  2. Hi Shadow. I have attached a copy of the Terms & conditions they sent, they have not confirmed in any way they are from the same document. I am not sure but wondering why they is not a signature at the end of the terms & conditions if it was one document. I also have an invlaid default as well. Hope this helps to comment further!   3. Hi there. I asked A solicitor to write to skycard to explain that I have been requesting on many occassions for a valid agreement. They continue to send the same unenforceable application form and i have posted up skycard's reply for all to see and make comment! Just to inform you about my earlier posts, they have sent an invalid default notice and termination letter and many threatening letters that it will be sent to a debt collection agency, so still waiting. Please not the gaps are mainly my name!

Ok I have sent CCA reuest and the SAR route and have still only recieved an application form and terms & conditions in a separate document that are from a later date than the date on the application form. I have also recieved an invalid default notice as it does not state a date that the arrears need to be paid by. All the above is in recent posts!! I have now received a letter from Moorcroft which is enclosed below. Can someone please give me some advice on what I should do next.

  6. Cheers all Are you saying a should get a reduction in the amount they are asking or can the amount be reduced to zero due to their responsibility of not reading my meter. Is it true that they can also only expect an estimation for twelve months and not two years
  7. They have been sending me an estimate bill for two years. When they have put in a new water meter they have waited a month and then estimated my bill from the last two years, from my usage from this month. Can they do this! So any suggestions what i should do!
  8. Hi All Apparantly my water meter has not worked for two years. They have decided to estimate my usage for the two years and have now sent a revised bill. It started when I was in credit by several hundred pounds and asked for a payment of my credited funds. They have now changed my water meter and sent me a new bill where I now owe them several hundred pounds. Can they do this? Whose reponsibility is it to check the water meter regularly that it works and to read the meter. Also can they estimate the usage for the whole two years. Appreciate as always the sound advice received! Johno
  9. Thanks all for your excellent advice. I have read another thread with the same CCA as me and all comments state it is unenforceable. So will just sit back and wait for their next step!!

  11. Cheers all for your help. Yes maverick i have done the SAR to Argos, have just sent a letter stating they have not responded fully to this request. They have sent the application form (dated Feb 04)posted earlier in this thread and terms & conditions dated May 06. So they can not even produce the terms & conditions from when the alledged account was opened. Hope it helps!! Johno

  14. cheers Citizen not sure about postage as no did not keep envelope. I will go on the basis that it is second class, then they have to prove it was first. would not waste a stamp sending them anything! But why do you not send any card back to them? Also what are my steps to take now! Do not think there is a default on my credit file as yet. What does it really mean as they have an invalid DN, what am i able to do to get it removed and pay the arrears if this is all i have to pay! thanks Paul J
  15. Today i Have sent the formal request CPR letter off today. They have another 21 days, then it will be the final letter and court for disclosure!! Here goes!!
  16. DN notice sent I think by first class but cannot prove it. Can you believe they have sent me this notice when i sent them a complaint letter on the 24th April 09, then the main office in London sent me a letter telling me on the 7th May they were looking in to the matter and giving me the banks final response with in 30 days. Still not heard anything.
  17. well i have still had no reply to my complaint regarding claiming interest back from when the account was in dispute from taking 5 months to supply me valid CCA. I have made it clear to HSBC once they repay the interest i will make payment. Typical bank that dont listen or read any letters. They have now sent me a DN notice that only gives 14 days from date of the letter. How bizarre of them. What should i do now, wait for them to pass it to a DCA. Also the main office were meant to be giving me a final response with in 30 days but still issues me with an invalid default notice. Do they not want paying, i only wanted approx £300 and then would have to pay £2500 on a credit card, seems so daft of them, that they prefer to receive no money and default me instead of receiving money!!
  18. sound thanks, just waiting now till they pass the debt to a CRA then offer a F&F of arrears I think of £400. As they have also sent me a dosgy DN highlighted in earlier posts on this thread. many thanks

  21. Hi All I have received the following default notice today 22nd June as it was sent 2nd class. It says 14 days to pay arrears from when I receive this notification. It does not actually give a date that it needs to be paid by. The account is currently still in dispute. Can someone please advice on wether the notice is valid. Many Thanks
  22. Did the Montreal Convention not change in 2004 where it meantions that the airlines are obliged to pay up to £850 when they lose luggage! Johno23

  24. is there any links to any threads where caggers have been successful in removing defaults when it is a disputed account & invalid DN. Would it be wise to start court procedings then! Johno23
