable? The first 3 sheets are from the same document and the final 2 are both stand alone documents. Bump...any views on this CCA. I have a feeling it will enforceable, unless anyone can see anything that I have missed? Can anyone help me out with this CCA? I think it may be unenforceable as the signed 3 page document is titled Summary of your application and does not contain details of a credit limit, in the Right to Cancel section it states that I have a short term to do so rather than the 14 days required. The following two pages they have provied are not part of the same document. The first is the covering letter for my card and the second is my current T&C's. all advise is really appreciated. thanks Can anyone give me any advice if this is or isn't an enforceable CCA. I feel I will have to offer to make reduced payments to Mint again if I cannot dispute the account. Obviously I'd prefer not to! Thanks OK....here's my DN followed by Termination. At the moment I am planning to deal with all my creditors first hand. This is because I am currently in the process of CCA request and hope to get some of my debts written off or to make reduced Final Sttlement offers in the future. If I hand everything over to the charity I will have to pay out all of my spare funds. If I deal direct I hope to be able to pay CDUK a bare mininum. I will a requst that they accept my payment proposal and provide me with a paying in book or details to set up a standing order (again). any further advise or opinions are welcomed. Thanks
